03-10177 Zone Lamers 2nd SubdivC,,,I,d,ee5a a (Published in the Salina Journal on December , 2003) ORDINANCE NUMBER 03-10177 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -211, PLANNED NEIGHBORHOOD SHOPPING DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: The East 85' of the West 131' of Lot 6, Plat ##3 in Lamer's 2'd Subdivision to the City of Salina, Saline County, Kansas (aka 538 Maple Avenue). shall become a part of DISTRICT "PC -211, PLANNED NEIGHBORHOOD SHOPPING DISTRICT. Section 2. CONDITIONS OF APPROVAL. The use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "PC -2", PLANNED NEIGHBORHOOD SHOPPING DISTRICT and shall be subject to the following conditions: Permitted uses shall be limited to all permitted and conditional uses in the R-1 (Single -Family Residential) District plus Child Care Centers. Any alterations to the existing structure and property shall be subject to review and approval by the Planning Commission. No additions to the existing building footprint and no demolition or new construction shall take place on the property without prior site plan approval by the Planning Commission; 2. Use of the property shall be subject to all bulk limitations of the R-1 (Single -Family Residential) District; 3. Maximum occupancy of the child care facility shall be 20 children; and 4. No Certificate of Occupancy shall be issued for the Child Care Center until the site has had a final inspection for compliance with Life Safety Code and Building Code requirements. Section 3. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper. Introduced: November 24, 2003 Passed: VOID Alan E.
