AN ORDINANCE PROVIDING FOR THE VACATION OF A THIRTY FOOT (30')
SEGMENT OF THE PLATTED RESTRICTED ACCESS ALONG THE NORTH SIDE OF

NATER WELL ROAD ABUTTING LOT ONE (1), BLOCK THREE (3) IN THE AIRPORT
INDUSTRIAL CENTER SUBDIVISION OF THE CITY OF SALINA, SALINE COUNTY,
KANSAS.

BE IT ORDAINED by the Governing Body of the City of Salina. Kansas:

Section 1. Petition and Public Hearing. That on December 9, 2013 the governing body

conducted a public hearing ("Public Hearing") on the petition filed by Lee Young on behalf of the
Salina Vortex Corp. ("Petitioner') requesting the vacation of thirty (30) feet of the platted restricted
access along the north side of Water Well Road; beginning at a point six hundred fifty-five (655')
east of the east right-of-way line of Scanlan Avenue and ending at a point four hundred eight -six
feet (486') west of the west edge of the west right-of-way line of Centennial Road, for the purpose
of constructing a driveway opening on Water Well Road to serve Salina Vortex Corp.'s
manufacturing facility.
Section 2. Findings. That the governing body finds from the evidence presented in relation to the
requested access drive:
1). Water Well Road is classified as a minor arterial street with a relatively low traffic volume
of 2;200 vehicles per day. Because of the presence of the airport runway and rural land to
the west it is unlikely to experience a large increase in traffic volumes in the future.
2). There is almost %< of a mile of spacing between the Centennial Road and Scanlan Avenue
intersections and the Access Management Manual published by the Transportation Research
Board recommends a 1/8 of a mile spacing between intersections on minor arterials. The
driveway opening requested by Salina Vortex is well placed and centered between the two
street intersections and also complies with the recommended access spacing (500 ft. at 55
Omph and 365 ft. at 45 mph) in the KDOT Access Management Policy Manual.
3). The proposed driveway entrance/exit location would be outside the area of influence of the
Scanlan Avenue -Water Well Road and Centennial Road -Water Well Road intersections if
the speed limit on Water Well Road is reduced to 45 mph.
4). Salina Vortex is a manufacturing use and not a retail commercial use and use of the
proposed driveway would be minimal except at shift changes.
5). Based on the design and layout of the Salina Vortex site; the requested driveway would not
be used by truck traffic entering or leaving the site.
6). The Salina Vortex employee parking lot is essentially a 900 sq. ft. long cul-de-sac and a
parking area of that length (900 ft.) and that capacity (184 spaces) should have a second
outlet for public safety reasons.
7). Restricted access will remain in place along the remaining Water Well Road frontage of
Lots I and 2.
Conclusions. That on the basis of those findings and conditions; the governing body
that:
(A) Due and legal notice has been given by publication as required by law;
(B) No private rights will be injured or endangered by the requested vacation of restricted
access;
(C) The public will suffer no loss or inconvenience therebv ; and
(D) Injustice to the Petitioner, the prayer of the Petitioner ought to be granted.
Section 4. Recording. That for the purpose of recording this ordinance with the office of the
Saline County Register of Deeds, this vacation of a segment of platted restricted access relates to

that tract of real property described as Lot One (1); Block Three (3) in the Airport Industrial Center
Subdivision to the Citv of Salina, Saline County, Kansas.
Section 5. Effective Date. That this ordinance shall be in full force and effect from and after its

On December 16; 2013 the City of Salina, Kansas passed Ordinance No. 13-10722.
The ordinance approves a thirty foot (30') break in the restricted access along the
north side of Nater Well Road to allow a driveway entrance into Salina Vortex's
manufacturing facility at 1725 Vortex Avenue. This summary is certified by the City
