12-01-2003 MinutesCommission Action # CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS December 1, 2003 4:00 p.m. The City Commission convened at 3:30 p.m. in a Study Session for Commission Open Discussion Time. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City -County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. There were present: Mayor Alan E. Jilka, Chairman presiding Commissioner Deborah P. Divine Commissioner Donnie D. Marrs Commissioner Monte D. Shadwick Commissioner Paul G. Webb comprising a quorum of the Board, also present: Dennis M. Kissinger, City Manager Greg Bengtson, City Attorney Lieu Ann Elsey, City Clerk Absent: None CITIZEN FORUM None. AWARDS - PROCLAMATIONS None. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of November 24, 2003. 03-6198 Moved by Commissioner Divine, seconded by Commissioner Marrs, to approve the consent agenda as presented. Aye: (5). Nay: (0). Motion carried. DEVELOPMENT BUSINESS (7.1) Second reading Ordinance No. 03-10142 annexing the unplatted portion of Mariposa and a portion of Cloud Street into the corporate limits of the city. Mayor Jilka confirmed that Ordinance No. 03-10142 was passed on first reading on April 28, 2003 and since that time no comments have been received. -- 03-6199 Moved by Commissioner Shadwick, seconded by Commissioner Divine, to pass Ordinance No. 03-10142 on second reading. A roll call vote was taken. Aye: (5) Divine, Marrs, Shadwick, Webb, Jilka. Nay: (0). Motion carried. ADMINISTRATION (8.1) Second reading Ordinance No. 03-10175 adopting the East Salina Master Plan as an amendment to the Comprehensive Plan. Mayor Jilka noted that Ordinance No. 03-10175 was passed on first reading on November 24, 2003 and since that time no comments have been received. Commission Action # 03-6200 Moved by Commissioner Webb, seconded by Commissioner Divine, to adopt Ordinance No. 03-10175 on second reading. A roll call vote was taken. Aye: (5) Divine, Marrs, Shadwick, Webb, Jilka. Nay: (0). Motion carried. (8.2) Second reading Ordinance No. 03-10176 providing for a change in zoning district classification from R-2 (Multi -Family Residential) to R-3 (Multi -Family Residential) on property addressed as 330 and 332 S. Ohio Street. Mayor Jilka clarified that Ordinance No. 03-10176 was passed on first reading on November 24, 2003 and since that time no comments have been received. Commissioner Divine questioned the immediacy of adopting the ordinance and proposed second reading be postponed until the Ohio Street Corridor study has been presented to the commission. 03-6201 Moved by Commissioner Divine, seconded by Commissioner Shadwick, to postpone the consideration of Ordinance No. 03-10176 on second reading until the Ohio Street Corridor study has been presented to the City Commission. Aye: (5). Nay: (0). Motion carried. (8.3) First reading Ordinance No. 03-10180 amending Chapter 34, Article III, Section 34-52 of the Salina Code by adding provisions pertaining to adoption of administrative regulations and variations from vehicle standards. Dennis Kissinger, City Manager, explained that Salina Code Section 34-51 establishes specific minimum standards and requirements for vehicles transporting comrnercial and residential refuse in Salina. The amendment to Section 34-52 would allow the City Manager flexibility to approve a variation from the standard requirements, as long as public health and safety is comparably protected. 03-6202 Moved by Commissioner Marrs, seconded by Commissioner Shadwick, to pass Ordinance No. 03-10180 on first reading. Aye: (5). Nay: (0). Motion carried. (8.4) Resolution No. 03-6013 authorizing and directing the issuance, sale and delivery of General Obligation Temporary Notes, Series 2003-3. Rodney Franz, Director of Finance and Administration, explained the proceeds from General Obligation Temporary Notes, Series 2003-3 will be used to provide interim financing for public improvements in the RiverRun Subdivision. Mr. Franz continued to explain that five bids were received and the lowest bidder was Commerce Bank with an average rate of 1.550273%. He then clarified what improvements were being financed through the temporary notes, as requested by Commissioner Shadwick. 03-6203 Moved by Commissioner Marrs, seconded by Commissioner Webb, to adopt Resolution No. 03-6013. Aye: (5). Nay: (0). Motion carried. OTHER BUSINESS (9.1) Dennis Kissinger, City Manager, noted that the City has over 1,000 applications for the recycling program and will continue to accept applications until December 10, 2003.
