11-07-1988 MinutesAction 88-365 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS NOVEMBER 7, 1988 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, November 7, 1988, at 4:00 p.m. There were present: Mayor Sydney Soderberg, Chairman presiding Commissioner Robert E. Frank Commissioner Vi Justus Commissioner Stephen C. Ryan Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Robert K. Biles, City Clerk Dennis M. Kissinger, City Manager Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of November 14 through 21, 1988 as "NATIONAL R.E.A.D. WEEK." The proclamation was read by Ann Menzies and Marilyn Huslig representing the Mid Kansas Council of Kansas Reading Association. (4.2) The Mayor proclaimed the Week of November 7 through 11 , 1988 as "NATIONAL MEDICAL ASSISTANTS WEEK." The proclamation was read by Marcia Feighny, President of the Saline County Medical Assistants Association. (4.3) The Mayor proclaimed Friday, November 11, 1988 as "VETERANS DAY." The proclamation was read by Larry Wegner, Veterans Day Parade Chairman for American Legion. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting October 24, 1988. (6.2) Approve the Minutes of the Special Meeting October 31, 1988. Moved by Commissioner Warner, seconded by Commissioner Frank that all items on the Consent Agenda be approved. Aye: (5) . Nay: (0) . DEVELOPMENT BUSINESS (7.1) Staff report on a recommendation from the City Planning Commission concerning Zoning Application 88-9, filed by the City Planning Commission for an amendment to Section 42-507 of the Salina Code. The Planning Commission recommends limitations on the use of temporary signs including decorative business signs, advertising signs for special events and mobile signs. [Ordinance 88-9283 was returned to the City Planning Commission for reconsideration at the October 10, 1988 meeting. Introduce Ordinance Number 88-9283 for first reading.] Action 88-366 88-367 88-368 88-369 Roy Dudark, Director of Planning and Community Development, reviewed the recommendation from the City Planning Commission. Mr. Dudark highlighted the areas where the Planning Commission's recommendation differed from the action taken by the City Commission at its October 10th meeting. Darrell Sutton, owner of Sutton's Shoppe, stated his opposition to the ordinance. Mr. Sutton felt it was wrong to tell property owners how to use their signs. C. R. Nicholson, owner of Nick's Pawn Shop, spoke in opposition to the ordinance. Mr. Nicholson felt "The City surely had something else to do besides harassing the business owner." Jim Vanderbilt, reminded the City Commission that during this process several other businessmen had opposed any restrictions on signs due to the hardship it would create for their businesses. Moved by Commissioner Warner, seconded by Commissioner Justus that the recommendation of the City Planning Commission be accepted, that Zoning Application 88-9 be approved and that Ordinance Number 88-9283, amending Section 42-507 of the Salina Code by adding a definition of decorative signs and revising the definition of mobile signs, amending Article X of Chapter 42 of the Salina Code by adding Section 42-508 specifying limitations for the use of temporary signs including decorative signs, advertising signs and special public events and mobile signs, and repealing the existing Section 42-507, be amended by deleting Section 42-508 (a) (1) and introduced for first reading as amended. (7.2) Recommendation from the City Planning Commission that Zoning Application 88-12, filed by the City Planning Commission, that Chapter 42 of the Salina Code be amended to allow nursing homes and group day care centers as conditional uses in residential zones, be approved. [Introduce Ordinance Number 88-9287 for first reading] Moved by Commissioner Justus, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted, that Zoning Application 88-12 be approved and that Ordinance Number 88-9287, providing for the amendment of Sections 42-128, 42-143, 42-158, 42-173, 42-188, 42-203 of the Salina Code pertaining to conditional uses in the RS, R, R-1, R-2, R-2.5 and R-3 Districts and repealing the existing sections, be introduced for first reading. (7.3) Recommendation from the Heritage Commission that Heritage Commission Application 88-2 be approved and heritage conservation landmark designation be given to Lots 26 and 28, Block 8, Bonds Addition (aka 850 South Santa Fe) . [Introduce Ordinance Number 88-9288 for first reading] Moved by Commissioner Warner, seconded by Commissioner Frank that the recommendation of the Heritage Commission be accepted, that Heritage Conservation Application 88-2 be approved and Ordinance Number 88-9288, designating the structure located at 850 South Santa Fe Avenue for Herigate Conservation (HC) Landmark Designation, be introduced for first reading. (7.4) Recommendation from the Heritage Commission that Heritage Commission Application 88-3 be approved and heritage conservation landmark designation be given to Court House Park, Bishops Addition (aka 245 North Ninth Street) , known as the Leisure Years Center and the Old Saline County Courthouse. [Introduce Ordinance Number 88-9289 for first reading] Moved by Commissioner Frank, seconded by Commissioner Ryan that the recommendation of the Heritage Commission be accepted, that Heritage Conservation Application 88-3 be approved and Ordinance Number 88-9289, designating the structure located at 245 North Ninth Street for Heritage Conservation (HC) Landmark Designation, be introduced for first reading. Action 88-370 88-371 88-372 88-373 88-374 _ 88-375 (7.5) Recommendation from the Heritage Commission that Heritage Commission Application 88-4 be approved and heritage conservation landmark designation be given to Lot 6, Maple Grove Addition (aka 238 South Tenth Street) . [ I ntroduce Ordinance Number 88-9290 for first reading] Moved by Commissioner Justus, seconded by Commissioner Frank that the recommendation of the Heritage Commission be accepted, that Heritage Conservation Application 88-4 be approved and Ordinance Number 88-9290, designating the structure located at 238 South Tenth Street for Heritage Conservation (HC) Landmark Designation, be introduced for first reading. Aye: (5) . Nay: (0) . Motion adopted. ADMINISTRATION (8.1) Report on bids received October 27, 1988 for roofing improvements at the Water Treatment Plant (Engineering Project 88-772) . [Award the contract to Serrault Roofing, Inc. in the amount of $40,500.00] Moved by Commissioner Frank, seconded by Commissioner Warner that the report of the City Engineer be accepted and that the contract for Engineering Project 88-772 be awarded to Serrault Roofing, Inc., in the amount of $40,500. Aye: (5) . Nay: (0) . Motion adopted. (8.2) Report on bids received November 3, 1988 for trench excavation at the Solid Waste Disposal Site. (Engineering Project 88-773) . [Award the contract to Meuli, Inc., in the amount of $38,632.001 Moved by Commissioner Ryan, seconded by Commissioner Justus that the report of the City Engineer be accepted and that the contract for Engineering Project 88-773 be awarded to Meuli, Inc. in the amount of $38,632.00. Aye: (4) . Nay: (0) . Commissioner Frank abstained. Motion adopted. (8.3) Authorize City staff to negotiate a contract for financial software with New World Systems of Troy, Michigan. Moved by Commissioner Warner, seconded by Commissioner Justus that City staff be authorized to negotiate a contract for financial software with New World Systems of Troy, Michigan. Aye: (5). Nay: (0). Motion adopted. (8.4) Resolution Number 88-4026, appointing members to certain volunteer citizen boards, commissions and committees of the City of Salina, Kansas. Moved by Commissioner Warner, seconded by Commissioner Frank that Resolution Number 88-4026, appointing members to certain volunteer citizen boards, commissions and committees of the City of Salina, Kansas be adopted.
