REGULAR MEETING OF THE BOARD OF COMMISSIONERS
NOVEMBER 2, 1987

The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, November 2, 1987, at 4:00
p.m.
There were present:

CITIZEN FORUM
AWARDS - PROCLAMATIONS
(4.1) The Mayor proclaimed the Week of November 2 through 6, 1987 as
"MEDICAL ASSISTANTS WEEK". The proclamation was read by Pam Bluemel,
President of the Saline County Medical Assistants.
(4.2) The Mayor proclaimed the Month of November, 1987 as "ALZHEIMER'S
AWARENESS MONTH". The proclamation was read by Jacque Woolsey, Support
Group member.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME

CONSENT AGENDA
(6.1) Approve the Minutes of the Regular Meeting October 26, 1987.
(6.2) Recommendation from the City Engineer that a request by A. L. Botts,
d/b/a AI's City Taxi, for an additional taxi stand on West Walnut, be denied.
Moved by Commissioner Frank, seconded by Commissioner Justus that
Item 5.2 in the minutes of October 26 be corrected to reflect that Bob Stewart,
of Stewart International, and Dave Mitchell, of Salina Truck Sales, expressed
their concerns about the possibility of TEC, Inc. using monies from the CDBG
program to become a direct competitor of Stewart International, and that all items
on the Consent Agenda be approved as corrected. Aye: (5) . Nay: (0) . Motion

DEVELOPMENT BUSINESS
(7.1 ) Recommendation from the City Planning Commission that Zoning
Application 87-14, filed by Unified School District #305, for the rezoning of
Blocks 13 and 14 and a tract of land in the NE -41 of Section 34, Township 14
South, Range 3 West of the 6th Principal Meridian in the Schilling Subdivision to
District U, be approved. [Introduce Ordinance Number 87-9222 for first
reading]

Moved by Commissioner Justus, seconded by Commissioner Frank that
the recommendation of the City Planning Commission be accepted, that Zoning
Application 87-14 be approved, and that Ordinance Number 87-9222, providing
for the amendment of Ordinance Number 8526, the same being Chapter 42 of the
Salina Code, and the Zoning District Map therein and thereby adopted and
providing for the rezoning of certain property within the City and prescribing
the proper uses thereof, be introduced for first reading. Aye: (5) . Nay: (0) .

ADMINISTRATION
(8.1) Resolution Number 87-3916, providing for the rates, fees or charges for
the use of the sewerage system and services rendered by the combined water
and sewerage department of the City of Salina, Kansas, and repealing Resolution
83-3657. [Action postponed at the October 19, 1987 meeting.]

that consideration of Resolution Number 87-3916 be postponed until the December

(8.2) Resolution Number 87-3926, establishing the Emergency Medical Service
Administration Committee.

Resolution Number 87-3926, establishing the Emergency Medical Service

(8.3) Resolution Number 87-3927, setting forth the Board of City
Commissioners findings that certain structures are unsafe or dangerous,
directing the structures be repaired or removed, and fixing a reasonable time
within which the repair or removal of such structures shall be commenced and

that Resolution Number 87-3927, setting forth the Board of City Commissioners

(8.7) Resolution Number 87-3931, setting forth the Board of City

Bonita Stewart, 700 South Santa Fe, appeared before the Commission
and indicated she was considering purchasing and repairing the structure.
Moved by Commissioner Warner, seconded by Commissioner Justus that
Resolution Number 87-3931, setting forth the Board of City Commissioners
findings that certain structures are unsafe or dangerous, directing the
structures be repaired or removed, and fixing a reasonable time within which the
repair or removal of such structures shall be commenced and completed, be

(8.8) Resolution Number 87-3932, setting forth the Board of City
Commissioners findings that certain structures are unsafe or dangerous,
directing the structures be repaired or removed, and fixing a reasonable time
within which the repair or removal of such structures shall be commenced and

Jack Stewart, attorney representing Bill Benz, the owner of 510 North
Ninth Street, appeared before the Commission. Mr. Stewart urged the
Commission not to order demolition of the structure. However, Mr. Stewart
indicated his client would agree to demolition if the demolition time period were
expanded, preferably to six months.
Johnny Augustine, tenant of 510 North Ninth Street, appeared and
expressed his desire to remain at his current location.
Roy Dudark, Director of Community Development, indicated city staff
would accept a schedule which provided for closing the structure to the public
within 30 days, initiation of demolition within 90 days and completion of
demolition within 180 days.
Mr. Stewart indicated these terms would be acceptable to his client.
Moved by Commissioner Soderberg, seconded by Commissioner Warner
that Resolution Number 87-39322 be amended to require the structure to be
closed to the public within 30 days of publication, the commencement of
demolition or repair within 90 days of publication and the completion of demolition
or repair within 6 months of publication. Aye: (5). Nay: (0). Motion adopted.
Moved by Commissioner Justus, seconded by Commissioner Frank that
Resolution Number 87-3932, setting forth the Board of City Commissioners

that the Commission recess into executive session to discuss the acquisition of
