10-10-1988 MinutesAction CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS October 10, 1988 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, October 10, 1988, at 4:00 p.m. There were present: Mayor Sydney Soderberg, Chairman presiding Commissioner Robert E. Frank Commissioner Vi Justus Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Robert K. Biles, City Clerk Dennis M. Kissinger, City Manager Absent: Commissioner Stephen C. Ryan None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor presented twenty-five year service awards to Clarence A. Morrow, Jacqueline B. Shiever and Virgil L. Smock. She presented ten year service awards to Larry K. Charles, Ben Critchfield, Alan L. Ecton, Gale A. Esch, Robert E. Humiston, Robert A. Klein, Rich L. Nicholson, Kelly S. Parrson, Donald P. Reiff, Larry Rundell, Esther J. Wolfe and Ronald C. York. Mayor Soderberg thanked all of the employees for their dedication and hard work. (4.2) The Mayor proclaimed the Week of October 9 through 15, 1988 as "FIRE PREVENTION WEEK." The proclamation was read by Carol Vineyard, Public Education Specialist for the Salina Fire Department. (4.3) The Mayor proclaimed Friday, Saturday, Sunday, October 14, 15, 16, 1988 as "HELP THE MENTALLY RETARDED CITIZENS DAYS." The proclamation was read by Scott Budreau and Frank Thelan, of the Knights of Columbus. (4.4) The Mayor proclaimed the Month of October as "NATIONAL 4-H AWARENESS MONTH." The proclamation was read by Brandon Linquist and Jenny Farmer, Members of the Cardinal 4-H Club. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on the vacation of street right-of-way requested in Petition Number 3960, filed by Falgers, Inc. for the vacation of the easement for roadway purposes which exit on the east side of Lots 1 and 9, Block C, Park West Addition. The Mayor declared the public hearing open. There were no comments, written or oral, so the Mayor declared the public hearing closed. (5.1a) First Reading Ordinance Number 88-9279, vacating certain easement for roadway purposes on the east side of Lots 1 and 9, Block C, Park West Addition. Action 88-327 88-328 88-329 88-330 — 88-331 Wallace Storey, representing Falgers, Inc, responded to questions concerning Petition Number 3960. Moved by Commissioner Frank, seconded by Commissioner Warner that Ordinance Number 88-9279, vacating certain easement for roadway purposes on the east side of Lots 1 and 9, Block C, Park West Addition, be introduced for first reading. (5.2) Public Hearing on the vacation of frontage road requested in Petition Number 3961, filed by Security Savings and Loan Association for the vacation of the public frontage road between East Cloud Street and 1805 South Ohio. The Mayor declared the public hearing open. There were no comments, written or oral, so the Mayor declared the public hearing closed. (5.2a) First Reading Ordinance Number 88-9280, vacating a portion of the public frontage road between East Cloud Street and 1805 South Ohio. Moved by Commissioner Warner, seconded by Commissioner Justus that Ordinance Number 88-9280, vacating a portion of the public frontage road between East Cloud Street and 1805 South Ohio, be introduced for first reading. Aye: (4). Nay: (0). Motion adopted. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting September 26, 1988. Moved by Commissioner Justus, seconded by Commissioner Frank that the Minutes of the Regular Meeting of September 26, 1988 be approved and that all other items on the Consent Agenda be considered separately. Aye: (4) . Nay: (0) . Motion adopted. (6.2) Petition Number 3962, filed by David D. Moshier on behalf of William H. Graves for the vacation of thirty feet of restricted access of Crawford Street to permit a driveway entrance/exit on the West 175' of Lot 17, Block 4, in the Replat of part of Lots 15, 16 and 22 and all of Lots 17, 18, 19, 20, 21, Block 4, in the Replat of Moose Addition, to be located 90 feet east of the west property line of said tract. [Refer to the City Engineer for a recommendation] Wallace Storey, representing the petitioner, discussed the location of the driveway in reference to the Graves Museum. (6.3) Resolution Number 88-4015, directing public notice of application for vacation of a portion of restricted access control. [This Resolution sets October 24, 1988 as the date for public hearing for the vacation of thirty feet of restricted access of Crawford Street to permit a driveway entrance/exit on the West 175' of Lot 17, Block 4, in the Replat of part of Lots 15, 16 and 22 and all of Lots 17, 18, 19, 20, 21, Block 4, in the Replat of Moose Addition, located 90 feet east of the west property line of said tract, requested in Petition 3962, and instructs the City Clerk to publish notice of public hearing] Moved by Commissioner Frank, seconded by Commissioner Warner that Resolution Number 88-4015, directing public notice of application for vacation of a portion of restricted access control, be adopted. Action 88-332 88-333 DEVELOPMENT BUSINESS (7.1) Staff report on recommendation from the City Planning Commission concerning Zoning Application 88-9, filed by the City Planning Commission for amendment to Section 42-507 of the Salina Code. The Planning Commission recommends limitations on the use of temporary signs including decorative business signs, advertising signs for special events and mobile signs. [Introduce an Ordinance for first reading on October 17, 19881 [Schedule a public comment period for October 17, 1988 meeting] Roy Dudark, Director of Planning and Community Development, discussed the content of Zoning Application 88-9. Mr. Dudark indicated several questions had surfaced in the past regarding signage guidelines and that the City of Salina currently has no restrictions on temporary signs. Mr. Dudark responded to questions from the City Commission on the recommendations before Mayor Soderberg asked for public comment. Kenny Jorgensen, of Warta Buick, expressed his concerns over the proposed restrictions. Mr. Jorgensen felt the restrictions would hamper businessmen too much. Jim Vanderbilt, 1100 North Tenth, expressed his opposition to the proposed restrictions. Mr. Vanderbilt felt the restrictions would encourage merchants to use less expensive signage materials resulting in more trash for the community. Also, he expressed his concern that Salina businesses could not afford to lose any more business. The City Commission took no action. ADMINISTRATION (8.1) First Reading Ordinance Number 88-9281, terminating the Mobile Home Craftsman Board of Examiners and the Housing Advisory and Appeals Board and consolidating the functions of the Mobile Home Craftsman Board of Examiners and the Housing Advisory and Appeals Board under the Building Codes Advisory and Appeals Board, designating duties of the Building Official under such consolidation, and amending Sections 8-16, 8-24, 18-41, 18-42, 18-46, 18-47, 22-52, 22-53, 22-54, 22-57, 22-58, 22-59 and 22-63 of the Salina Code and repealing the existing Sections 8-16, 8-24, 18-41, 18-42, 18-46, 18-47, 22-52, 22-53, 22-54, 22-55, 22-56, 22-57, 22-58, 22-59 and 22-63. Action 88-334 88-335 88-336 88-337 (8.3) First Reading Ordinance Number 88-9282, amending Section 8-364 of the Salina Code relating to surety bonds requirements for demolition of buildings and repealing the existing section. (8.4) Resolution Number 88-4017, that the City of Salina, Kansas, should repair, alter, extend, reconstruct, enlarge and improve its water and sewerage system and authorizing notice to be given of the City's intention to take such action. (ElDorado Motor Corporation) Moved by Commissioner Justus, seconded by Commissioner Warner that the City Commission endorse city staff's actions taken in the defeasance of $800,000 of outstanding City of Salina Industrial Revenue Bonds (ElDorado Motor Corporation), appointing the Southwest National Bank of Wichita and/or First Securities Company of Kansas, Inc., as the City's agent to subscribe to U.S. Treasury Certificates of Indebtedness, Notes and Bonds and name the Southwest National Bank of Wichita as the escrow bank. Aye: (4) . Nay: (0) . Motion adopted. OTHER BUSINESS City Manager Kissinger indicated Dickinson Theatres had contacted him about the possibility of donating the Fox Theatre to the City of Salina. Mr. Kissinger stated the Salina Area Chamber of Commerce was very interested in taking a lead role in studying the possible uses for the Fox Theatre. The City Commission directed City Staff to work closely with the Salina Area Chamber of Commerce to develop possible uses for the Fox Theatre.
