SCARC (2) LICENSE AGREEMENT
This License Agreement, made this Ilth day of May, 1979 , by and between the
CITY OF SALINA, a municipal corporation, hereinafter referred to as the "city" and
the SALINE COUNTY ASSOCIATION FOR RETARDED CITIZENS, a non profit association of
Salina, Saline County, Kansas , hereinafter referred to as the "SCARC" ,
WITNESSETH:
WHEREAS, the City is an owner of certain lands Iying and situated in Saline
County, Kansas , upon which it formerly operated a municipal airport, the same
being described as follows :
The East Half (Ep) of the Northwest Quarter (NWk) and the West Half
(W_) of the Northeast Quarter (NE,=, ) of Section Twenty(20) , Township
Fourteen ( 14) South , Range Two (2) , West of the 6th P.M. in Saline
County, Kansas,
hereinafter referred to as the "Premises" , and
WHEREAS, the "SCARC" have indicated a desire to use a portion of the premises
as indicated on the attached map for the purpose of conducting a circus on said
premises on May 1I , 1979 :
NOW THEREFORE, the City, in consideration of the covenants herein contained on
the part of the SCARC, does by these presents hereby grant a license to said SCARC
to use that portion of the premises shown on the attached map for the purpose of
conducting a circus thereon May II , 1979, in accordance with the following terms
and conditions :
( I ) SCARC hereby agrees to assume the following responsibilities :
(a) . To secure and maintain in force from a company authorized to
do business within the State of Kansas, a policy of liability insurance
which will provide liability coverage for personal injuries and property
damages which might arise on the premises as a result of its operation,
in an aggregate amount of not less than $500,000.00.
(b) . To hold and save harmless the City from any and all liability
for property damage or bodily injury claims which may result from its
operation of a circus on said premises .
(c) . To maintain the premises in a neat and orderly manner and not
to allow any rubbish to accumulate on or about the premises.
(d) . To abide by all applicable laws, ordinances, regulations and
restrictions imposed by the City, State, or any Governmental authority.
(e) . To remove all property from the premises upon the termination
of this agreement and to restore the premises to substantially the same
condition as they were prior to the use by said SCARC.
(f) . To provide, install and maintain on the premises adequate
sanitation facilities for use by the participants and spectators.
(g) . To remove all paper, debris and other trash which may accumulate
on the premises.
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands the day
and year first above written.
