09-22-1986 Minutes86-199 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS SEPTEMBER 22, 1986 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, September 22, 1986, at four p.m. There were present: Mayor Joseph M. Ritter, Chairman presiding Commissioner John F. Burgess Commissioner Merle A. Hodges Commissioner Stephen C. Ryan Commissioner Sydney S. Soderberg comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Rufus L. Nye, City Manager Jacqueline Shiever, Deputy City Clerk Absent: D. L. Harrison, City Clerk None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) 1986 Good Citizenship Awards. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting September 15, 1986. (6.2) Report on bids received September 18, 1986 for Engineering Project 86-740C for construction of 4 arcades in the Downtown Business District. [Contract awarded to Holgerson and Company, Inc. for $320,800.1 Moved by Commissioner Burgess, seconded by Commissioner Soderberg that all items on the Consent Agenda be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 86-14, filed by William D. Sharp for the rezoning of a 58 acre tract of land in the NW4 of Section 14, Township 14 South, Range 3 West to District 1-2, be approved. [Introduce Ordinance 86-9161 for first reading.1 Ed Pogue, Vice President of Bank IV, presented checks to the Mayor who then presented them to Barbara Knight and Merle Broce as the 1986 recipients of the Good Citizenship Awards. (4.2) The Mayor proclaimed the Week of September 28 through October 4, 1986 - "I CARE WEEK". The proclamation was read by Gail Bates, President Elect of the Citizens Coalition on Drug and Alcohol Abuse. (4.3) The Mayor proclaimed the Week of September 28 through October 4, 1986 - "NATIONAL AMBUCS WEEK". The proclamation will be read by Larry Adam, First vice president of Ambucs. Moved by Commissioner Soderberg, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted and that an amendment of the Final Planned Development District 81-413 be approved and that the Mayor be authorized to sign the amended Final Planned Development District. ADMINISTRATION (8.1) Second Reading Ordinance Number 86-9157 - providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof. [Lots 1 and 2, School Park, Original Townsite, requested in Zoning Application 86-16, filed by Patrick R. and O. Jean Brewer] Moved by Commissioner Hodges, seconded by Commissioner Burgess that Ordinance Number 86-9157 providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. Aye: Burgess, Hodges, Ryan, Soderberg, Ritter (5). Nay: (0). Motion adopted. (8.2) Second Reading Ordinance Number 86-9158 - prescribing the permitted uses in C-5, Service Commercial Districts; amending Section 42-317 of the Salina Code and repealing the existing section. [Zoning Application 86-18, filed by the City Planning Commission] Moved by Commissioner Hodges, seconded by Commissioner Soderberg that Ordinance Number 86-9158, prescribing the permitted uses in C-5, Service Commercial Districts; amending Section 42-317 of the Salina Code and repealing the existing section, be adopted. (8.3) Second Reading Ordinance Number 86-9159 - allowing dog racing and horse racing tracks as conditional uses in C-6, Heavy Commercial Districts; amending Section 42-333 of the Salina Code and repealing the existing section. (8.4) Second Reading Ordinance Number 86-9160 - Authorizing issuance of $1,650,000 Industrial Revenue Bonds for Salina Motel Partnership. Moved by Commissioner Soderberg, seconded by Commissioner Hodges that Ordinance Number 86-9160, authorizing the City of Salina, Kansas, to acquire certain real property and to acquire, renovate, rehabilitate, construct, improve and equip certain buildings, improvements, machinery and equipment located or to be located thereon to be leased to Salina Motel Limited Partnership, a Kansas Limited Partnership (the "Partnership") , for development of a hotel/motel facility (the "development"); authorizing the City to issue $1,650,000 principal amount of industrial revenue bonds (Salina Motel Limited Partnership Project) , for the purpose of providing funds to pay the cost of acquiring, renovating, rehabilitating, constructing, improving and equipping the development for the partnership; authorizing the City to enter into a trust indenture with Security Bank of Kansas City, authorizing the City to enter into 86-206 86-207 86-208 86-209 86-210 86-211 a lease of the development with Salina Motel Limited Partnership; approving the forms of guaranty agreements, a first leasehold mortgage and security agreement, a first assignment of rents and leases, a letter of credit and collateral pledge agreement; and authorizing and approving the execution of certain documents and the taking of other actions in connection with the issuance of said bonds, be adopted. (8.5) Resolution Number 86-3858 - approving certain rules and regulations for the operation of the Salina Bicentennial Center. Moved by Commissioner Burgess, seconded by Commissioner Ryan that Resolution Number 86-3858, approving certain rules and regulations for the operation of the Salina Bicentennial Center, be approved. Aye: (5). Nay: (0). Motion adopted. (8.6) Resolution Number 86-3859 - requesting that property in the City of Salina and industrial park land outside the corporate limits of the City of Salina be designated as an enterprise zone as authorized by Resolution K.S.A. 12-17,109; and repealing Resolution Number 86-3832. Moved by Commissioner Ryan, seconded by Commissioner Burgess that Resolution Number 86-3859, requesting that property in the City of Salina and industrial park land outside the corporate limits of the City of Salina be designated as an enterprise zone as authorized by Resolution K.S.A. 12-17,109; and repealing Resolution Number 86-3832, be adopted. Aye: (5). Nay: (0). Motion adopted. (8.7) Resolution Number 86-3860 - determining the incentives to be provided by the City of Salina for enterprise zones; and repealing Resolution Number 86-3833. (8.8) Request by William Bonilla to be present at the commission meeting to propose that the bridge on Iron and Fourth Streets be dedicated to the veteran and the name changed to the "Veteran Memorial Bridge" on Veteran's Day, November 11, 1986. Mr. William Bonilla was present and read a prepared statement asking the City Commission to change the name of the bridge at Iron and Fourth Streets to Veterans Memorial Bridge. Moved by Commissioner Hodges, seconded by Commissioner Burgess that action on this request be delayed until October 20, 1986, in order to give it due consideration. Aye: (5). Nay: (0). (8.9) First Reading Ordinance Number 86-9162 - prohibiting the display, sale, distribution, or presentation to a minor of any material which is harmful to a minor, and providing penalties in the event of violation.
