04-11-1988 MinutesCommission CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS APRIL 11, 1988 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, April 11, 1988, at 4:00 p.m. There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Robert E. Frank Commissioner Vi Justus Commissioner Sydney S. Soderberg Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Robert K. Biles, City Clerk Dennis M. Kissinger, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the month of April, 1988 as "FAIR HOUSING MONTH". The proclamation was read by Will Burnett, Director of Human Relations. (4.2) Sonja Martin, representing the Community Housing Resource Board, announced the winners of the Fair Housing Poster Contest. Winners for the 5th grade contest were: 1st Alvaro Gonzalez - Schilling 2nd Lela Schulte - Schilling 3rd Deng Hong Vilay - Schilling Winners for the 6th grade contest were: 1st Tyson Wool soncroft - Hageman 2nd Cara Jo Bragg - Hageman 3rd Kellie Langrell - Hageman Mayor Ryan presented the awards to each winner. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public hearing on the possible issuance of $20,000,000 Industrial Revenue Bonds for Beech Aircraft Corporation. (5.1a) Resolution Number 88-3970 expressing the intention of the City of Salina, Kansas, to issue Industrial Revenue Bonds in the amount of not to exceed $20,000,000 for the purpose of providing funds to pay the cost of the construction, improvement and equipping of additions to an existing facility and purchase machinery and equipment to be located thereon for Beech Aircraft Corporation. Mayor Ryan opened the public hearing. There were no comments, written or oral, and the Mayor declared the public hearing closed. Aye: (5) . Nay: (0) . Motion adopted. Winton Hinkle, bond counsel for Beech Aircraft Corporation, indicated he and Beech management personnel were present to respond to any Commission concerns. Mayor Ryan congratulated Beech on its confidence in employees of the Salina Division of Beech and wished the company success in its expansion in Salina. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting March 28, 1988 (6.2) Approve the Minutes of the Regular Meeting April 4, 1988 (6.3) Report on bids received April 7, 1988 for Engineering Project 88-758 for the demolition of 5 structures. (6.4) Report on Petition Number 3952, filed by Billy Pittenger I for permission to construct a driveway approach on Ohio Street to serve Lot 2, Block 8, Replat of Dow Addition. Moved by Commissioner Warner, seconded by Commissioner Soderberg that items 6.2 and 6.4 on the Consent Agenda be approved, and that items 6.1 and 6.3 be considered separately. Aye: (5) . Nay: (0) . Motion adopted. (6.1) . Approve the Minutes of the Regular Meeting March 28, 1988. Commissioner Justus and Commissioner Soderberg indicated the appointments to the Housing Authority and the Salina Arts and Humanities Commission need further review. City Manager Kissinger proposed that the minutes of the March 28th meeting be placed on the April 18th agenda. (6.3) Report on bids received April 7, 1988 for Engineering Project 88-758 for the demolition of 5 structures. Moved by Commissioner Warner, seconded by Commissioner Soderberg that the low bid of Frank Construction Company, Inc., in the amount of $3,050.00, be accepted for the demolition work in Engineering Project 88-758. Aye: (4). Nay: (0). Commissioner Frank abstained. Motion adopted. Moved by Commissioner Justus, seconded by Commissioner Warner that Item 6.4 be reconsidered. Aye: (5). Nay: (0). Motion adopted. Billy Pittenger, 1106 Louise Lane, asked what he needs to do to gain access to his garage from Ohio Street. City Manager Kissinger explained the differing access restrictions along Ohio Street and discussed the restricted access in Mr. Pittenger's area. Moved by Commissioner Soderberg, seconded by Commissioner Justus that the Staff recommendation to deny permission to construct a driveway approach on Ohio Street to serve Lot 2, Block 8, Replat of Dow Addition be accepted and the driveway approach be denied. Commission 88-104 88-105 88-106 88-107 88-108 88-109 None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second Reading Ordinance 88-9241 providing for the amendment of Sections 42-252, 42-267, 42-282, 42-302, 42-317, 42-332 of the Salina Code by deleting the four (4) hour fire wall separation requirement for group day care centers and substituting the uniform building code standard in Districts C-1, C-2, C-3, C-4, C-5 and C-6 and repealing the existing sections. Moved by Commissioner Soderberg, seconded by Commissioner Warner that Ordinance 88-9241 providing for the amendment of Sections 42-252, 42-267, 42-282, 42-302, 42-317, 42-332 of the Salina Code by deleting the four (4) hour fire wall separation requirement for group day care centers and substituting the uniform building code standard in Districts C-1, C-2, C-3, C-4, C-5 and C-6 and repealing the existing sections, be adopted. Moved by Commissioner Soderberg, seconded by Commissioner Frank that the City of Salina assume one-half of the cost of the $40,000 sewer project at the East Crawford Recreational Area. Aye: (5). Moved by Commissioner Soderberg, seconded by Commissioner Warner that $40,000 be allocated from the 1988 Sales Tax Capital Budget to reimburse the Recreation Commission for the construction costs on the sewer project. Moved by Commissioner Soderberg, seconded by Commissioner Justus that the City reduce the 1989 budget sales tax capital allocation to the Recreation Commission by $20,000 to take into account their one-half of the sewer project cost. OTHER BUSINESS Moved by Commissioner Soderberg, seconded by Commissioner Frank that the Board of Commissioners accept Ray Snyder's resignation from the Recreation Commission and the Board of Zoning Appeals and that the Board express its appreciation for his many years of service. Moved by Commissioner Justus, seconded by Commissioner Warner that the Board of Commissioners accept Ray Snyder's resignation from the Recreation Commission and that his appointment to the Board of Zoning Appeals be reaffirmed.
