13-7054 Acquisition of Interests 9th and Cloud ImprovementsRESOLUTION NUMBER 13-7054 A RESOLUTION STATING THE POLICY OF THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS, REGARDING THE ACQUISITION OF INTERESTS IN REAL ESTATE FOR THE NINTH AND CLOUD IMPROVEMENTS PROJECT. a w WHEREAS, the Kansas Department of Transportation ("KDOT") has authorized $350,000 of the $1.1 million estimated total cost of project number 85 U -0066-01—a project to re -align and ' N widen travel lanes, revise parking, install new traffic signals, and close several driveways at the Ninth Street and Cloud Street intersection (the "Project"); and U WHEREAS, the City will, in its own name, acquire the interests in real estate necessary for the Project in compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 as amended by the Surface Transportation and Uniform Relocation Assistance Act of 1987 (the "Act"), and administrative regulations contained in 49 C.F.R. part 24, entitled Uniform Relocation Assistance and Real Property Acquisition for Federal and Federally Assisted Programs (the "Regulations"); and WHEREAS, pursuant to Resolution 13-7049, the governing body established the amount of just compensation for the 7 parcels of real property to be $89,730; and WHEREAS, certain appraisals used by the governing body to establish just compensation were amended thereby lowering the total appraised value for the 7 parcels to $87,290; and WHEREAS, the governing body desires to state the policy of the City regarding acquisition of the necessary interests in real estate, all in compliance with the Act, and the Regulations; SO NOW, THEREFORE, BE IT RESOLVED, by the governing body of the City of Salina, Kansas: ' Section 1. Acquisition of Real Property. The City has obtained surveys, legal descriptions, title reports, and appraisals in compliance with the Act and the Regulations for the interests in real property to be acquired by the City. Based upon these appraisals, the governing body establishes the amount of just compensation for the interests in real property to be $87,290 in the aggregate for the 7 parcels in compliance with the Regulations. The City has provided or will provide each property owner with a written purchase offer and a written statement of the basis for the offer of just compensation, which shall include the information required under the Regulations. The City Manager is authorized to sign contracts for the purchase of the interests in real property for the amounts determined by the appraisals. If the City is unable to negotiate with the property owner a purchase of the interests in real property based upon the amounts determined by the appraisals, the City Manager is authorized to sign a contract for purchase of the real property for a negotiated purchase price in excess of the City's initial offer, or upon such other terms as are within the scope of the Project budget and consistent with the public interest. Section 2. Reporting to Governing Body. The City Manager shall periodically report the governing body regarding the status of the acquisition of interests in real property throughout it phase of the Project. Section 3. Effective Date. This resolution shall be in full force and effect from and its adoption. ' Adopted by the Board of Commissioners and signed by the ayor this 18th day of November, 2013.
