02-08-1988 MinutesCommission CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS FEBRUARY 8, 1988 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, February 8, 1988, at 4:00 p.m. There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Robert E. Frank Commissioner Vi Justus Commissioner Sydney S. Soderberg Commissioner Joseph A. Warner I comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Robert K. Biles, City Clerk W. E. Harris, Interim City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the week of February 7 through 13, 1988 as "VOCATIONAL EDUCATION! WEEK". The proclamation was read by Richard Roe, a refrigeration student and president of the local VICA organization and Sharon Burt, a dental assistance student. (4.2) The Mayor proclaimed the week of February 21 through 27, 1988 as "NATIONAL ENGINEERS WEEK". The proclamation was read by John Youll, President of the Smoky Valley Chapter of the Kansas Engineering Society. (4.3) The Mayor proclaimed the week of February 7 through 13, 1988 as "BLACK HISTORY WEEK". The proclamation was read by Earle L. Bess, Jr., Press Publicity Chairperson of the Salina Chapter of the NAACP. (4.4) The Mayor proclaimed the week of February 15 through 21, 1988 as "NATIONAL PATRIOTISM WEEK". The proclamation was read by Roy Goding, Exalted Ruler of Elks Lodge 718. (4.5) The Mayor proclaimed the week of February 7 through 13, 1988 as "OFFICE EDUCATION ASSOCIATION WEEK". The proclamation was read by Jeanne Murry, Student of Salina High School South. (4.6) The Mayor proclaimed the week of February 7 through 13, 1988 as "BOY SCOUT WEEK". The proclamation was read by Mike Hay, Troop 2. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting February 1, 1988 (6.2) Request from the Salina Heritage Commission for permission from the City Commission to file an application for Heritage Conservation Designation for the Smoky Hill Museum building at 211 West Iron. 88-040 Moved by Commissioner Soderberg, seconded by Commissioner Justus that all items on the Consent Agenda be approved. Motion adopted. 88-041 88-042 88-043 88-044 — 88-045 88-046 DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 87-16, filed by Wally Storey, Jr. for the rezoning of the East 32 feet of Lot 5 and all of Lots 6 and 7, Block 6, Replat of Moose Addition, to District C-5 (Service Commercial District) be approved. [introduce Ordinance 88-9235 for first reading] Moved by Commissioner Justus, seconded by Commissioner Soderberg that the recommendation of the City Planning Commission be accepted, that Zoning Application 87-16 be approved, and that Ordinance Number 88-9235, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof be introduced for first reading. Triplett for the rezoning of the North 75' of Lots 8 and 9, Block 1, Fruitland Addition to District C-5 (Service Commercial District) be approved. ADMINISTRATION (8.1) Second Reading Ordinance 88-9233, annexing certain land to the City of Salina, Kansas, in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive. (a tract in NWjNWj 31-14-2) Moved by Commissioner Soderberg, seconded by Commissioner Warner that Ordinance Number 88-9233, annexing certain land to the City of Salina, Kansas, in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be adopted. (8.2) Second Reading Ordinance 88-9234, levying the annual business improvement district service fees for 1988 applicable to all businesses located within the Salina Business Improvement District Number 1; and repealing Ordinance Number 86-9171. (8.3) Resolution Number 88-3956, establishing certain charges for the operation of and sale of lots in the Gypsum Hill Cemetery, amending Resolution Number 81-3573 and repealing the existing resolution. Aye: (5). Nay: (0). Motion adopted. (8.4) Discussion of recreation center site alternatives. Moved by Commissioner Warner, seconded by Commissioner Frank that Kenwood Park be selected as the location of the recreational facility and that the process of making formal presentations to interested parties regarding the choice of Kenwood Park be begun. Commission 88-047 88-048 88-049 Moved by Commissioner Frank, seconded by Commissioner Soderberg that a special meeting of the Board of Commissioners be called for 8 a.m, on Wednesday, February 10, 1988 to formulate a proposal to present to the Saline County Commission regarding the use of Kenwood Park as the location of a recreation facility. Aye: (5). Nay: (0). Motion adopted. OTHER BUSINESS Moved by Commissioner Soderberg, seconded by Commissioner Frank that the Board of Commissioners recess into executive session for the purpose of preliminary discussion relating to the acquisition of real property for approximately 30 minutes. Aye: (5) . Nay: (0) . Motion adopted. Bryan Thompson, KINA News, asked whether the discussion of the lease of the Fair Association fell under an exception to the open meetings law. The Board of Commissioners recessed at 4:32 p.m, and reconvened at 4:56 p.m. City Attorney Bengtson indicated no discussion of the Kenwood Park lease occurred in the executive session. Instead, questions were raised regarding the particular facts of the situation at hand and a decision was made to postpone discussion until the Attorney General's office could be consulted.
