08-14-1989 MinutesAction 89-302 89-303 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS AUGUST 14, 1989 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, August 14, 1989, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Robert E. Frank Commissioner Stephen C. Ryan comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: None CITIZEN FORUM Randy Sterrett, 721 North 7th, asked permission to keep a goat within the city limits. AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Hearing on the proposed 1990 budget. The Mayor declared the public hearing open. There were no comments, written or oral, so the public hearing was declared closed. (5.1a) Resolution Number 89-4109 adopting the 1990 budget. (5.1 b) First Reading Ordinance Number 89-9340, providing for the adoption and appropriation, by fund, of the budget of the City of Salina for the year beginning January 1, 1990, and appropriating money from the various funds to pay payrolls and claims against the City of Salina for the calendar year 1990. (5.2a) Resolution Number 89-4110, determining the intent of the City of Salina, Kansas, to issue its hospital revenue bonds (Asbury -Salina Regional Medical Center, Inc. Project), Series 1989, in the amount not to exceed $16,100,000. Action 89-304 89-305 89-306 89-307 89-308 Greg Bengtson, City Attorney, reviewed the IRB application and introduced Paul Macek, Executive Vice President for the medical center and Jim Winn, bond counsel with the law firm of Stinson, Mag and Fizzell of Kansas City, Missouri. Paul Macek, Executive Vice President, reviewed a model of the building expansion to be completed by mid 1992. He projected that 20 to 30 full-time positions will be added upon completion of the project. Moved by Commissioner Frank, seconded by Commissioner Beggs that the item on the consent agenda be approved with the correction of Commission Action #89-300 be $58,000 instead of $54,000, and that the name of Billy Bashford be corrected to Kelly Bashford. DEVELOPMENT BUSINESS (7.1) Second Reading Ordinance Number 89-9331, amending Section 42-59 of the Salina Code pertaining to the temporary or seasonal uses of property in the City of Salina, and repealing the existing section. [Z89-7, filed by the City Planning Commission, for amendment to Section 42-59 of the Salina Code] Moved by Commissioner Beggs, seconded by Commissioner Frank that Ordinance Number 89-9331, amending Section 42-59 of the Salina Code pertaining to the temporary or seasonal uses of property in the City of Salina, and repealing the existing section, be adopted. (7.2) Second Reading Ordinance Number 89-9332, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof. [Z89-9, filed by KCT for Blocks 16, 16B, 17, 18, 20, 21, 22, 23, Schilling Subdivision to District "U"] Moved by Commissioner Divine, seconded by Commissioner Ryan that Ordinance Number 89-9332, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. (7.3) Second Reading Ordinance Number 89-9333, amending Section 42-221 of the Salina Code pertaining to bulk regulations for MH -S District; and repealing the existing section. [Z89-10, filed by Monty Montee, for amendment to zoning ordinance to reduce the side yard setback requirements in Manufactured Home Subdivisions] Moved by Commissioner Frank, seconded by Commissioner Beggs that Ordinance Number 89-9333, amending Section 42-221 of the Salina Code pertaining to bulk regulations for MH -S District; and repealing the existing section, be adopted. (8.4) Resolution Number 89-4111, authorizing and ordering certain curbing, guttering, paving, grading, storm sewer, water main and services, and sanitary sewer improvements, ordering preparation of plans and specifications and the estimate of costs. [Engineering Projects 89-789 and 89-7901 Action 89-314 89-315 89-316 89-317 The Commissioners and staff discussed the possibility of adding asphalt curb, gutter and sidewalk to the specifications as a bidding option and a financing limit for construction projects. Moved by Commissioner Ryan, seconded by Commissioner Divine that Resolution Number 89-4111, authorizing and ordering certain curbing, guttering, paving, grading, storm sewer, water main and services, and sanitary sewer improvements, ordering preparation of plans and specifications and the estimate of costs, be adopted. (8.5) Resolution Number 89-4112, authorizing and ordering certain sidewalk improvements, ordering preparation of plans and specifications and the estimate of costs. [Engineering Project 89-7911 The Commissioners and staff discussed the procedure required to add individual sidewalk requests to the sidewalk project. Moved by Commissioner Ryan, seconded by Commissioner Beggs that Resolution Number 89-4112, authorizing and ordering certain sidewalk improvements, ordering preparation of plans and specifications and the estimate of costs, be adopted. Aye: (5) . Nay: (0) . Motion adopted. (8.6) Request by Ben Frick for City Commission approval to use public property for aesthetic purposes. [To fly "Welcome" flags on North Ninth, North Santa Fe, North Broadway, Pacific] Jim Gile explained that Mr. Frick had a prior commitment and had to leave the meeting before his item could be considered. Commissioner Divine asked that staff contact Mr. Frick so the unanswered questions can be resolved before the matter is considered again. Moved by Commissioner Ryan, seconded by Commissioner Frank that consideration of this item be postponed until August 21, 1989 so Mr. Frick can be present. Aye: (5). Nay: (0). Motion adopted. (8.7) Selection of a real estate agency to market tax sale properties. Mayor Warner drew the name of Max McClintock Realty by lottery. (8.8) Recommendation from the Salina Tree Advisory Board that the City of Salina offer a tree planting cost -share program for the residents affected by the current Ohio Street widening project. Steve Snyder, Director of Parks and Recreation, reviewed the proposed tree planting cost -share program and asked that the program be approved. Moved by Commissioner Ryan, seconded by Commissioner Divine that the recommendation of the Salina Tree Advisory Board be accepted and that the tree planting cost -share program for the residents affected by the current Ohio Street widening project be approved. Aye: (5). Nay: (0). Motion adopted. OTHER BUSINESS Mayor Warner announced that the August 21, 1989 meeting will convene at 7:00 p.m. in the City Commission meeting room. Commissioner Frank commented on the completion of the Ohio Street and Iron Avenue widening project.
