03-09-2015 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS March 9, 2015 4:00 p.m. a The City Commission convened at 3:45 p.m. for Citizens Forum. 0 N B The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City -County Building. Roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Aaron Householter (presiding), Commissioners Jon R. Blanchard, Kaye J. Crawford and Trent Davis. Also present: Jason A. Gage, City Manager; Michael D. Schrage, Deputy City Manager; Greg Bengtson, City Attorney; and Shandi Wicks, City Clerk. Absent: Commissioner Randall R. Hardy AWARDS AND PROCLAMATIONS (3.1) The month of March, 2015 as "Women's History Month" in the city of Salina. Luci Larson, Human Relations Commission Vice -Chair, read the proclamation and announced upcoming events. CITIZEN FORUM Mone. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of March 2, 2015. (6.2) Resolution No. 15-7185 appointing a member to the Board of Zoning Appeals. (6.3) Authorize Modification No. 2 of Agreements for the U.S. Environmental Protection Agency (EPA) Community Action for a Renewed Environment (CARE) Level II Grant with Kansas State University's Pollution Prevention Institute and the Saline County Health Department. (6.4) Authorize the purchase of six wastewater pumps for .Wastewater Collection from JCI Industries, Lee's Summit, Missouri in the amount of $155,423 (6.5) Authorize the City Manager to sign a request from the Kansas Department of Transportation (KDOT) to exchange 2015 federal funds for the Iron Avenue Improvements, Project No. 13-3008. (6.6) Authorize the Mayor to approve Change Order No. 2 for the following Specialty Contractor Agreements: Drilling Support -Site Wide Remedial Investigation to Environmental Priority Services, Inc, in the amount of $3,872.00 (Revised Agreement Amount $159,477.00) and Drilling Support -Site Wide Remedial Investigation to GeoCore, Inc., in the amount of $6,474.00 (Revised Agreement Amount $111,301.40). ADMINISTRATION (7.1) Second reading of Ordinance No. 15-10767 amending Salina Code Section 31-900 and 31- 1006 relating to the maintenance of weeds and grass nuisances and abatement of violations by the City of Salina. Mayor Householter noted that Ordinance No. 15-10767 was passed on first reading on March 2, 2015 and since that time no comments have been received. U 15-0071 Moved by Commissioner Blanchard, seconded by Commissioner Davis, to adopt Ordinance No. 15-10767 amending Salina Code Section 31-900 and 31-1006 relating to the maintenance of weeds and grass nuisances and abatement of violations by the City of Salina on second reading. A roll call vote was taken. Aye: (4) Blanchard, Crawford, Davis, Householter. Nay: (0). Motion carried. DEVELOPMENT BUSINESS None. OTHER BUSINESS Commissioner Blanchard noted the attendance of the commissioners at the Big Brothers Big Sisters Bowl for Kids Sake. Jason Gage, City Manager, noted the lack of motion by the commission on the Iron Avenue Art Project at the last meeting and asked if the commission was still interested in an art feature for the project. Mayor Householter responded by stating that he would like to see an art element within the project. Commissioner Davis stated that he was in favor of a functional art piece for the project. Commissioner Crawford stated that she would rather see the original stamped concrete retained in place of the art piece. Commissioner Blanchard was in favor of an art piece with the piece incorporated within multiple locations in downtown and budget to remain neutral. Mr. Gage asked if the commission would like to have a study session on the Community Art & Design process. The Commission unanimously requested a study session to review the Community Art & Design process. Commissioner Blanchard requested an executive session for legal be added to the agenda. (9.1) Request for executive session (real estate/ personnel). 15-0072 Moved by Commissioner Blanchard, seconded by Commissioner Davis, to recess into executive session for 45 minutes to discuss matters pertaining to the acquisition of real estate for the reason that public discussion of the matter would adversely affect the City's position in relation to acquisition of the real estate and for the purpose of discussing matters pertaining to non -elected City personnel for the reason that public discussion of the matter would violate the privacy rights of the non -elected personnel involved and to discuss with legal counsel matters subject to the attomey-client privilege for the reason that public discussion of those matters would waive the privilege and adversely affect the City's interest in the matters and reconvene at 5:05 p.m. The City Commission recessed into executive session at 4:20 p.m. and reconvened at 5:05 p.m. No action was taken.
