ORDINANCE NUMBER 15-10789 AN ORDINANCE AMENDING SALINA CODE SECTION 1-8 PERTAINING TO PREVAILING FEDERAL OR STATE LAW AND CONFLICT BETWEEN CODE PROVISIONS, AND REPEALING THE EXISTING SECTION. BE IT ORDAINED by the Governing Body of Salina, Kansas: Section 1. Amendment. Salina Code Section 1-8 is amended to provide as follows: Prevailing Federal or State Law and Conflict Between Code Provisions. (a) When a provision of this Code is found to be in conflict with federal or state law, the applicable federal or state law shall prevail to the extent necessary for the conflicting provision of this Code to be enforced consistently with federal and state law. (b) Where a provision of this Code is found to be in conflict with a provision of any other provision of this Code, the provision which establishes the higher standard for the promotion and protection of the public health and safety shall prevail. Section 2. Repealer. Existing Salina Code Section 1-8 is repealed. Section 3. Effective. This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper by the following summary: Ordinance No. 15-10789 Summary On August 10, 2015, the City Commission passed Ordinance No. 15-10789.
