11-25-2013 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS November 25, 2013 4:00 p.m. w The City Commission convened at 2:30 p.m. in a Study Session for an executive session and citizens open forum. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City -County Building. A roll call was taken followed by ' the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Barbara V. Shirley (presiding), Commissioners Jon R. Blanchard, Kaye J. Crawford, Randall R. Hardy, and Aaron Householter Also present: Jason A. Gage, City Manager; Michael D. Schrage, Deputy City Manager, Greg Bengtson, City Attorney; and Lieu Ann Elsey, City Clerk AWARDS AND PROCLAMATIONS None. FORUM Joan Ratzlaff urged the Commission to change the meeting time to later than 4:00 p.m. LIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of November 18, 2013. A discussion occurred between Commissioner Hardy and City Attorney Greg Bengtson regarding executive session extensions. 13-0392 Moved by Commissioner Crawford, seconded by Commissioner Hardy, to approve the consent agenda as presented. Aye: (5). Nay: (0). Motion carried. NISTRATION (7.1) Second reading Ordinance No. 13-10725 vacating a portion of a platted utility easement occupying the north 35 feet of Lot 16, Block 1 of the Replat of Pheasant Ridge Addition. Mayor Shirley noted that Ordinance No. 13-10725 was passed on first reading on November 18, 2013 and since that time no comments have been received. 13-0393 Moved by Commissioner Crawford, seconded by Commissioner Householter, to adopt Ordinance No. 13-10725 on second reading. A roll call vote was taken. Aye: (5) Blanchard, Crawford, Hardy, Householter, Shirley. Nay: (0). Motion carried. (7.2) Second reading Ordinance No. 13-10724 levying Salina Business Improvement District No.1 service fees for 2014. Mayor Shirley noted that Ordinance No. 13-10724 was passed on first reading on November 18, 2013 and since that time no comments have been received. 13-0394 Moved by Commissioner Blanchard, seconded by Commissioner Householter, to adopt Ordinance No. 13-10724 on second reading. A roll call vote was taken. Aye: (5) Blanchard, Crawford, Hardy, Householter, Shirley. Nay: (0). Motion carried. (7.3) Award of contract for the replacement of chilled water piping at the Police Department Administrative building, Project No. 13-3002. Dion Louthan, Director of Parks and Recreation, explained the project, bid received, Page 1 and project funding. Mr. Louthan also responded to Commissioner Blanchard's questions regarding the bid received, project estimate, and implications of re- bidding the project. Commissioner Householter was not in favor of re -bidding the project and shouldn't w punish the contractor that submitted a proposal. = Commissioner Crawford concurred with Commissioner Householter. ' N 4 Commissioner Hardy felt that the size of the contract may determine the number of 3 bids received; this project would likely have little interest. 13-0395 Moved by Commissioner Crawford, seconded by Commissioner Blanchard, to award the contract for the replacement of chilled water piping at the Police Department Administrative Building, Project No. 13-3002 to American Commercial and Residential Services, LLC in the amount of $17,109. Ave: (5). Nay: (0). Motion carried. BUSINESS Resolution No. 13-7055 regarding the City of Salina's Development Policy for the Financing of Public Improvements. Michael Schrage, Deputy City Manager, explained the current policy, study session presentations, and proposed options. Commissioner Blanchard commented on the options presented and moratorium. He felt that the revised policy would allow flexibility and that it is important to get policies inline with the Comprehensive Plan. Commissioner Blanchard also suggested of reducing the pay back period for special assessments to ten years instead of 15. Commissioner Hardy commented on the cost of development, importance of redevelopment and looking for different ways of funding. ' Jason Gage, City Manager, clarified the moratorium in place for residential and commercial development. Commissioner Crawford expressed her opposition of extending the moratorium. Stan Byquist, 2601 S. Ohio, urged the Commission to approve Version "B" of the proposed resolution. Abner Perney, 101 Overhill Drive, expressed his concerns with special assessments and that purchasers are not made aware of them. He continued by stating he supported the term reduction and the need to focus geographically where assessments would be allowed. Eric Campbell, Summit Plumbing, expressed the need for new housing to bring people into the community. He continued by saying that builders within the community are not fully equipped to take on the responsibility of financing new development solely; job layoffs would result due to decline in houses built. Greg Stephens, 842 S. lOw, spoke on future population trends and the need to attract youthful families to the community. He expressed his support in development and the Comprehensive Plan. David Norlin, 608 E. Republic, commented on in -field development and the need for work force housing that is affordable: He felt it was important to have a long term vision. Todd Welsh expressed the importance of rooftops and attracting people to come and stay within the community group. He felt that there would be a negative effect to the tax payers and consumers if the financing was eliminated. Kirk Cusick, 2737 E. North Street, spoke of the importance of the Comprehensive Plan and concerns of providing funding for housing outside the city limits. Mike Hoppock, 914 Post Oak Lane, asked the City Commission and staff to provide them with other financing options to develop and redevelop. Mr. Hoppock continued to speak on the Comprehensive Plan and balancing new and Page 2 redevelopment; expressing concerns with discontinuing the use of special assessments will cause developers to leap frog outside the city limits. Bob Haworth, 913 Twin Oaks Drive, felt that the current policy works well and helps development to occur with the increased costs of materials. He also w expressed the importance of bringing new people into the community. Joan Ratzlaff expressed her concerns with new housing taking farm land out of N 8 production and growing away from downtown and historic areas. ' Kelly Dunn, 309 Quail Creek Lane, expressed his concerns of the negative effects U of not using special assessments and is in support of allowing the moratorium to expire. James Blackwell, 219 Blakemoore Drive, felt that stopping development would lead to layoffs and the need for Salina to grow and redevelop existing areas. Paee 3 Rodney Brummett, 646 E. Iron, commented on the cost of remodeling existing homes and encouraged the City Commission to offer incentives for redevelopment. Pete Earles, Earles Engineering, commented on the cost of redeveloping existing structures, financing new development, increased cost of materials and that new growth should not be stopped. Commissioner Blanchard noted an option to remove special assessment financing all together. 13-0396 Moved by Commissioner Blanchard, seconded by Commissioner Hardy, to adopt Version "B" of Resolution No. 13-7055 which readopts Resolution No. 89-1066 with the exception of replacing the word "will" with "may" and striking Section 7 which provides for an exception for petitions filed prior to 1989 which is no longer applicable. Commissioner Householter felt that every new residential house built is a debt to the tax payers and increases taxes. He continued to state that they where not trying to stop building, but to build at your own risk. He felt that it has been made too easy to build in green spaces. Commissioner Hardy is interested in keeping youth in Salina, and looking into `gays that special assessments could be built into the price of the homes. He then expressed concerns of the City's bonding capacity; the decrease bond rating and the affect special assessments have on the bond rating. Commissioner Blanchard expressed the need to improve the city's corridors, downtown development, in -fill redevelopment, and the importance of the Comprehensive Plan. He also concurred with Commissioner Hardy's statements regarding bonding capacity and bond rating. Commissioner Crawford noted that she would like to see a balance; there is a need for new housing and redevelopment and incentives need to be provided. Mayor Shirley thanked the attendees for approaching the Commission in a respectful manner. Mayor Shirley called the question. Aye: (4). Nay: (1) Shirley. Motion carried. OTHER BUSINESS Commissioner Householter asked for the Commission and staff to look into hiring an economic development director. A discussion followed between Commissioner Householter, Commissioner Hardy, and City Manager Jason Gage regarding the current economic development agreement between the City of Salina and the Chamber of Commerce. Commissioner Crawford thanked the Quilts of Valor Chapter 809 for presenting her husband with a quilt for his service in the armed forces. She also thanked all the veterans for their service. Page 4 Daryl Bixby, 1519 Briargate, commented on the cost of rebuilding and development. He expressed a need for a long term plan for redevelopment. Mr. Bixby also commented that special assessments are required to be disclosed to the purchaser. Trace)' Sin, 340'/2 S. Connecticut, expressed the need for quality homes in Salina. w Diana Dierks, 1221 Sunrise Drive, commented on the requirement to disclose Nspecial assessments when selling a home; she expressed concerns with reducing the term of the special assessments and job eliminations if development is stopped. 3 William Humphry, 600 E. Elm Street, expressed the importance of redevelopment. Alan Jilka, 849 S. 91', expressed his concerns of subsidizing green field development, and whether local government should be subsidizing tax dollars to finance development. Dennis Lauver, Chamber of Commerce, expressed his concerns of the lack of affordable housing and the need for a comprehensive housing strategy. He continued to express his concerns of development going to outside counties. Rodney Brummett, 646 E. (9.1) Request for executive session (legal and personnel). 13-03_97 Moved by Commissioner Blanchard, seconded by Commissioner Hardy, to recess into executive session for 60 minutes to discuss with legal counsel matters subject to the attorney-client privilege for the reason that public discussion of those matters would waive the privilege and adversely affect the City's interest in the matters and for the purpose of discussing matters pertaining to non -elected City personnel for the reason that public discussion of the matter would violate the privacy rights of the non -elected personnel involved; and reconvene at 7:00 p.m. Aye: (5).
