An ordinance -granting addit`ional.right of .way to the Salina & Southwest- .
sFri Railway Company on,certain streets and alleys of the'City of
Salina,,Kansas. ,

Be it ordained by the Mayor and Councilmen of the -City -of Salina
Section 1. That there be and is heee��y granted to,.the Salina &
Southwestern Railway Company, its successors and assigns'', tWight to con-
struct, ma�ntain.and operate a side track or spur from a point on its
sidetraclt on Fourth and Elm streets over and across Elm street and along
and upon the alley between Fourth and Fifth streets to a point one hundred
and fifty feet south of the south line of Elm street, subject, however,
to the conditions in this ordinance contained.

Sec.. .2. Said side track or spur shall be constructed'-bnd main-
tained at theggstablished grade of.said street'4 and alley and said rail-
way company All provide and maintain suitable crossings over said track
' at all street and alley crossings,.and shall. provide and maintain suf-
ficient culverts and water ways underthe same when, where and,as directed
by order of the mayor and council of said city.
Sec. 3. The right of way hereby granted shall'be and remain
subject to a,ll reasonable regulations now or,herea°'ter• enacted by the
—. mayor and counciL.of. said city; and t.he.city -of Salina, -especially reserves
the right to grant to any other railway company a right of way along and
upon said alley, and said grantee may also run its track and trains
Ellong and over the part of said alley occupied by the grantee,.named in
this ordinance.
See. 4. The right of say herein granted is upon the express coo-
dition that said grantee shall. convey, or cause to be conveyed, to said.
city a right of way twenty feet wide, from Fourth street to Fifth street,
the south line of which right of.way shall be one hundred ana fifty feet
south of the south line of Elm street.
Sec. 5. That if said railway company fails or neglects to con-
struct,said switch•or_spur withinC;• ?max: "months from this date, all
the tights herein granted shall be o sited and revert to said city..
Sec..6. This ordinance shall take effect and be in force from
and after its publication once in t e Salina Daily Republican -Journal.
