05-19-1986 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS May 19, 1986 4:00 p.m. 1The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 19, 1986, at four p.m. There were present: Mayor Joseph M. Ritter, Chairman presiding Commissioner John F. Burgess Commissioner Merle A. Hodges Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg I comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Rufus L. Nye, City Manager Jacqueline Shiever, Acting City Clerk Absent: D. L. Harrison, City Clerk None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of May 18 through 24, 1986 - "NATIONAL PUBLIC WORKS WEEK". The proclamation was read by Charlie Campbell, Executive Director of the American Public Works Association. (4.2) The Mayor proclaimed the Week of May 18 through 24, 1986 - "NATIONAL INSURANCE WOMEN'S WEEK". The proclamation was read by Brenda Smith, Past President of Insurance Women of North Central Kansas. (4.3) The Mayor proclaimed Sunday, May 25, 1986 - "PAUL H. KELLOGG DAY". The proclamation was read by Col. Keith Duckers. The proclamation was presented to Col. Paul Kellogg. (4.4) The Mayor presented plaques of appreciation to past board and commission members: Robert L. Kauffman and Russell A. Jones, City Planning Commission; Rollin Johnson, Electrical Code Panel; Chris Hoffman, III, Library Board. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting May 12, 1986. (6.2) Report on bids received May 15, 1986 for restroom renovation in the Salina Bicentennial Center. [Contract awarded to Western Construction Company for $120,600.1 86-091 1 Moved by Commissioner Hodges, seconded by Commissioner Burgess that all items on the consent agenda be approved. Aye: (5). Motion adopted. 86-092 86-093 86-094 86-095 86-096 86-097 DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 86-8, filed by Tracy and Marilyn Dilling, for the rezoning of the East 34' of Lot 1 , Block 1 , West Evergreen Park Addition and Lot 13, Block 1 , Evergreen Park Addition to District R-2 be approved. [ Introduce Ordinance Number 86-9135 first reading] Moved by Commissioner Burgess, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted and that Zoning Application 86-8 be approved and that Ordinance Number 86-9135, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. (7.2) Recommendation from the City Planning Commission that Zoning Application 86-9, filed by Chuck and Rose Barnett, for the rezoning of Lot 9, on Ninth Street, Bishop's Addition to District C-5 be approved. [ Introduce Ordinance Number 86-9136 first reading] Moved by Commissioner Hodges, seconded by Commissioner Burgess that the recommendation of the City Planning Commission be accepted and that Zoning Application 86-9 be approved and that Ordinance Number 86-9136, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. ADMINISTRATION (8.1) Second Reading Ordinance Number 86-9134 - vacating a portion of a certain borrow easement on South 9th Street in NWJSWk Section 36, Township 14 South, Range 3 West. [Requested in Petition 3924, filed by Jack Dooley] Moved by Commissioner Soderberg, seconded by Commissioner Hodges that Ordinance Number 86-9134, providing for the vacation of a portion of a certain borrow easement on South Ninth Street in NWJSWJ Section 36, Township 14 South, Range 3 West, be adopted. Aye: Burgess, Hodges, Ryan, Soderberg, Ritter (5). Nay: (0). Motion adopted. (8.2) Recommendation from the Business Improvement District Advisory Board that a request by Laurin Schutter, attorney for the Salina Motel Partnership, requesting that the city grant a four year tax forgiveness authorized by Kansas Statutes for projects financed by economic development revenue bonds, be approved. Moved by Commissioner Burgess, seconded by Commissioner Ryan that Salina Motel Partnership be granted a four year tax exemption as authorized by K.S.A. 79-201A for taxable years 1986, 1987, 1988, 1989 provided that all delinquent taxes, interest and penalties on this property be paid including the 1985 taxes, as a precondition to this grant. Aye: (5). Nay: (0). Motion adopted. (8.3) Authorize the Mayor to sign an interlocal agreement with the Board of County Commissioners providing the County with the responsibility to process the Municipal Court Notices and provide bailiff services while the Court is in process. Moved by Commissioner Hodges, seconded by Commissioner Soderberg that the Mayor be authorized to sign the interlocal agreement with the Board of County Commissioners. Aye: (5). Nay: (0). Motion adopted. (8.4) Recommendation by the City Engineer on a request by Eric Nelson, Managing partner of Burger King at 520 South Broadway for a cut in the median in the 500 block of South Broadway, opposite the south exit of Burger King. Moved by Commissioner Burgess, seconded by Commissioner Hodges that the City Engineer's recommendation be accepted and that the request be denied at the present time, but take it up at a later time after completion of the larger study of Broadway Boulevard. Aye: (5). Nay: (0).
