AN ORDINANCE AMENDING SECTION -25 OF THE CITY CODE TO PERMIT
CONSUMPTION OF ALCOHOLIC LIQUOR ON THE SALINA BICENTENNIAL
CENTER PARKING LOT AND GROUNDS.

BE IT ORDAINED by the Governing Body of the City of Salina. Kansas:

Section 1. That Chapter 5, Article 11. Section 5-25 of the Salina Code, is hereby amended to
read as follows:

Pursuant to K.S.A 41-719(d):
(1) It shall be lawful to drink, or consume alcoholic liquor at the following locations and
areas, at times and places authorized by the rules and regulations adopted for such
locations' operation:
(a) Within the confines of the Salina Bicentennial Center, and on the grounds
and parking lots under city ownership surrounding the Salina
Bicentennial Center, located in Kenwood Park:
(b) Within the confines of the Salina Community Theatre, located at 303 East
Iron Avenue:
(c) Within the confines of the Smoky Hill Museum, located at 211 West Iron
Avenue: and
(d) Within the confines of the portion of Memorial Hall leased to Community_
Access Television of Salina, located at 410 W. Ash.
(2) Only in association with a special event approved by the city manager, with or
without conditions, based upon the information contained in a written application on a
form provided by the city and consideration on the basis of criteria established by
resolution of the governing body, it shall be lawful to drink or consume alcoholic liquor
within the boundaries of the following locations:
1 (a) Jerry Ivey Park:
(b) Bill Burke Park:
(c) The East Crawford Recreational Area:
(d) The Municipal Golf Course: and
(e) Those areas within the Lee District owned by the city and not requiring a
special event temporary permit pursuant to Section 5-24.
Section 2. Summary of Ordinance for Publication. This ordinance shall be published by
the following summary:

On February 10, 2014, the City of Salina, Kansas, passed Ordinance No. 14-
10730. The ordinance amends Chapter 5, Article II, Section 25 of the Salina
Code by permitting the consumption of alcoholic liquor on the Salina
Bicentennial Center grounds and parking lots. A complete copy of the
ordinance is available at w%vw.salina-ks.eov or in the office of the city clerk,
300 W. Ash Street, free of charge. This summary is certified by the city
attorney.
Section 3. Effective Date, This ordinance shall be in full force and effect from and after its
adoption and publication by summary once in the official city newspaper.

SUBJECT: Approval of Outdoor Alcohol Consumption Regulations/Administration
City Ordinance 14-10730, as approved by'the City Commission, allows -the consumption
of alcoholic beverages on the Bicentennial Center grounds once "rules and regulations"
are administratively authorized. This authority is reserved for the city manager.
Please consider the attached documents, which contain the regulations and
administration plan, to be formally approved. Please know that any future deviations to
the regulations will also need to be reviewed and approved. This authorization allows the
full utilization of authority as granted by Ordinance 14-10730. I will also file this
authorization and attached addendums with the City Clerk's Office for attached to the
ordinance in our electronic record system.

Bicentennial Center — Outdoor Alcohol Consumption Administration
The following outlines internal procedures for pre event tailgating at the Salina
Bicentennial center. Tailgating is only permitted when noted on
www.BicentennialCenter.com and signs are posted in the parking lot.
Communication
o All tailgating rules and regulations are posted on Bicentennialcenter.com as well
as linked on each game page.
o Global Spectrum staff will produce a Flier that lists all tailgating rules/regulations
as well as an overview map of the venue with "approved tailgating areas"
highlighted in yellow. These fliers will be distributed to patrons by a security
person roaming the assigned lot, monitoring all pre event tailgating activities.
o A "live read" will be created and given the on -air personality at each live remote
on KSKG - 99.9 FM. The read will detail areas where tailgating is approved.
o Signs listing a I I rules and regulations, as well as overview map of the venue will
be set in high traffic locations around each parking lot. Inventory can
accommodate up to ten locations.
Monitoring
o Two additional Security guards have been employed and will staff the lots
starting four hours prior to kickoff to scheduled kickoff.
o Guards are supplied with radios and golf carts to address needs or incidents in a
timely manner. Guard ratio could vary depending on expected size of event
attendance.

Football Tailgating Policy

The following standards have been developed so that Salina Bombers fans can enjoy their game day
experience to the fullest. We anticipate your cooperation in observing each of these points, which are
provided in the best interest of health and safety.
Tailgating is allowed in all Salina Bicentennial Center Parking lots. Tailgating is prohibited in any county
owned parking lots or grass areas adjacent to the Bicentennial Center Parking lots.
Tailgating Hours:
Tailgating begins 4 Hours prior to kickoff (3 hours prior to doors opening) and ends 30 minutes prior to
kickoff.
Tailgating Rules & Regulations
The Salina Bicentennial Center reserves the right to restrict any vehicle and/or person for reasons
of safety.
2. Tailgating in the parking lots must be limited to the area directly in front or behind the vehicle.
Tail -gating in empty parkinq stalls is prohibited.
3. For safety reasons, we ask that all beverages be consumed from plastic or paper cups.
Beer kegs, party balls, open cans, and glass bottles of beverages are prohibited in all parking
areas.
4. Under no circumstances shall persons under 21 years of age have possession of alcoholic
beverages in the tailgate areas. Persons under the age of 21 must be accompanied by a parent
or legal guardian.

5. "Drinking games (including but not limited to beer pong), and the use of devices intended to
accelerate the consumption of alcohol (including but not limited to funnels or beer bongs) are
prohibited."
6. No open containers of alcoholic beverages will be permitted outside the designated lots.
7. Individuals who interfere with the rights of other people by the use of loud, abusive language and
behavior that prevent others from enjoying tailgating and the game will be asked to cease the
behavior or leave the event.
8. Tailgating participants are responsible for keeping the Bicentennial Center and surrounding areas
clean.
9. Driving under the influence is illegal in the state of Kansas. State drinking and driving laws will be
enforced in and around all parking lots.
10. Solicitation is not allowed on the Bicentennial Center property without permit. The sale of items by
anyone other than venue personnel is prohibited unless the Bicentennial Center has granted prior
approval. All Bicentennial Center solicitation policies apply.
11. Open flame fires, including fire pits, are prohibited in parking lots. Propane and charcoal grills are
permitted. Please properly dispose of all hot coals.
12. Please be aware that individuals who violate the above rules and regulations will be asked to
leave the property and be subject to legal penalties.
13. Golf carts, segways, skateboards, bicycles, scooters and other non licensed motorized vehicles
are not permitted to be operated within the Bicentennial Center parking areas.
14. Portable electric generators (6,50OW or less) are allowed. However, electrical cords cannot be
placed across parking area drive aisles.
All Bicentennial Center parking areas are patrolled by security and local law enforcement
officers. All fans should enjoy their tailgating experience in a responsible fashion.
Tailgating is only permitted when noted on our website and signs are posted in the parking
