07-28-1986 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS JULY 28, 1986 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, July 28, 1986, at four p.m. There were present: Mayor Joseph M. Ritter, Chairman presiding Commissioner John F. Burgess Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: Greg Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: Commissioner Merle A. Hodges CITIZEN FORUM None AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on a Community Development Block Grant application for Eugene Revels for $400,000. Don Diederich, attorney for Gene Revels, stated Mr. Revels wants the economic development grant to purchase and renovate the Weeks building on South Santa Fe to expand his catering business in approximately half the building. The remainder of the building will be leased. The Mayor declared the public hearing closed. CONSENT AGENDA (6.1) Approve the Minutes of the Regular ,Meeting July 21, 1986. (6.2) Resolution Number 86-3854 - authorizing the preparation and filing with the Kansas Department of Economic Development of a small cities community development block grant program application for economic development assistance for fiscal year 1986, designating the City Manager as the authorized representative of the City of Salina to act in connection with the application; and to provide such additional information as may be required. (6.3) Request by Eric Nelson, Managing Partner of Burger King Restaurant to: (1) withdraw his request filed May 29, 1986, for speed limit reduction on Broadway Boulevard from Ash to Wendy's, and (2) that the City Commission obtain a contractor's cost estimate for removal of the median on Broadway between Ash and Franklin Streets. (This request should be referred to the City Engineer for a recommendation.) (6.4) Report on bids received July 24, 1986 for Engineering Project 86-740-B for Downtown Parking Lots. [Contract awarded to Frank Construction Company for $365,239.751 86-154 Moved by Commissioner Soderberg, seconded by Commissioner Ryan that all items on the Consent Agenda be approved. Aye: (4). DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that PDD Application 86-2A, filed by Salina Presbyterian Manor, requesting approval of an amendment of the final development plan of Phase II of Salina Presbyterian Manor, Inc. PDD, be approved. 86-155 Moved by Commissioner Soderberg, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted and that an amendment of the final development plan of Phase II of Salina Presbyterian Manor PDD be approved, and that the Mayor be authorized to sign the Certificate of Approval. ADMINISTRATION (8.1) Second Reading Ordinance Number 86-9124 - providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the zoning district map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof. [Z86-2, filed by John Ileline for the rezoning of Gile Addition. Ordinance was introduced for first reading March 3, 19861 86-156 Moved by Commissioner Burgess, seconded by Commissioner Soderberg that Ordinance Number 86-9124, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the zoning district map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be adopted. Aye: Burgess, Ryan, Soderberg, Ritter (4) . Nay: (0) . Commissioner Hodges absent. Motion adopted. (8.2) First Reading Ordinance Number 86-9147 - ordering the condemnation and acquisition of certain utility easements for the use of the City of Salina, Kansas, for the purpose of carrying public utilities in the downtown Business District, pursuant to K.S.A. Chapter 26, and amendments thereto, as the same relates to condemnation by cities and further pursuant to Resolution Number 86-3852 of the City of Salina, Kansas. Don Hough, 245 South Santa Fe, expressed his concern about the electrical service running from another property to his buildings. Why doesn't each property have its own junction box? T. M. Siler, 249 South Santa Fe, expressed his concern about the electrical junction box on his property then running service lines across his buildings to other properties. I could possibly be liable for service lines running from the junction box across my buildings to other properties. 86-157 Moved by Commissioner Burgess, seconded by Commissioner Ryan that Ordinance Number 86-9147, ordering the condemnation and acquisition of certain utility easements for the use of the City of Salina, Kansas, for the purpose of carrying public utilities in the downtown Business District, pursuant to K.S.A.
