07-14-1986 Minutes— 86-133 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS JULY 14, 1986 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, July 14, 1986, at four p.m. There were present: Mayor Joseph M. Ritter, Chairman presiding Commissioner John F. Burgess Commissioner Merle A. Hodges Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: Greg Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None CITIZEN FORUM Carl Sands, Student from the State of Washington, selling educational material for Southwestern Publishing Company, asked the City Commission to change the ordinance regulating door to door salesmen to allow salesmen to knock on doors without prior appointments. He was told it would be taken under advisement with the City Attorney. AWARDS - PROCLAMATIONS PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on the possible issuance of $1,650,000 Industrial Revenue Bonds for Salina Motel Partnership. Robert Thompson, attorney representing several local businesses stated that the resolution passed in January required the bond applicant to waive any property tax relief. Later the Commissioners gave a four year tax relief to the new motel owners. He said they feel this is unfair. Bruce Kent, owner of Ramada Inn, stated the economic effect of the bonds on local motels could be substantial. We pay our taxes like all of you. We feel it is not in the best interest on the City to forgive taxes on this motel. The Mayor declared the public hearing closed. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting July 7, 1986. (6.2) Report on Bids received July 10, 1986 for Engineering Project 86-741 for Roofing Improvements at the Bicentennial Center. [Salina Roofing, Inc. $20,230.00.1 Moved by Commissioner Hodges, seconded by Commissioner Ryan that all items on the Consent agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation by the City Planning Commission that Plat Application 86-2A, filed by John W. Heline for the approval of Gile Addition, be approved, subject to certain conditions, and the Mayor be authorized to sign the plat. 86-134 - 86-135 86-136 86-137 86-138 Moved by Commissioner Soderberg, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted and that Plat Application 86-2A be approved and that the Mayor be authorized to sign the final plat of Gile Addition. Aye: (5). Nay: (0). Motion adopted. (7.2) Recommendation from the City Planning Commission that Ordinance Number 82-8947 be repealed and that Ordinance Number 86-9141 be introduced for first reading. [PDD application 82-2, filed by Blue Beacon International, Inc. for part of Lot 5, Block 3 and Lots 3, 4, 5, 6, and the East 64 feet of Lots 2 and 7, Block 4, Countryside Addition) Moved by Commissioner Burgess, seconded by Commissioner Hodges, that the recommendation of the City Planning Commission be accepted and that Ordinance Number 82-8947 be repealed and that Ordinance Number 86-9141, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof; and repealing Ordinance Number 82-8947, be introduced for first reading. (7.3) Recommendation from the City Planning Commission that Zoning Application 86-11, filed by the City Planning Commission, for the amendment of certain sections of Chapter 42 of the Salina Code, requiring a minimum 55 foot front yard setback from the center line of a collector street. [ Introduce Ordinance 86-9142 for first reading] and that Salina Subdivision regulations (Section 36-74(b)(1) be amended to be in conformance with the reduction in right-of-way from 80 feet to 60 feet and reduction of the minimum pavement width from 45 feet to 41 feet. [Introduce Ordinance 86-9143 for first reading] Moved by Commissioner Hodges, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted and that Zoning Application 86-11 be approved, and that Ordinance Number 86-9142, requiring a minimum fifty-five (55) foot front yard setback from the centerline of a collector street; amending Sections 42-145, 42-160, 42-175, 42-190, 42-205, 42-221, 42-255, 42-270, 42-285, 42-320, 42-335 of the Salina Code and repealing the existing sections, be introduced for first reading. Moved by Commissioner Hodges, seconded by Commissioner Ryan that Ordinance Number 86-9143, requiring minimum sixty (60) foot street right-of-way for collector streets; amending Section 36-74 of the Salina Code, and repealing the existing section, be introduced for first reading. (7.4) Recommendation from the City Planning Commission that Zoning Application 86-12, filed by George Johnson for the rezoning of Lots 4, 5, Block 3, Replat of Beebe's Second Addition to District "C-1", be approved. [Introduce Ordinance Number 86-9144 for first reading] Moved by Commissioner Burgess, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted and that Zoning Application 86-12 be approved, and that Ordinance Number 86-9144 providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. (7.5) Recommendation from the City Planning Commission that Zoning Application 86-13, filed by the City Planning Commission for amendment of Section 42-442 to allow construction of residential basements only within Flood Zones Al to A30 and AH of the City of Salina's Flood Insurance Rate Map. [introduce Ordinance Number 86-9145 for first reading; and that Division 9 (Section 42-445) of the City of Salina's Flood Plain Management ordinance, relating to procedures of considering a variance of regulations contained in the ordinance, be amended. [Introduce Ordinance Number 86-9146 for first reading] 86-139 Moved by Commissioner Ryan, seconded by Commissioner Burgess, that the Recommendation of the City Planning Commission be accepted and that Zoning Application 86-13 be approved and that Ordinance Number 86-9145, allowing construction of residential basements only within flood zones Al to A30 and AH of the City of Salina's Flood Insurance Rate Map; amending Section 42-442 of the Salina Code and repealing the existing section, be introduced for first reading.
