04-14-1986 Minutes86-066 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS APRIL 14, 1986 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, April 14, 1986, at four p.m. There were present: Mayor Merle A. Hodges, Chairman presiding Commissioner John F. Burgess Commissioner Joseph M. Ritter Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: Greg Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of April 20 through 26, 1986 - "ENVIRONMENTAL HEALTH WEEK". The proclamation was read by Jo Johnson, Salina -Saline County Health Department. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting April 7, 1986. (6.2) Report on bids received April 10, 1986 for vehicles and equipment. (6.3) Resolution Number 86-3841 - Amending Section III -2 of the Personnel Manual regarding pay periods and repealing the existing Section III -2; amending Section III -3 of the Personnel Manual regarding overtime pay and repealing the existing Section III -3 as set forth in Resolution Number 82-3617; and amending Section V-3 of the Personnel Manual regarding schedules and assignments and repealing the existing Section V-3. (6.4) Resolution Number 86-3842 - Authorizing the Mayor to sign an agreement with the Union Pacific Railroad Company for crossing signals at Cloud and Fourth Streets. (CD 53538-4) (6.5) Resolution Number 86-3843 - Authorizing the Mayor to sign an agreement with the Union Pacific Railroad Company for crossing signals at Claflin and Fourth Streets. (CD 53538-6) Moved by Commissioner Burgess, seconded by Commissioner Ritter that all items on the consent agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 86-5, filed by Darrell Francisco for the rezoning of Lots 6, 7, 9, Block 19, Sunset Manor Addition to District C-5 be approved for Lots 6 and 7, Block 19, Sunset Manor Addition only. [introduce Ordinance Number 86-9132 for first reading] 86-067 86-068 86-069 86-070 86-071 Moved by Commissioner Ritter, seconded by Commissioner Burgess that the recommendation of the City Planning Commission be accepted and that Zoning Application 86-5 be approved, and that Ordinance Number 86-9132, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. (7.2) Recommendation from the City Planning Commission that Zoning Application 86-6, filed by Wallace W. Storey, for the rezoning of Lots 1, 2, and 3, Block 9, Replat of Indian Rock Addition to District C-1, be denied. (7.2a) Petition Number 3823, filed by property owners within 200 feet of the requested area, protesting the rezoning of this property to District C-1 (Restricted Business District) Wally Storey, stated they plan to file a PDD application for this property for a financial institution. Mr. and Mrs. James Hyde, 600 Berkshire, stated they are against the financial institution and want the property left residential. Pastor Al Burkes, First Four Square Church which owns this property, wants to sell it so they can take the money and pave the church parking lot. Bob Bostater, Sunset Plaza Development, which owns property across Ohio Street, stated he has no objection to the rezoning. He said this would be a good use for the property. Moved by Commissioner Soderberg, seconded by Commissioner Burgess that the recommendation of the City Planning Commission be accepted and that Zoning Application 86-6 be denied. Aye: (5). Nay: (0). Motion adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 86-9131, providing for the vacation of a portion of Marietta Street in Leavenworth Addition to the City of Salina, Saline County, Kansas. (Requested in Petition Number 3922, filed by Edna Carter). Moved by Commissioner Soderberg, seconded by Commissioner Ryan that Ordinance Number 86-9131, providing for the vacation of a portion of Marietta Street in Leavenworth Addition to the City of Salina, Saline County, Kansas, be adopted. Aye: Burgess, Ritter, Ryan, Soderberg, Hodges (5). Nay: (0). Motion adopted. OTHER BUSINESS Moved by Commissioner Burgess, seconded by Commissioner Ryan that the Board of Commissioners recess into Executive Session to 30 minutes to discuss a personnel matter. Aye: (5). Nay: (0). Motion adopted. The Commissioners recessed at 4:20 p.m. and reconvened at 4:59 p.m. Moved by Commissioner Ryan, seconded by Commissioner Burgess that the Regular Meeting of the Board of Commissioners be adjourned.
