Section 3. All places in the City Of Salina where i.,tox- icatir_g liquors are sold, bartered or given av+ay in violation of any of the provisions of this ordinance, or where persons are per- mitted to resort for the purpose of drink in? ir_to.,icatiUj liquors as a ntoxicating lienors are kept for sale, ':�" bevera e, or Where i Q�r ��3,,F�I in violation Of this ordinance, are he_ e .b- -' de- clared to be common nuisances, and .ipon the j.�ig9mc 1+, of the Police Judge finding such -.places to be a nuisance imrler this oriinance the City }Marshall shall be directed to sh»t up anrl abate such -2- places by taking possession thEreof and by taking possession of all such intoxicating liquors together with all Signs, Screens, Fars, Bottles, Glasses and other personal property used in keeping a,nd maintaining such, nuisance and such personal property so taken possession of shall be forthwith publicly destroyed by such of- ficar and the owner or keeper thereof shall upon conviction'be adjudged guilty o.f' maintair_ing a common nuisance. Section 4.iJ7)on a filing of a complaint in writing and unser oath charging any person with a violation of any of the ure- visions of this ordinance the Police Judgc shall issue a Warrant and in said warra-rit shall direct ana command the city 1:4arshall to search the premises described in the com Taint and to seize all intoxicating liquo,-s ana all vessels,^� bottles cor.tainii:g the same, together with all Screens, Signs, Fars, Bottles, Glasses rty, and arrest the keeper or keepe and other personal pro, rs thereof; and. said person or persons when arraigned before the Po- lice Judge shall plead to his or their real name or names, and shall be'tried.upon. p n.said complaint. and if found guilty shall be punished as - provided:; and. the Police Jurige shall also order all the property seized s aforesaid to be d; provided, said Police Ji..i.dge shall also find pub licly destroye and adjudge such property was being nser3 by the riefendart or de- fenaants at the time of said search and seiTire for the purpose of " try. intoxicating liquors. unlawfullyar-ter lection 5.
