02-03-1986 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS FEBRUARY 3, 1986 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, February 3, 1986, at four p.m. There were present: Mayor Merle A. Hodges, Chairman presiding Commissioner John F. Burgess Commissioner Joseph M. Ritter Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: Greg Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Month of February, 1986 - "AMBUC MONTH". The proclamation was read by Larry Adam, District Visibility Chairman of Region 5 of Ambucs. (4.2) The Mayor proclaimed the Week of February 2 through 8, 1986 - "BOY SCOUT WEEK". Lindy Lorenson, District Chairman of the Three Rivers District of the Boy Scouts of America introduced Thane Hager, a Boy Scout, to read the proclamation. (4.3) The Mayor proclaimed the Month of February, 1986 - "CHILDREN'S DENTAL HEALTH MONTH". The proclamation was read by Charlie Ritter, Chairman of Children's Dental Health Month Committee of the Salina Dental Health Society. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting January 27, 1986. (6.2) Authorize the Mayor to sign an acknowledgement with United Securities, Inc. giving permission to include the City of Salina in a request for allocation from the State of Kansas for the issuance of Single Family Mortgage Revenue Bonds with Saline County. (6.3) Recommendation from the Design and Review Committee of the Business Improvement District that a request by Robert Bostater to use 4 feet of sidewalk adjacent to the Huntsinger Store in the 100 Block of South Santa Fe be approved and the Mayor be authorized to sign an agreement between the City and Mr. Bostater. 86-017 Moved by Commissioner Ritter, seconded by Commissioner Burgess that all items on the Consent Agenda be approved. Aye: (5). Nay: (0). Motion adopted. 86-018 86-019 86-020 DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 85-20, filed by James and Coralene Jarvis, for the rezoning of Lots 2 and 4, Block 1, Pacific Addition to District 1-2 be approved. [ Introduce Ordinance Number 86-91201 Moved by Commissioner Ritter, seconded by Commissioner Burgess, that the recommendation of the City Planning Commission be accepted and that Zoning Application 85-20 be approved and that Ordinance Number 86-9120 providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. Aye: (5). Nay: (0) . Motion adopted. (7.2) Recommendation from the City Planning Commission that Zoning Application 85-21, filed by Wallace W. Storey, for the rezoning of Lots 11 through 20, Block 1, Calkins Addition to District 1-2 be approved. [ Introduce Ordinance Number 86-91211 Moved by Commissioner Soderberg, seconded by Commissioner Burgess, that the recommendation of the City Planning Commission be accepted and that Zoning Application 85-21 be approved and that Ordinance Number 86-9121 providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. Aye: (5). Nay: (0) . Motion adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 86-9119 - providing for management of the flood plain, creating floodway and floodway fringe districts, defining the same and setting forth regulations therefor; amending Article VIII of Chapter 42 of the Salina Code and repealing the existing article; amending Article XIV of Chapter 42 by adding Sections 42-625.1, 42-629.1, 42-629.2, 42-634.1, 42-656.1, 42-668.1, 42-668.2, 42-668.3, 42-668.4, 42-673.1, 42-674.1, 42-674.2, 42-676.1, 42-679.1, 42-690.1, 42-722.1, 42-782.1, 42-731.1, 42-758.1, 42-785.1, 42-794; amending Sections 42-676 and 42-751 and repealing the existing sections. Max Morgan, on North 5th Street, and Katherine Saum, 1533 North 5th, stated this ordinance will hurt the value of their property. They asked if the federal government is going to buy the land at the appraised value if the property owner cannot rebuild if there is damage over 50 percent? Moved by Commissioner Soderberg, seconded by Commissioner Burgess, that Ordinance Number 86-9119, providing for management of the flood plain, creating floodway and floodway fringe districts, defining the same and setting forth regulations therefor; amending Article Vlll of Chapter 42 of the Salina Code and repealing the existing article; amending Article XIV of Chapter 42 by adding Sections 42-625.1, 42-629.1, 42-629.2, 42-634.1, 42-656.1, 42-668.1, 42-668.2, 42-668.3, 42-668.4, 42-673.1, 42-674.1, 42-674.2, 42-676.1, 42-679.1, 42-690.1, 42-722.1, 42-782.1, 42-731.1, 42-758.1, 42-785.1, 42-794; amending Sections 42-676 and 42-751 and repealing the existing sections, be amended by substituting "may result" in place of "results" in Section 42-427(a); Section 42-442(a) be amended to read "New construction of substantial improvements of residential structures shall be required to have the lowest flood including basement, elevated to or above the base flood elevation."; that Section 42-783 be added, which amends the definition of structure by adding "(b) 'Structure' is anything constructed or erected with a fixed location on the ground, or attached to something having a fixed location on the ground.", and adopted as amended. Aye: Burgess, Ritter, Ryan, Soderberg, Hodges (5). Nay: (0). Motion adopted. OTHER BUSINESS The Mayor, with the approval of the City Commissioners, made the following appointments: Heritage Commission Paul F. Anderson, Historian or Archaeologist, appointed to fill the unexpired term of Imogene Campbell to November 26, 1988 Wilma Dorsey, Member at large, appointed to succeed Naomi Wooster, for a 3 year term to November 26, 1988 ADJOURNMENT 85-021 Moved by Commissioner Ryan, seconded by Commissioner Burgess, that the Regular Meeting of the Board of Commissioners be adjourned.
