RESOLUTION NUMBER 99-5440
A RESOLUTION AMENDING SECTIONS 1, 3 AND 8 OF RESOLUTION 97-
5206 FINDING AS TO THE ADVISABILITY AND AUTHORIZING CONSTRUCTION
PURSUANT TO K.S.A. 12-601 et sea. OF AN IMPROVEMENT CONSISTING OF
CERTAIN CURBING, GUTTERING, PAVING, GRADING, STORM DRAINAGE,
SANITARY SEWER AND WATER MAIN IMPROVEMENTS IN GOLDEN EAGLE
ESTATES ADDITION TO THE CITY OF SALINA, KANSAS AND REPEALING THE
EXISTING SECTIONS.
Pursuant to findings of advisability made by the Governing Body of the City of Salina,
Kansas.
WHEREAS, Petition Number 4151 was filed with the City Clerk on the 17th day of
October, 1997, under and pursuant to K.S.A. 12-6a01 et sea. to make certain curbing, guttering,
paving, grading, storm drainage, sanitary sewer and water main improvements in Golden Eagle
Estates Addition, and
WHEREAS, on October 20, 1997, the City Commission adopted Resolution Number
97-5206 finding the advisability of and authorizing such improvements, and
WHEREAS, Petition Number 4179 was filed with the City Clerk on March 11, 1999
to enlarge the improvement district established by Resolution Number 97-5206, and
WHEREAS, it has been determined that amendments to certain sections of the
resolution are necessary in order to enlarge said improvement district, SO
NOW, THEREFORE, be it resolved by the Governing Body of the City of Salina,
Kansas, that the following amendments to the findings as to the advisability of and authorization of
making certain curbing, guttering, paving, grading, storm drainage, sanitary sewer and water main
improvements in Golden Eagle Estates Addition of the City of Salina, Kansas, are hereby made, to
wit:
Section 1. That Sections 1, 3 and 8 of Resolution Number 97-5206 shall be amended
to read as follows:
Section 1 That it is necessary and in the public interest to make an
improvement consisting of:
GOLDEN EAGLE ESTATES ADDITION
Curbing, guttering, paving, grading and drainage of Falconview Drive from 42'
south of the north lot line of Lot 26, Block 5 to the north line of Lot 7, Block 6
to serve Lots 4 through 9, Block 4, Lots 20 through 26, Block 5, Lots 5, 6 and 7,
Block 6 and Lots 1 and 2, Block 7, and
Curbing, guttering, paving, grading and drainage of Sherwood Lane from the east line
of Lot 4, Block 6 to the east line of Lot 1, Block 7, and
The installation of a sanitary sewer main, and
The installation of a water main,
to serve Lots 4 through 8, Block 4, Lots 20 through 26, Block 5, Lots 5, 6 and 7,
Block 6 and Lot 1, Block 7
all in Golden Eagle Estates Addition to the City of Salina, Kansas.
Section 3. That the Governing Body hereby further finds and finally
determines that the boundaries of the improvement district against a portion of the
costs of said improvement shall be assessed are hereby established and fixed as the
following legal description: Lots 4 through 9, Block 4, Lots 20 through 26, Block 5,
Lots 5, 6 and 7, Block 6 and Lots 1 and 2, Block 7 all in Golden Eagle Estates
Addition to the City of Salina, Kansas.
Section 8. The assessment, with accrued interest, shall be levied as a special
tax upon the property included within the benefit district concurrent with the general
property taxes and shall be payable in, not to exceed, fifteen (15) equal annual
installments as determined by the Governing Body.
Section 2. That the original Sections 1, 3 and 8 of Resolution Number 97-5206 are
hereby repealed.
Section 3. This resolution shall take effect after its passage and publication once in
the official city newspaper.
Adopted and passed this 5th day of April, 1999.
