04-07-2014 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS April 7, 2014 4:00 p.m. w The City Commission convened at 2:30 p.m. for Economic Development Guidelines, No. 2 and at 3:45 p.m. for Citizens Forum. C N The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, a City -County Building. Roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Barbara V. Shirley (presiding), Commissioners ,on R. Blanchard, Kaye', Crawford, Randall R. Hardy, and Aaron Householter. Also present: Jason A. Gage, City Manager; Michael D. Schrage, Deputy City Manager; Greg Bengtson, City Attorney; and Shandi Wicks, City Clerk. AWARDS AND PROCLAMATIONS (3.1) The week of April 6-13, 2014 as "National Volunteer Week" in the city of Salina. Clay Thompson, Volunteer Connection Advisory Council Chairman, read the proclamation and announced upcoming events. (3.2) The month of April 2014 as "Fair Housing Month" in the city of Salina. Gary Martens, Chairman of the Human Relations Commission, read the proclamation and announced upcoming events. (3.3) The month of April 2014 as "Sexual Assault Awareness Month" in the city of Salina. Amanda Olivier, Sexual Assault Advocate with DVACK, read the proclamation and announced upcoming events. (3.4) The week of April 7 - 11, 2014 as "National Work Zone Awareness Week" in the city of Salina. Dennis DeWitt, Traffic Foreman with the Public Works Department, read the proclamation. CITIZEN FORUM None. HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public hearing and report on Petition No. 4363 (filed by George Stein, President of SCR, Inc.), requesting the vacation of a 7 foot north -south utility easement running along the west 7 feet of Lots 13 and 14, Block 1 of the Holiday Addition. (5.1a) First reading Ordinance No. 14-10734. Mayor Shirley opened the public hearing. Dean Andrew, Director of Planning, explained the nature of the current request and affected public and franchise utilities. There being no further comments the public hearing was closed. 14-0090 11 Moved by Commissioner Blanchard, seconded by Commissioner Householter, to pass Ordinance No. 14-10734 on first reading. Aye: (5). Nay: (0). Motion carried. ' CONSENT AGENDA (6.1) Approve the minutes of March 24, 2014. (6.2) Authorize the purchase of one ambulance from Osage Ambulance in the amount of $194,621. (6.3) Authorize Amendment No. 1 to the Loan Agreement (Loan) between the Kansas Department of Health and Environment, acting on behalf of the State of Kansas, and Salina, Kansas for the purpose of financing improvements to the City's water distribution system. (6.4) Authorize the purchase of two traffic detection systems from Gade Sales Company, Inc., in the amount of $33,990. Page 1 (6.5) Award of contract for the abatement of nuisances to Loux Home Repair for the period of April 7, 2014 through March 31, 2015. 14-0091 Moved by Commissioner Householter, seconded by Commissioner Hardy, to approve the consent _ agenda as presented. Z n ADMINISTRATION 9 (7.1) Authorize City Manager to sign a request from KDOT to exchange 2014 federal funds for a the Iron Avenue Improvements, Project No. 13-3008. R Dan Stack, City Engineer, explained the rules and requirements of the program, current request and recommended action. Commissioner Crawford asked if the City is likely to receive the funds. Mr. Stack responded. Commissioner Hardy asked if this is the amount of funds that we will receive every near. Mr. Stack responded. Commissioner Blanchard asked if the funding source is different than that discussed for the Greeley Bridge project. Mr. Stack responded. Mr. Stack asked the commission if they preferred the funds to be used for Iron Avenue Improvements project. The Comrnission concurred. 14-0092 Moved by Commissioner Crawford, seconded by Commissioner Blanchard, to authorize the Citv Manager to sign the request from KDOT to exchange 2014 federal funds for the Iron Avenue ,Improvements, City Project No. 13-3008. Aye: (5). Nay: (0). Motion carried. (7.2) Consideration of bids for Bill Burke Park Severe Weather Egress, Project No. 14-3025. Dan Stack, City Engineer, explained the project, bid received and recommended action. Commissioner Householter asked if the egress would only be used for severe weather purposes and the possibility of implementing a traffic signal at the intersection. Mr. Stack, Jason Gage, Citv Manager and Dion Louthan, Director of Parks and Recreation, responded. Commissioner Blanchard asked staff to provide information on the purpose of installing the egress. Commissioner Crawford noted that it is a dangerous intersection. Commissioner Crawford was in favor of rejecting the bid. Commissioner Blanchard asked if the project was a split between severe weather safety and an exit system and what the protocol would be in the event of a tornado. Mr. Louthan responded. Commissioner Blanchard asked about the driving lane width, signage and traffic flow. Mr. Louthan responded. Commissioner Hardy asked if utilizing two lanes to turn was an option. Mr. Louthan and Mr. Gage responded. Commissioner Hardy asked about the project budget and the engineer's estimate. Mr. Stack responded. Commissioner Blanchard asked about the driving lane width. Mr. Stack responded. Mr. Gage provided information regarding the project amounts. Mr. Stack provided information pertaining to dirt that can be hauled to the jobsite by City staff. Commissioner Blanchard appreciated staff taking citizen complaints concerns and finding a solution. 114-0093 Moved by Commissioner Householter, seconded by Commissioner Crawford, to reject the bid for Project No. 14-3025, Bill Burke Park Severe Weather Egress and enter into direct negotiations with oncrete and dirt contractors. Aye: (5). Nay: (0). Motion carried. .3) Certification of final costs for 2013 special assessment projects. (7.3a) First reading Ordinance No. 14-10733 levying special assessments for improvements. Dan Stack, City Engineer, explained the projects, total costs and funding. (7.4) Approve the 2014 Vehicles and Equipment purchases. Rod Franz, Director of Finance and Administration, summarized the bids received and a w proposals. Commissioner Blanchard asked the uses of vehicles for Parks & Recreation and the oalternate bids for a Hvbrid. Dion Louthan, Director of Parks & Recreation, responded. 0 Commissioner Blanchard asked if the items listed on the public auction site are offered to other departments prior to being put on the site. Mr. Franz responded. Mr. Franz noted that the vehicles and equipment to be disposed are old and dated. 14-0095 Moved by Commissioner Householter, seconded by Commissioner Crawford, to approve the purchases as presented. (7S) Direct staff to complete preliminary work needed in preparation of future policy actions to be considered by the City Commission necessary to address an inquiry by a telecommunications company to deploy a small cell distributed antenna system (DAS) within our community. Jason Gage, City Manager, explained the nature and purpose of the request and possible application requirements. Commissioner Hardy asked how often the DAS will be placed within a specific area. Mr. Gage responded. Commissioner Blanchard asked if federal regulations prohibited the locations the City could designate for placement. Mr. Gage responded. Commissioner Blanchard asked if the small cell DAS would affect the right-of-way management ordinance and if the state legislature would have anv effect on these ' regulations. Mr. Gage responded. Commissioner Hardy asked if it would be beneficial to have a code that included additional technology in case the current request is no longer used in the future. Mr. Gage responded. Commissioner Blanchard asked if the right -of -Hay management code could be updated in the future if needed. Mr. Gage responded. 14-0096 Moved by Commissioner Hardy, seconded by Commissioner Householter, to authorize the required use of a franchise agreement for the deployment of a small cell DAS within the City's fight -of -way; complete the draft right-of-way management agreement to address a small cell DAS and'update the City's wireless antenna regulations within the zoning code. Ave: (5). Nay: (0). Motion carried. EVELOPMENT BUSINESS (8.1) Authorization to proceed with Housing Study Requests for Qualifications. Gary Hobbie, Director of Development Services, explained previous studies, completed qualification requirements, scope of service tasks and key concerns. Jason Gage, City Manager, provided information on the key points available upon the conclusion Df the study. ommissioner Blanchard felt the housing study would be a tool for a housing vision and provided ommunity goals from the Comprehensive Plan that would fit. Commissioner Blanchard asked taff the timeframe for the request for qualifications. Mr. Hobbie responded. ommissioner Blanchard asked to include additional key concerns to the Request for nmissioner Hardy thought this tool would help builders and developers know, what types of ising is needed in the community. nmissioner Householter also provided his thoughts on the need for the study. A conversation ued between the commissioners regarding the need for the study. uiis Lauver, Salina Chamber of Commerce, provided information regarding the unemployment and labor availability, challenges in housing and possible positive results of the housing study the community. Page 3 Daryl Bixby, Daryl Bixby Construction, agrees with Mr. Lauver for the need to work together and expressed his concern of the costs. Commissioner Crawford provided her thoughts on the rental market and asked if the ability to build a single family home or rental home at a cost that citizens can afford is doable. Mr. Bixby responded. i Commissioner Householter complemented Mr. Bixby on his work and the need for the property a w maintenance code. Commissioner Blanchard provided his thoughts on the study, additional community goals from 1 e the Comprehensive Plan that fall into play and implementing the plan after the study is completed. Mr. Gage wanted the Commission to be mindful of the potential need for fund dollars to be requested in the future for the implementing of the plan. 14-0097 Moved by Commissioner Householter, seconded by Commissioner Blanchard, to authorize staff to proceed with Requests for Qualifications for a Housing Study as described. Ave: (5). Nay: (0). Motion carried. conversation ensued between the commissioners pertaining to solicitation of community partner rticipation in funding the Housing Study. >rnmissioner Blanchard provided his thoughts on the need for the City to fund the study even if e community partners are not available. Conversation ensued between Commissioner Blanchard, ayor Shirley and Commissioner Hardy regarding the community partners. Gage provided information regarding funding and community interest. City Commission came to a consensus to allow formal authorization of City Commission itation of community partners participation in funding the Housing Study. OTHER BUSINESS Commissioner Blanchard asked staff for information regarding the disposal of yard waste. Mike Fraser, Director of Public Works, responded. 1 Mayor Shirley asked if the animal control officers work weekends to pick up animals at large. Jason Gage, City Manager, and Dion Louthan, Director of Parks & Recreation, responded. The Commission provided information on the Bowl for Kids Sake event this past weekend. 14-0098 Moved by Commissioner Blanchard, seconded by Commissioner Householter, to recess into executive session for 10 minutes to discuss with legal counsel matters subject to the attorney-client privilege for the reason that public discussion of those matters would waive the privilege and adversely affect the City's interest in the matters and reconvene at 5:55 p.m. The City Commission recessed into executive session at 5:45 p.m. and reconvened at 5:55 p.m. No action was taken. 14-0099 Moved by Commissioner Blanchard, seconded by Commissioner Householter, to extend the current executive session for an additional 10 minutes.
