05-18-1987 MinutesCommission 87-90 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS MAY 18, 1987 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 18, 1987, at four p.m. I There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Robert E. Frank Commissioner Vi Justus Commissioner Sydney S. Soderberg Commissioner Joseph A. Warner j comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Rufus L. Nye, City Manager Jacqueline Shiever, Deputy City Clerk Absent: D. L. Harrison, City Clerk None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of May 17 through 23, 1987 - "NATIONAL PUBLIC WORKS WEEK". The proclamation was read by Bill Strait, Planner with Bucher, Willis and Ratliff. (4.2) The Mayor proclaimed Saturday, May 23, 1987 - "BUDDY POPPY DAY". The proclamation was read by Preston Luck, Commander of the V.F.W. (4.3) The Mayor proclaimed Saturday, May 23, 1987 - "POPPY DAY". The proclamation was read by Mrs. Harold Scribner, Past President of the American Legion Auxiliary. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting May 11, 1987. (6.2) Report by the City Engineer on a request by the Meadowlark P.T.A. for various traffic control devices. (6.3) Accept an emergency shelter program grant from the Kansas Social Rehabilitation Services in the amount of $5,070.00 and authorize the City Manager to accept the money for DVAC. (6.4) Authorize the Mayor to execute the Landlord's Waiver and Consent to Collateral Assignment of Lease for General Battery Corporation. None DEVELOPMENT BUSINESS Commission 87-91 87-92 87-93 87-94 ADMINISTRATION (8.1) Second Reading Ordinance Number 87-9188, establishing minimum design standards for major and minor local streets, and for private streets within planned development districts; amending Section 36-74 of the Salina Code and repealing the existing section. [Action postponed for 1 week at the May 11, 1987 meeting] Moved by Commissioner Soderberg, seconded by Commissioner Justus that Ordinance Number 87-9188, establishing minimum design standards for major and minor local streets, and for private streets within planned development districts; amending Section 36-74 of the Salina Code and repealing the existing section, be adopted. Charles Randles, Real Estate Broker and Developer, spoke in opposition to the proposed ordinance and asked the City Commission vote against adopting the ordinance. Bob Haworth, Developer, asked the City Commissioners to verify that they did receive his letter, and to vote to adopt the proposed ordinance. Charles Boster, President of the Salina Homebuilders Association, asked the City Commissioners to adopt the proposed ordinance to bring Salina into compliance with other cities. Commissioner Soderberg amended her motion to include the change in Section 36-74 Table 1, Commissioner Justus seconded the motion to amend. The Mayor called for a vote on Commission Action #87-91 as amended: Aye: Frank, Justus, Soderberg, Warner, Ryan (5). Nay: (0). Motion adopted. (8.2) Second Reading Ordinance Number 87-9189, amending Sections 38-83, 38-87, 38-88 of the Salina Code, repealing Sections 38-84 and 38-85, pertaining to inoperable vehicles. Moved by Commissioner Warner, seconded by Commissioner Frank that Ordinance Number 87-9189, amending Sections 38-83, 38-87, 38-88 of the Salina Code, repealing Sections 38-84 and 38-85, pertaining to inoperable vehicles, be adopted. Aye: Frank, Justus, Soderberg, Warner, Ryan (5). Nay: (0). Motion adopted. (8.3) Second Reading Ordinance Number 87-9190, providing for the vacation of Century Plaza Drive between Magnolia Road and Saturn Avenue extended, in Meadowlark Acres Addition Number 2 and in the Replat of Meadowlark Acres Addition Number 3; and repealing Ordinance Number 85-9070. City Attorney Bengtson, read a letter from the petitioner that the wording in Section 2 be amended to read: "That the portion of the street hereby vacated located in Block 1, Meadowlark Acres Addition Number 2 shall revert to the owners of Block 1, Meadowlark Acres Addition Number 2 and the portion of the street hereby vacated located on Lot 1 , Block 1 , Replat of Meadowlark Acres Addition Number 3 shall revert to the owners of Lot 1, Block 1 , Replat of Meadowlark Acres Addition Number 3, in accordance with K.S.A. 13-443." Moved by Commissioner Justus, seconded by Commissioner Warner that Ordinance Number 87-9190, providing for the vacation of Century Plaza Drive between Magnolia Road and Saturn Avenue extended, in Meadowlark Acres Addition Number 2 and in the Replat of Meadowlark Acres Addition Number 3; and repealing Ordinance Number 85-9070, be adopted as amended. (8.4) Resolution Number 87-3891 that the City of Salina, Kansas, should repair, alter, extend, reconstruct, enlarge and improve its water and sewerage system and authorizing notice to be given of the city's intention to take such action. Aye: (5) . Nay: (0) . Motion adopted. Commission 87-95 87-96 87-97 (8.5) City Engineer files the final quantities for property owners share for Engineering Project 86-740, Downtown Redevelopment. Set the date of June 8, 1987 for public hearing. Moved by Commissioner Soderberg, seconded by Commissioner Justus that the final quantities for Engineering Project 86-740 be accepted as filed and that June 8, 1987 at four o'clock be established for a public hearing on the proposed assessments, and that the City Clerk be instructed to publish a Notice of Public Hearing. (8.6) Resolution Number 87-3892, directing and ordering a public hearing on the advisability of curbing, guttering, paving, grading, water main and service improvements in a certain district and giving notice of such hearing.
