14-10750 pertaining to calling a special election submitting to the vote of the
electors of the City of Salina, Kansas an ordinance repealing Ordinance No. 7096

AN ORDINANCE CALLING A SPECIAL ELECTION SUBMITTING TO THE
E OF THE ELECTORS OF THE CITY OF SALINA, KANSAS, IN ACCORDANCE
i THE INITIATIVE AND REFERENDUM STATUTE (K.S.A. 12-3013), AN
[NANCE REPEALING ORDINANCE NUMBER 7096, WHICH AUTHORIZED AND
:CTED THE WATER DEPARTMENT TO THE CITY OF SALINA, KANSAS, TO
ALL AND OPERATE EQUIPMENT WHICH WILL FLUORIDE THE WATER
'LY SYSTEM IN THE CITY OF SALINA, KANSAS.
WHEREAS, Ordinance Number 7096, which authorized and directed the Water
Department of the City of Salina. Kansas, to install and operate equipment which will fluoride the
water supply system in the City of Salina, Kansas. (the "Ordinance") was adopted by the Governing
Body on second reading on November 25. 1968, and was effective commencing November 27,
1968: and
WHEREAS, the Saline County Election Officer has certified that a petition submitted
pursuant to the initiative and referendum statute (K.S.A. 12-3013) containing a request that the
Governing Body adopt an ordinance repealing the Ordinance was signed by the required number of
electors qualified to sign: and
WHEREAS, under those circumstances, K.S.A. 12-3013(a) requires that the Governing
Body, within 20 days after certification of the petition, either pass the petitioned ordinance to repeal
Ordinance Number 7096, without alteration, or submit the petitioned ordinance, without alteration,
to a vote of the electors of the city by calling a special election, unless a regular city election is to be
held within 90 days thereafter: and
WHEREAS, for the reasons that (a) on this I Ith day of August. 2014, the Ordinance as set

BE IT ORDAINED, by the Governing Body of the Cite of Salina, Kansas:
Section 1. In accordance with K.S.A. 12-3013, the Governing Body submits to the vote of
electors of the city at a special city election to be held on the same date as and in conjunction
t the general election to be held on November 4, 2014. the following question:

An Ordinance of the City of Salina; Kansas repealing Ordinance 7096 which
was titled "AN ORDINANCE. AUTHORIZING AND DIRECTING THE WATER
DEPARTMENT OF THE CITY OF SALNA. KANSAS. TO INSTALL AND
OPERATE EQUIPMENT WHICH WILL FLUORIDE THE WATER SUPPLY
SYSTEM N THE CITY OF SALINA, KANSAS"; passed by the Governing Bode
of Salina. Kansas on November 25. 1968 and became effective on November 27,
1968.
BE IT ORDAINED by the Governing Body of Salina. Kansas:
Section 1. That Ordinance Number 7096 of the Citv of Salina. Kansas, is
repealed.
Section 2. That this Ordinance shall be in full force and effect after its
adoption by the Governing Bode of the Cite of Salina. Kansas, or after approval of a
majority of the qualified voters of the City of Salina, Kansas.
Section 2. If a majority of the electors of the city voting on the proposition approve the
proposed ordinance, the proposed ordinance shall thereupon become a valid and binding ordinance
of the City and Ordinance Number 7096 shall be repealed.
Section 3. The City Clerk is directed to request that the County Election Officer take all
steps necessary to include the proposition set forth in Section 1 above on the ballot for the special
city election to be held on the same date as and in conjunction with the general election to be held
on November 4, 2014.
Section 4. This ordinance shall be published by the following summary:

On August 11, 2014, the City of Salina, Kansas, passed Ordinance No. 14-10750.
The ordinance calls a special election to be held on November 4. 2014, submitting to
the vote of the electors of the city an ordinance repealing Ordinance Number 7096,
which authorized and directed the Water Department to the City of Salina; Kansas, to
install and operate equipment which will fluoride the water supply system in the City
of Salina, Kansas. A complete copy of the ordinance is available at cvw%v.salina-
ks.eov or in the office of the city clerk, 300 \V. Ash Street; free of charge. This
summary is certified by the city attorney.
Section 5. This ordinance shall be in full force and effect from and after its adoption and
publication by summary once in the official city newspaper.
