14-7130 Muscular Dystrophy Association SolicitationJ C M RESOLUTION NUMBER 14-7130 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ISSUE A PERMIT PURSUANT TO STANDARD TRAFFIC ORDINANCE SECTION 69 IN RESPONSE TO THE REQUST OF THE MUSCULAR DYSTROPHY ASSOCIATION (MDA) FOR THE PURPOSE OF AUTHORIZING OFF-DUTY, UNCOMPENSATED EMPLOYEES OF THE SALINA FIRE DEPARTMENT TO COLLECT CONTRIBUTIONS SOLICITED. FROM THE OCCUPANTS OF VEHICLES IN THE CITY RIGHT-OF-WAY IN CONJUNCTION WITH THE "FILL THE BOOT" CAMPAIGN TO BENEFIT MDA. WHEREAS, Section 69, subsection (b), of the Standard Traffic Ordinance ("STO"), as adopted by the City of Salina, Kansas ("City"), provides that: "(b) No person shall stand on a highway for the purpose of soliciting employment, business or contributions from the occupant of any vehicle;" and WHEREAS, Section 69, subsection (d) of the STO further provides that: "(d) The soliciting of contributions under subsection (b) shall not be prohibited if such person or organization has first obtained a permit authorizing such soliciting from the City;" and WHEREAS, at the direction of the Governing Body, City staff currently has under review the City's overall policy toward solicitation of business or contributions from the occupants of vehicles on City right-of-way; and WHEREAS, the Ark Valley Chapter of the Muscular Dystrophy Association ("MDA") has submitted the attached application to the City dated August 12, 2014 ('`Application") seeking approval of the "Fill the Boot Campaign" to benefit MDA in which voluntarily participating, off-duty, and uncompensated employees of the Salina Fire Department would solicit contributions from the occupants of vehicles on City right-of-way for the benefit of MDA from September 12 through 14, 2014; and WHEREAS, the Governing Body, pending final consideration of the City's overall policy toward solicitation of business or contributions from the occupants of vehicles on City right-of-way, desires to authorize the City Manager to issue a permit in accordance with STO Section 69(d) authorizing voluntarily participating, off-duty, and uncompensated employees of the Salina Fire Department.to collect contributions from the occupants of vehicles on City right- of-way in conjunction with the Fill the Boot Campaign to benefit MDA in accordance with the guidelines set forth below; SO NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. The City Manager is authorized to issue a permit in accordance with STO Section 69(d) authorizing Salina Fire Department employees to collect contributions from the occupants of vehicles on City right-of-way in conjunction with the Fill the Boot Campaign to benefit MDA upon the following conditions: The permitted activity shall occur only during daylight hours. The permit shall specify the times of collection per the Application. N b. The permitted activity shall be conducted only by current employees of the Salina Fire Department participating voluntarily, without compensation, and while off-duty from their regularly scheduled shifts as employees of the Salina Fire Department. The permitted activity will be conducted without recognition of rank among participating employees of the Salina Fire Department. C. The permitted activity shall be conducted only at signaled intersections approved by the City Manager per the Application. d. Any solicitation of contributions from occupants of a vehicle shall occur only from behind the curb line or on the median and not from the street adjoining the signaled intersection. Upon acknowledgement by the occupant of a vehicle of a desire to respond to the solicitation with a contribution, the contribution may be collected by an employee of the Salina Fire Department by stepping onto the street alongside the vehicle, but only while the vehicle is stopped at the signaled intersection. e. Participating employees of the Salina Fire Department shall wear reflective vests and may wear only those clothing items identifying him or her as an employee of the Salina Fire Department which have been preapproved by the City Manager. f. Only reserve vehicles and equipment of the Salina Fire Department which have been pre -approved by the City Manager shall be staged in conjunction with the permitted activity. Any such vehicles shall be legally parked at all times during the permitted activity. Any such vehicles may be parked on private property with the private property owner's advance permission. g. Any occupant of a vehicle who makes a contribution shall be simultaneously provided with a sticker or other marker as a means of displaying from the vehicle that a contribution has been made from the vehicle. Section 2. This Resolution shall be in full force and effect following its adoption. Please see below for details: Proposed Fill Dates/Times: Friday, September 12 from 4pm — 7pm Saturday, September 13 from 11am — 3pm Sunday, September 14 from 11am — 2pm Proposed Fill Locations: Crawford and Ohio Crawford and Broadway 91h and Magnolia Proposed Attire: MDA will provide firefighters with MDA Fill the Boot t -shirts to be worn along with safety vests per the safety plan. Proposed Equipment: Firefighters will request use of the backup fire truck for the Fill the Boot campaign Friday, September 12, Saturday, September 13 and Sunday, September 14. Safety Practices: Please see attached safety plan. Firefighters volunteering for the Fill the Boot campaign are covered by MDA's insurance policy and will not be covered by the City of Salina Workers Compensation insurance while participating in Fill the Boot activities. Firefighters will volunteer their time to participate in the Fill the Boot campaign for MDA on the dates/times listed above. They will not be compensated for their duties and will not be performing regular job duties while fundraising. All participation will be voluntary. No city resources will be used unless approved otherwise (see equipment request above) for the fundraising campaign. Please let me know if you have further questions and steps moving forward. You must keep a printed copy with the Ranking Officer while collecting. Firefighters are assigned to a specific approved intersection to collect funds during the campaign. Each intersection will have a designated "ranking officer" on site and will be in charge of implementing and enforcing the safety plan and standards of conduct. Below is the list of intersections assigned to the volunteer firefighters: YOU CAN ONLY SOLICIT AT YOUR ASSIGNED INTERSECTION/LOCATION. Assigned Intersection approved by City Intersection Supervisor Crawford and Ohio Ranking Officer on Duty Crawford and Broadway Ranking Officer on Duty 9`h and Magnolia Ranking Officer on Duty 1. Solicitors may only solicit on behalf of charitable organization as defined in this RFP 2. Solicitors may only solicit on the dates and times set forth on the RFP 3. All solicitors shall be 18 years of age or older and must carry a valid, government issued, photo ID showing the solicitor to be at least 18 years of age on his or her person while engaged in a charitable solicitation event. 4. There shall be at least one person 21 years of age or older present at each intersection while solicitation is occurring who shall be designated as the responsible party for the group and shall be a contact person for police for enforcement of the provisions of this chapter. 5. Solicitation shall be allowed only at approved intersections 6. No solicitor shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close as to constitute an immediate hazard 7. Solicitors shall not approach a vehicle unless a window is down or an occupant has given some sign of assent to be approached. 8. Each solicitor shall wear a safety vest of a color and material that will enhance visibility and help insure solicitor safety. 9. Identification of the soliciting agency shall be printed or displayed upon all containers used by solicitors to collect monetary donations.
