The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, December 21, 1987, at 4:00
p.m.
There were present:

AWARDS - PROCLAMATIONS
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Public Hearing on Petition 3945 for the vacation of street right-of-way
on both sides of University Place from College to 12th Street
(5.1a) First Reading Ordinance Number 87-9227, vacating certain street
right of way in University Addition.
Mayor Ryan declared the public hearing open.
There were no protests filed, written or oral, and the Mayor declared
the public hearing closed.
Moved by Commissioner Frank, seconded by Commissioner Justus that
Ordinance Number 87-9227, providing for the vacation of five (5) feet of street
right-of-way on each side of University Place from College Street to Twelfth
Street, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted.

(8.1) Second Reading Ordinance Number 87-9224, providing for the vacation
of a ten (10) foot pedestrian walkway easement located in Block Seventeen (17),
Sunset Manor Addition to the City of Salina, Saline County, Kansas.
Moved by Commissioner Justus, seconded by Commissioner Warner that
Ordinance Number 87-9224, providing for the vacation of a ten (10) foot
pedestrian walkway easement located in Block Seventeen (17), Sunset Manor
Addition to the City of Salina, Saline County, Kansas, be adopted. Aye: Frank,
Justus, Soderberg, Warner, Ryan (5). Nay: (0). Motion adopted.
(8.2) Second Reading Ordinance Number 87-9225, providing for the
amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina
Code, and the Zoning District Map therein and thereby adopted and providing
for the rezoning of certain property in Countryside Addition from P.D.D. to
R-1, prescribing the proper uses thereof and repealing Ordinance Numbers
82-8947 and 86-9141.

Ordinance Number 87-9225, providing for the amendment of Ordinance Number
8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map
therein and thereby adopted and providing for the rezoning of certain property
in Countryside Addition from P.D.D. to R-1, prescribing the proper uses
thereof and repealing Ordinance Numbers 82-8947 and 86-9141, be adopted.

located at 211 West Prescott for Heritage Conservation (HC) Landmark
designation.

that Ordinance Number 87-9226, designating the structure located at 211 West
Prescott for Heritage Conservation (HC) Landmark designation, be adopted.

(8.4) Resolution Number 87-3945, prescribing the corporate limits of the City
of Salina, Kansas, and repealing Resolution Number 86-3869.

Resolution Number 87-3945, prescribing the corporate limits of the City of
Salina, Kansas, and repealing Resolution umber 86-3869, be adopted. Aye: (5).

(8.5) First Reading Ordinance Number 87-9228, requiring a city license,
levying a license fee, establishing business regulations and establishing penalties
relating to drinking establishments in the City of Salina, Kansas, amending
Chapter 5, Article IV, Division 2 of the Salina Code by adding Sections 5-147
through 5-150.
Moved by Commissioner Justus, seconded by Commissioner Frank that
Ordinance Number 87-9228, requiring a city license, levying a license fee,
establishing business regulations and establishing penalties relating to drinking
establishments in the City of Salina, Kansas, amending Chapter 5, Article IV,
Division 2 of the Salina Code by adding Sections 5-147 through 5-150, be
introduced for first reading. Aye: (5). Nay: (0). Motion adopted.
(8.6) Request by Dr. Gary Harbin to purchase a portion of the real estate
acquired by the City pursuant to IRB Ordinance 82-8899.
(8.6a) Resolution Number 87-3946, approving the sale of certain real estate
covered by the $361,000 Medical Clinic Revenue Bonds, Series 1982-A, and
authorizing the execution of the necessary documents.
Moved by Commissioner Frank, seconded by Commissioner Soderberg
that the recommendation of the City Attorney be accepted and that Resolution
Number 87-3946, approving the sale of certain real estate covered by the
$361,000 Medical Clinic Revenue Bonds, Series 1982-A, and authorizing the
execution of the necessary documents, be adopted. Aye: (5) . Nay: (0) .

(8.7) Resolution Number 87-3947, authorizing the Mayor and City Clerk to
execute an agreement for professional engineering services between the City of
Salina and Wilson and Company, Engineers and Architects for the design phase
of the extension of the Slough Drainage System.
Moved by Commissioner Warner, seconded by Commissioner Soderberg
that Resolution Number 87-3947, authorizing the Mayor and City Clerk to execute
an agreement for professional engineering services between the City of Salina

(8.8) Resolution Number 87-3948, repealing Resolution 80-3473, which
established the Alcohol Fund Advisory Committee on January 14, 1980.

(8.9) Resolution Number 87-3949, authorizing the Mayor to execute a
right-of-way agreement by and between St. John's Hospital and the City of
Salina.

Resolution Number 87-3949, authorizing the Mayor to execute a right-of-way
agreement by and between St. John's Hospital and the City of Salina, be

Warner abstained. Motion adopted.
OTHER BUSINESS
Moved by Commissioner Soderberg, seconded by Commissioner Warner
that special meetings of the Board of Commissioners be called for 11:00 A.M.
December 22, 28, and 30, 1987, to recess into executive session to discuss
personnel matters regarding non -elected personnel, particularly the consideration
of applicants for the position of City Manager. Aye: (5). Nay: (0). Motion
adopted.
Moved by Commissioner Soderberg, seconded by Commissioner Frank
that the Board of Commissioners recess into executive session to discuss
personnel matters regarding non -elected personnel, particularly the consideration
of applicants for the position of City Manager, for approximately 30 minutes.

The Commission recessed at 4:19 p.m. and reconvened at 4:50 p.m.
