08-12-1985 Minutes CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS AUGUST 12, 1985 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City-County Building, on Monday, August 12, 1985, at four p.m. There were present: Mayor Merle A. Hodges, Chairman presiding Commissioner John F. Burgess Commissioner Joseph M. Ritter Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: L. O. Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting August 5, 1985. (6.2) Resolution Number 85-3802, establishing the building inspection and permit fees pursuant to Section 2-2 of the Salina Code. (6.3) Resolution Number 85-3803, establishing the mechanical insepction and permit fees pursuant to Section 2-2 of the Salina Code. (6.4) Petition Number 3908, filed by Gilbert and Erma Wenger, protesting the rezoning of Lot 26, Hazelwood Addition from R-2 to C-1. [Z85-8, filed by Dr. Thomas Taylor]. ( Referred to City Planning Commission for recommendation. ) (6.5) Petition Number 3909, filed by Sanford Bank, president of Salina Iron and Metal, and C. Dale Lyon, president of Salina Coffee House, Inc. requesting the vacation of the north-south alley between Fourth and Fifth Streets, and north of Elm Street to the railroad tracks. (Referred to City Engineer for recommendation. ) (6.6) Petition Number 3910, filed by Rainbow Child Care Center, for a waiver of Section 35-133 of the Salina Code to permit the construction of a circular driveway on the South ½ of Lot 17, Ninth Street, Prescott Addition. (8.5) Second Reading Ordinance Number 85-9087 - providing for the amendment of certain sections of Chapter 5 of the Salina Code relating to the legal age for the consumption of cereal malt beverage, the sale of cereal malt beverages to persons under the legal age for consumption of cereal malt beverages; amending Sections 5-66, 5-71, 5-72, 5-73, and 5-102 of the Salina Code, and repealing the existing sections. 85-176 Moved by Commissioner Soderberg, seconded by Commissioner Ryan that Ordinance Number 85-9087 providing for the amendment of certain sections of Chapter 5 of the Salina Code relating to the legal age for the consumption of cereal malt beverage, the sale of cereal malt beverages to persons under the legal age for consumption of cereal malt beverages; amending Sections 5-66, 5-71, 5-72, 5-73, and 5-102 of the Salina Code, and repealing the existing sections be adopted. (8.9) Consideration of a request by Commissioner Soderberg to delay payment in lieu of taxes by the Salina Housing Authority. Commissioner Soderberg asked for the consent of the City Commission to allow the Salina Housing Authority to accumulate a $36,000 reserve fund and to pay its in lieu of taxes for fiscal years 1977 to 1983 within the next ten years. No action was taken on this request. (8.10) Consideration of a request by A. L. Botts for permission to operate a taxi cab company in the City. (Action was postponed from the July 15, 1985 meeting for 30 days.) 85-180 Moved by Commissioner Ritter, seconded by Commissioner Ryan that Mr. A. L. Botts' request to operate a taxi cab company be approved, and that the City Clerk be authorized to issue licenses to Mr. Botts after he meets all requirements of the Salina Code for taxi cab companies. (8.11) Capital Improvement Program for the years 1986 through 1990. 85-181 Moved by Commissioner Soderberg, seconded by Commissioner Ryan that a recommendation be made to the City Planning Commission to adopt the revised Capital Improvement Program for the years 1986 through 1990.
