REGULAR MEETING OF THE BOARD OF COMMISSIONERS
March 10, 2014

w The Citv Commission convened in Study Session at 2:30 p.m. for Iron Avenue Improvements
Project and at 3:45 p.m. for Citizens Forum.
The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107,
' City -County Building. Roll call was taken followed by the Pledge of Allegiance and a moment of
silence.
Those present and comprising a quorum: Mayor Barbara V. Shirley (presiding), Commissioners
Jon R. Blanchard, Kaye J. Crawford, and Aaron Householter.
Absent: Commissioner Randall Hardy.
Also present: Jason A. Gage, City Manager; Michael D. Schrage, Deputy City Manager; Greg
Bengtson, City Attorney; and Shandi Wicks, Interim City Clerk.
AWARDS AND PROCLAMATIONS
None.
CITIZEN FORUM
Jim Vint, 741 Guernsey, Apt #12, quoted information from an article published in the Salina
Journal pertaining to a police raid of a family home in Leawood, Kansas. He provided his thoughts
on police policy and tactics and lack of information he received on questioning of the City police
tactics and policy. Commissioner Householter and Jason Gage, Citv Manager, responded.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
None.
1CONSENT AGENDA
(6.1) Approve minutes of February 24, 2014.
(6.2) Approve minutes of March 10, 2014.
(6.3) Authorize the purchase of one Halogen valve controller at the Water Treatment Plant.

ADMINISTRATION
(7.1) First reading Ordinance No. 14-10732 establishing a 90 -day moratorium on new hookah
bars and vapor bars.
Jason Gage, City Manager, explained the zoning regulations, the definition of tobacco
hookah, non -tobacco hookah and an e -cigarette, and the establishment of a temporary
moratorium.
Mayor Shirley asked what the ingredients of a non -tobacco hookah contain. Mr. Gage
responded.
Commissioner Blanchard asked if the ninety days is an adequate time period. Mr. Gage and

Commissioner Blanchard asked with the non -permitted or unlawful use and the
moratorium in place would the current businesses remain unlawful after the moratorium is
complete. Mr. Bengtson and Mr. Gage responded.
Commissioner Blanchard also asked if City staff is confident that the current open locations
are performing legally without the use of tobacco. Mr. Gage responded.
Commissioner Blanchard asked if staff has obtained ordinance information from the City of
McPherson pertaining to their hookah bar. Mr. Gage responded.
Mr. Bengtson provided state legislative information regarding the ability for minors to
purchase e -cigarettes.
Commissioner Crawford asked if the state legislature has passed a prohibition regarding

the sale of e -cigarettes to minors. Mr. Bengtson responded.
Sophy Kea, 917 Choctaw, owner of Salina Vape Lounge, 117 E. Iron, provided information
pertaining to vapor lounges and the current law. Conversation ensued between the
Commission and Mr. Kea.
Commissioner Householter thanked Mr. Kea for his information and willingness to follow
the law.

Householter, Shirley. Nay: (0). Motion carried.
DEVELOPMENT BUSINESS

or Shirley provided her thoughts on the lack of quality of rental housing in the City of Salina,
need for a housing needs assessment and her willingness to solicit funds so the tax payers will
have to pay for it. Mayor Shirley noted an email was sent to her fellow commissioners
taining a draft letter pertaining to the housing needs assessment. Commissioner Householter
�d the increasing need for citizens to follow the property maintenance code to help make the
a better place to live. Jason Gage, City Manager, responded.
nmissioner Householter asked if the City is participating in the house painting project that we
e done in the past. Gary Hobbie, Director of Development Services, responded.
Hobbie provided information regarding the nuisance of vehicle parking in front yards.
nmissioner Blanchard felt that the housing needs assessment is long overdue and thought
)ful information can be found from the last assessment done. Commissioner Crawford
vided information on the last time a housing assessment was completed.
Bengtson provided information on open meetings and the conduct of interaction pertaining to
email and letter submitted to the other commissioners by the Mayor.
Blanchard acknowledged the promotions of staff within the Police Department.
