05-11-1987 MinutesCommission — 87-76 87-77 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS May 11, 1987 4:00 p.m. IThe Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 11, 1987, at four p.m. I There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Robert E. Frank Commissioner Vi Justus Commissioner Sydney S. Soderberg Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney D. L. Harrison, City Clerk Rufus L. Nye, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of May 10 through 16, 1987 - "POLICE WEEK" and May 15th - "POLICE OFFICER MEMORIAL DAY". The proclamation was read by Police Chaplain Holly Lienhord. (4.2) The Mayor proclaimed the Week of May 17 through 23, 1987 - "NATIONAL INSURANCE WOMEN'S WEEK". The proclamation was read by Brenda Smith, Legislative Chairman for Insurance Women of North Central Kansas. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting May 4, 1987. (6.2) Report on bids received May 7, 1987 for one backhoe/loader. [Awarded to Ditch Witch of Kansas in the amount of $25,790.00] (6.3) Resolution Number 87-3888, establishing a Loss Control Management Program. (6.4) Resolution Number 87-3889, Authorizing the Mayor to execute an agreement by and between the City of Salina; Board of Advisors of Business Improvement District Number 1; and Salina Downtown, Inc. to provide special maintenance services within the area comprising the Business Improvement District Number 1. Moved by Commissioner Soderberg, seconded by Commissioner Justus that Section 5 be amended to read "Each city employee will be responsible for his or her own personal safety ..... None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second Reading Ordinance Number 87-9183, renaming the "Mobile Home Park District" to "Manufactured Home Park District"; substituting the term "Manufactured Home" for "Mobile Home"; amending Division 9 of Article VI of Chapter 42 of the Salina Code and repealing the existing sections. Moved by Commissioner Warner, seconded by Commissioner Soderberg that Ordinance Number 87-9183, renaming the "Mobile Home Park District" to "Manufactured Home Park District"; substituting the term "Manufactured Home" for "Mobile Home"; amending Division 9 of Article VI of Chapter 42 of the Salina Code and repealing the existing sections, be adopted. (8.2) Second Reading Ordinance Number 87-9184, substituting the term "Manufactured Home" for "Mobile Home"; providing that the City of Salina shall obtain, review and utilize any base flood elevation and floodway data available from a federal, state or other source to regulate construction in Zone A; Amending Sections 42-438, 42-439; 42-782.1, 42-783 and repealing the existing sections; amending Article XIV of Chapter 42 of the Salina Code by repealing Sections 42-668.2, 42-668.4, 42-715, 42-716, 42-717, 42-718, and by adding Sections 42-712.1, 42-712.2, 42-712.3, 42-712.4, 42-719.1. Moved by Commissioner Justus, seconded by Commissioner Warner that Ordinance Number 87-9184, substituting the term "Manufactured Home" for "Mobile Home"; providing that the City of Salina shall obtain, review and utilize any base flood elevation and floodway data available from a federal, state or other source to regulate construction in Zone A; Amending Sections 42-438, 42-439; 42-782.1, 42-783 and repealing the existing sections; amending Article XIV of Chapter 42 of the Salina Code by repealing Sections 42-668.2, 42-668.4, 42-715, 42-716, 42-717, 42-718, and by adding Sections 42-712.1, 42-712.2, 42-712.3, 42-712.4, 42-719.1, be adopted. Commission --6014on #-- 87-83 87-84 87-85 87-86 87-87 (8.4) Second Reading Ordinance Number 87-9186 requiring fully enclosed areas below the base flood elevation to be designed to allow for the automatic entry and exit of floodwaters to equalize hydrostatic flood forces; substituting the term "Manufactured Home" for "Mobile Home"; requiring all manufactured homes placed or substantially improved within Zones Al - 30, AH and AE to be elevated on a permanent foundation such that the lowest floor of the manufactured home is at or above the base flood elevation; Amending Section 42-442 of the Salina Code and repealing the existing Section. (8.6) Second Reading Ordinance Number 87-9188 establishing minimum design standards for major and minor local streets, and for private streets within planned development districts; amending Section 36-74 of the Salina Code and repealing the existing Section. (8.7) First Reading Ordinance Number 87-9189 amending Sections 38-83, 38-87, 38-88 of the Salina Code, repealing Sections 38-84 and 38-85, pertaining to inoperable vehicles. (8.8) First Reading Ordinance Number 87-9190 providing for the vacation of Century Plaza Drive between Magnolia Road and Saturn Avenue Extended in Meadowlark Acres Addition Number 2 and in the Replat of Meadowlark Acres Addition Number 3; and repealing Ordinance Number 85-9070. Moved by Commissioner Frank, seconded by Commissioner Justus that Ordinance Number 87-9190 providing for the vacation of Century Plaza Drive between Magnolia Road and Saturn Avenue Extended in Meadowlark Acres Addition Number 2 and in the Replat of Meadowlark Acres Addition Number 3; and repealing Ordinance Number 85-9070, be introduced for first reading. (8.9) Resolution Number 87-3890 - appropriating from the Transient Guest Tax Unappropriated Fund Reserve the amount of $25,000 to provide funding for a feasibility study for a horse/dog race track facility. Guy Reinbold, feels this is a waste of time and money. He feels it is better to spend money on a study in conjunction with Abilene for an area track. He doesn't feel it should be in the city because of the traffic problems. Commission 87-88 87-89 Wayne Ward, resident of Dickinson County and a partner in the greyhound training track west of Abilene, stated that he would lease the track for a commercial race track if he could retain training rights. He said a feasibility study has been done by Abilene which is available to anyone. Salina has motels and restaurant facilities which will be utilized by people attending the race track facilities in Abilene and would be an economic benefit to Abilene and Salina. John Ryberg, Vice President of the Salina Area Chamber of Commerce read a letter to Commissioners. He spoke in favor of the resolution, because Salina has a good change for a race track being located at the intersection of Interstate Highways 135 and 70. Moved by Commissioner Frank, seconded by Commissioner Justus that Resolution Number 87-3890, appropriating from the Transient Guest Tax Unappropriated Fund Reserve the amount of $25,000 to provide funding for a feasibility study for a horse/dog race track facility, be adopted. Aye: (5). Nay: (0) . Motion adopted. OTHER BUSINESS The Mayor, with the approval of the board of commissioners made the following appointments: Library Board Amy L. Hoffman, appointed to succeed Nancy Hampton, for a 4 year term to April 30, 1991. Albert Schwartz, appointed to succeed James Geisendorf, for a 4 year term to April 30, 1991.
