REGULAR MEETING OF THE BOARD OF COMMISSIONERS
SEPTEMBER 9, 1985

The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City-County Building, on Monday, September 9, 1985, at four p.m.
There were present:
Mayor Merle A. Hodges, Chairman presiding

AWARDS- PROCLAMATIONS
(4.1) The Mayor proclaimed the Week of September 17 through 23, 1985 -
"CONSTITUTION WEEK". The proclamation was read by Loberta Schwartz,
Constitution Week Chairwoman, Dale Wade Strother Chapter of the Daughters of
the American Revolution.
(4.2) The Mayor proclaimed the Week of September 9 through 13, 1985 -
"HUMAN RELATIONS WEEK". The proclamation was read by Joe Stewart,
Chairman of the Human Relations Commission.
(4.3) The Mayor presents plaques of appreciation to past board and
commission members: John Mize, Board of Building Appeals; Kenneth N. White,
Board of Zoning Appeals; Kay Kent, Building Code Advisory Board; Morrie
Soderberg, Business Improvement District Number 1 Advisory Board; Kenneth N.
White, City Planning Commission; Russ Jones, Heritage Commission; Rev. J. E.
Jones, Housing Advisory and Appeals Board.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Public Hearing on the proposed assessments for Engineering
Project 83-712 for the improvement of Crawford Street from Marymount
Road to the East city limits.
(5.1a) Introduce Assessment Ordinance 85-9093 for first reading.
There were no protests, written or oral, filed and the Mayor declared
the public hearing closed.
85-192 Moved by Commissioner Burgess, seconded by Commissioner Ritter that
Ordinance Number 85-9093, levying special assessments on lots, pieces, and
parcels of ground in the City of Salina for the purpose of paying a portion of
the cost of curbing, gutering, paving, grading, compaction, drainage structures
and utility improvements in Crawford Street from the east line of Marymount
Road to the East City Limits, be adopted. Aye: Burgess, Ritter, Ryan,
Soderberg, Hodges (5). Nay: (0). Motion adopted.
CONSENT AGENDA
(6.1) Approve the Minutes of the Regular Meeting August 26, 1985.
(6.2) Petition Number 3914, filed by The Brown Mackie Corporation
for curbing, guttering, paving, grading Foxboro Drive to serve ali lots
in the proposed Wheatridge Addition. [Refer to the City Engineer for a
recommendation ]
(6.3) Petition Number 3915, filed by Hixson and Lehenbauer, for the
naming of a street north of Hixson Drive to Atkinson. [Refer to Planning
for a recommendation]
(6.4) Request by a number of residents affected by the continuing
dust problem on an unimproved section of Smoky Hill Drive for the
reconsideration of Petition Number 3878. [Refer to the City Engineer for
a recommendation ]
(6.5) Resolution Number 85-3805 - relating to benefits obtainable by
cities under the program for federal and state aid on highway
construction. [Project 85U-1040-01 installation of a traffic signal system
at the intersection of Ohio Street and Albert Avenue]
85-193 Moved by Commissioner Ritter, seconded by Commissioner Ryan that all
items on the Consent Agenda be approved. Aye: (5). Nay: (0). Motion
adopted.
DEVELOPMENT BUSINESS
(7.1) Recommendation by the City Planning Commission that Petition
Number 3905, filed by Ron Barta, attorney for the Country Estates Owners
Association, Inc. for an amendment of the protective covenants of the
Country Hills Estates, be approved.
85-194 Moved by Commissioner Burgess, seconded by Commissioner Soderberg
that the recommendation of the City Planning Commission be accepted and that
the amendment of the protective covenants of the Country Hills Estates
be approved. Aye: (5). Nay: (0). Motion adopted.
(7.2) Recommendation by the City Planning Commission that Zoning
Application 85-9, filed by Thomas Taylor for the rezoning of Lot 27,
Hazeiwood Addition to C-1, Restricted Business District, be approved.

85-195 Moved by Commissioner Soderberg, seconded by Commissioner Burgess
that the recommendation of the City Planning Commission be accepted and that
Zoning Application 85-9 be approved, and that Ordinance Number 85-9094
providing for the amendment of Ordinance Number 8526, the same being Chapter
42 of the Salina Code, and the Zoning District Map therein and thereby adopted
and providing for the rezoning of certain property within the City and
prescribing the proper uses thereof, be introduced for first reading. Aye:
(5). Nay: (0). Motion adopted.
(7.3) Recommendation by the City Planning Commission that PDD application
85-2, filed by H. W. Steele for the rezoning of Lots 1 through 6, Block 9,
Belmont Addition to a planned development district, be approved. [Introduce
Ordinance Number 85-9095 first reading]
85-196 Moved by Commissioner Burgess, seconded by Commissioner Ryan that
the recommendation of the City Planning Commission be accepted and that
Planned Development District 85-2 be approved, and that Ordinance Number
85-9095, providing for the amendment of Ordinance Number 8526, the same being
Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby
adopted and providing for the rezoning of certain property within the City and
prescribing the proper uses thereof, be introduced for first reading. Aye: (5).

ADMINISTRATION
(8.1) Second Reading Ordinance Number 85-9092 providing for the
vacation of a portion of a certain north south alley located between
Fourth Street and Fifth Street, from the north line of Elm Street to a
point 25 feet north of the southeast corner of Lot 37, Fifth Street,
Original Townsite.
85-197 Moved by Commissioner Ritter, seconded by Commissioner Soderberg
that Ordinance Numnber 85-9092, providing for the vacation of a portion of a
certain north south alley located between Fourth Street and Fifth Street, from
the north line of Elm Street to a point 25 feet north of the southeast corner
of Lot 37, Fifth Street, Original Townsite, be adopted. Aye: Burgess, Ritter,
Ryan, Soderberg, Hodges (5). Nay: (0). Motion adopted.
(8.2) Recommendation by the City Engineer that Petition Number 3902,
filed by Sunset Plaza, Inc. for the vacation of YMCA Drive be approved.

85-198 Moved by Commissioner Soderberg, seconded by Commissioner Ryan
that the recommendation of the City Engineer be accepted and that Ordinance
Number 85-9096, providing for the vacation of YMCA Drive in Westbend Addition
to the City of Salina, Saline County, Kansas, be introduced for first reading.
Aye: (5). Nay: (0). Motion adopted.
(8.3) Recommendation by the City Engineer that Petition Number 3912,
filed by Dale Hanzlicek for the vacation of Sprecker Drive be denied.
85-199 Moved by Commissioner Burgess, seconded by Commissioner Soderberg
that the recommendation of the City Engineer be accepted and that Petition
Number 3912 be denied. Aye: (5). Nay.' (0). Motion adopted.
(8.4) Report by Board of Advisors of Business Improvement District # 1
on property acquisition for parking and arcade improvements.
John Poos, Chairman of the Business Improvement District Advisory
Board, stated that the Board recommends that the city purchase 12 downtown
buildings and two parking lot properties for this project.
Dan West explained the plan to the City Commissioners concerning the
number of additional parkin§ spaces, cost of property and the pedestrian
arcades.
Mayor Hodges said no action would be taken today, that it will be
on the agenda on September 16, 1985.

the Regular Meeting of the Board of Commissioners be adjourned. Aye: (5).
