09-08-1986 Minutes86-182 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS SEPTEMBER 8, 1986 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, September 8, 1986, at four p.m. There were present: Mayor Joseph M. Ritter, Chairman presiding Commissioner John F. Burgess Commissioner Merle A. Hodges Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: Greg Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of September 7 through 12, 1986 - "HUMAN RELATIONS WEEK". The proclamation was read by Joe Stewart, Chairman of the Human Relations Commission. (4.2) The Mayor proclaimed the Week of September 17 through 23, 1986 - "CONSTITUTION WEEK". The proclamation was read by Mrs. A. V. Schwartz, Representative of the DAR. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting August 25, 1986. (6.2) Report by the City Engineer that a request by Salina Presbyterian Manor, 2601 East Crawford, for a 60 foot break in the restricted access along the north property line of East Crawford, directly north of the existing Marlkey Road interesection, be approved. Moved by Commissioner Hodges, seconded by Commissioner Ryan that all items on the Consent Agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Planned Development Application 86-3, filed by George Johnson, for the rezoning of Lots 1, 2, 3, Block 23, Belmont Addition, be denied. (7.1a) Petition 3826, filed by Reginald and June Hurd, protesting the rezoning of Lots 1, 2, 3, Block 3, Belmont Addition. (7.1b) Petition 3827, filed by residents within 200 feet, protesting the rezoning of Lots 1, 2, 3, Block 3, Belmont Addition. 86-183 Moved by Commissioner Soderberg, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted and that Planned Development Application 86-3 be denied. Bill Wunder, 2350 Montclair, representing the residents in the Belmont Area, spoke against the rezoning. George Johnson, applicant, asked Larry Triplett to speak. Larry Triplett said he would like for the City Commission to refer the application back to the City Planning Commission because they were not prepared for the hearing, and they want a full planning commission present. The Mayor called for a vote on Commission Action 86-183. Aye: (5). Nay: (0) . Motion adopted. (7.2) Recommendation from the Heritage Conservation Commission that Heritage Conservation application 86-2, filed by Patrick R. and O. Jean Brewer for heritage conservation landmark designation for Lots 1 and 2, School Park, Original Townsite of the City of Salina (200 South 7th Street) be approved. [introduce Ordinance Number 86-9156 for first reading] 86-184 Moved by Commissioner Burgess, seconded by Commissioner Ryan that the recommendation of the Heritage Conservation Commission be accepted and that Heritage Conservation Application 86-2 be approved and that Ordinance Number 86-9156, designating 200 South 7th Street for heritage conservation landmark designation, be introduced for first reading. ADMINISTRATION (8.1) First Reading Charter Ordinance 22 - Exempting the City of Salina, Kansas, from K.S.A. 12-1697 and 12-16,101 concerning the promotion of tourism and conventions, authorizing the levying of a transient guest tax by counties or cities; providing for appointment of a convention and tourism committee; providing substitute provisions on the same subject and repealing Chapter 37 of the Salina Code. [ Delayed from the August 18, 1986 meeting.] 86-185 Moved by Commissioner Burgess, seconded by Commissioner Hodges _ that Charter Ordinance 22, Exempting the City of Salina, Kansas, from K.S.A. 12-1697 and 12-16,101 concerning the promotion of tourism and conventions, authorizing the levying of a transient guest tax by counties or cities; providing for appointment of a convention and tourism committee; providing substitute provisions on the same subject and repealing Chapter 37 of the Salina Code, be introduced for first reading. (8.2) First Reading Ordinance Number 86-9154 - levying special assessments on lots, pieces, and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of street and utility improvements in The River Place, Riverdale, Nord, Mayfair, Meyer, Eastgate, and Replat of Blocks 4, 10, 11 , 12, Georgetown Addition. [Postponed at the August 25, 1986 meeting.] 86-186 Moved by Commissioner Hodges, seconded by Commissioner Soderberg that Ordinance Number 86-9154, levying special assessments on lots, pieces, and parcels of ground in the City of Salina, Kansas, for the purpose of paying a portion of the cost of street and utility improvements in The River Place, Riverdale, Nord, Mayfair, Meyer, Eastgate, and Replat of Blocks 4, 10, 11, 12, Georgetown Addition, be introduced for first reading.
