99-5424 Advis Auth Sidewalks�uN (Published in the Salina Journal March 1999) RESOLUTION NUMBER 99-5424 A RESOLUTION AMENDING SECTION 4 OF RESOLUTION NUMBER 98-5383 DETERMINING THE ADVISABILITY OF CERTAIN SIDEWALK IMPROVEMENTS ON THE WEST SIDE OF OHIO STREET FROM PRESCOTT AVENUE TO EDISON PLACE IN THE CITY OF SALINA, KANSAS; AMENDING SECTION 4 OF RESOLUTION NUMBER 98-5386 AUTHORIZING AND ORDERING THE SAME SIDEWALK IMPROVEMENTS; AND REPEALING THOSE EXISTING SECTIONS. WHEREAS, on December 7,1998, the Governing Body of the City of Salina, Kansas, adopted Resolution Number 98-5383 setting out findings and determining the advisability of the following improvement project: Public concrete sidewalks on the west side of Ohio Street from Prescott Avenue to Edison Place, in the City of Salina, Kansas (the "Improvement Project") benefitting the following improvement district: Lot 1, Block 2, in the Replat of a Part of Lot 16 Garden Homes Addition; Lot 16, less the south 624', Garden Home Addition; South 145.8' Lots 9 and 10, Block 1, and the North'/2 of Lots 9 and 10, Block 1 in Replat of Lot 3 and East 70 feet Lot 4 and Part of Lot 2, Surveyor's Plat #52; and Lots 6 and 7, Block 1, Replat of Riverdale Addition, to the City of Salina, Saline County, Kansas (the `Benefit District"); and WHEREAS, on December 7, 1998, the Governing Body adopted Resolution 98-5386 authorizing and ordering the Improvement Project; and NOW, THEREFORE, be it resolved by the Governing Body of the City of Salina, Kansas: Section 1. Section 4 of Resolution Number 98-5383 and Section 4 of Resolution Number 98- 5386 are amended to read as follows: "Section 4. The method of assessment shall be that the total cost assessed against each parcel of property shall be based on the cost of the square footage of sidewalk actually constructed immediately adjacent to the property being assessed." Section 2. Section 4 of Resolution 98-5383 and Section 4 of Resolution Number 98-5386 are repealed. Section 3. This resolution shall take effect after its passage and publication once in the official city newspaper.
