The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. 6 in Room 107, City -County Building. A roll call was taken followed by the Pledge of Allegiance ' N and a moment of silence. Those present and comprising a quorum: Mayor Barbara V. Shirley (presiding), Commissioners Jon R. Blanchard, Kaye J. Crawford, Randall R. Hardy, and Aaron Householter Also present: Jason A. Gage, City Manager; Michael D. Schrage, Deputy City Manager; Greg Bengtson, City Attorney; and Lieu Ann Elsey, City Clerk AWARDS AND PROCLAMATIONS None. FORUM cey Sin, 340 1/2 S. ' CONSENT AGENDA (6.1) Approve the minutes of October 28, 2013. (6.2) Authorize repair of a river pump at the River Pump Station, Project No. 13-3011 by Layne Christensen Company in an amount not to exceed $18,076.50. (6.3) Award of contract for the 2013 Hike and Bike Trail, Project No. 13-2975 in an amount not to exceed $60,512.95 (which includes a contingency of $5,500). (6.4) Acceptance of a permanent public trail easement dedication for the hike and bike trail along the south side of Schilling Road east of Ohio to the flood control levee. 13-0381 Moved by Commissioner Crawford, seconded by Commissioner Householter, to approve the consent agenda as presented. Aye: (5). Nay: (0). Motion carried. ADMINISTRATION None. DEVELOPMENT BUSINESS (8.1) First reading Ordinance No. 13-10716 amending Chapter 8, Sections 8-171, 8-183,8-191, and 8-192 of the Salina Code by adding a definition for volunteers and providing when volunteers can perform work under exemptions from building contractor and skilled trade contractor licensing and contract registration requirements. Elvin DeVorss, Building Official, summarized the current regulations, Building Advisory Board's recommendation, and proposed amendments. Commissioner Hardy noted a correction Section 8-183. Michael Schrage, Deputy City Manager, explained that the ordinance would bring past practice into compliance. A discussion followed between Commissioner Blanchard, Mr. Schrage, and Mr. DeVorss regarding permit requirements and exemptions. Steve Kmetz, Salina Rescue Mission, requested the item to be returned to the Building Advisory Board. Page I Dick Brown, Habitat for Humanity volunteer, expressed his concerns of the amendment and would like to appear before the Building Advisory Board to express his concerns. A discussion followed between Mr. Brown and Commissioner Householter regarding the type of work that would be allowed. Commissioner Crawford noted that she would be in favor of returning the item to the Building Advisory Board. A discussion followed between Commissioner Householter, Mr. Schrage, City Manager ' o Jason Gage, City Attorney Greg Bengtson, Mr. Kmetz, Commissioner Blanchard, Mr. 13 DeVorss, and Mayor Shirley regarding permit requirements, performance skilled trade work, inspections, and pending legislation. Tracey Sin, 340 1/2 S. Connecticut, expressed the importance of using an agency such as The Volunteer Connect and churches to seek volunteering opportunities. 13-0382 Moved by Commissioner Householter, seconded by Commissioner Crawford, to pass Ordinance No. 13-10716 on first reading and place a moratorium on enforcement of current work being performed until second reading of the ordinance on November 18, 2013. (8.2) Acceptance of the offered easement and restricted access dedication from Kansas Wesleyan University and the vacation of a portion of the South Fourth Street, Claflin Avenue and Osborne Street right-of-way as part of a proposed replat of a portion of the Addition to the Grounds of Kansas Wesleyan University to be know as the Kansas Wesleyan University Sports Complex Addition (Application #P13 -6/6A). Commissioner Householter left at 4:51 p.m. and returned at 4:53 p.m Dean Andrew, Planning and Zoning Administrator, explained the request, utilities, infrastructure, proposed plat, and the Planning Commissions recommendation of approval with the conditions: ' 1. The 10 feet of vacated Claflin Avenue right-of-way shall be retained and shown on the plat as a 10 -foot drainage easement. 2. Kansas Wesleyan University shall, upon terms meeting the approval of the City Commission and prior to construction of its proposed north property line fence, enter into a license agreement with the City of Salina to install and maintain the fence on property subject to the City's easement, including terms under which Kansas Wesleyan University shall agree to temporarily remove or relocate the fence in the event the City of Salina needs to make repairs to or replace the storm sewer pipeline on the south side of Claflin; 3. The right-of-way profile for Osborne Street shall be 46 feet in width and Osborne Street shall be designated as a one way street southbound from Claflin Avenue to Cloud Street with 29 feet of paving width consisting of a 20.5 feet travel lane and 8.5 feet parking land on the east side; 4. Kansas Wesleyan University shall be responsible for marking all physical modifications to Osborne Street to convert the street from two way to one way traffic. 5. Restricted access shall be dedicated and shown along the Claflin Avenue and Cloud Street frontages. ' Mr. Andrew continued to explain that staff would recommend the following supplemental to Condition No. 4: Kansas Welseyan University shall be responsible for preparing and submitting a Supplemental Traffic Analysis consisting of a detailed traffic signal warrant study of the continued need for the Osborne Street - Cloud Street traffic signal with one way traffic on Osborne Street, including recommended updates to the existing traffic signal heads, heads locations, signal timing, crosswalk locations, pavement markings and striping. The signal warrant analysis shall include current pedestrian counts for St. Mary's Elementary School, Sacred Heart and Glenn Martin Stadium and traffic counts and records of recent accidents at the intersection. The traffic analysis shall assess the need for and recommend a location for a marked and/or signalized crosswalk on Cloud Street. Page 2 C Kansas Wesleyan University shall be responsible for making all physical modifications to the Osborne Street - Cloud Street traffic signals and intersection or alternative crosswalk location recommended by the traffic analysis and approved by the City Engineer. z City Manager Jason Gage spoke on strategic plan goals, traffic flows, and a improvements to the area. Dr. Matt Thompson, Kansas Wesleyan University, commented on the proposed improvements. Commissioner Hardy noted the area being landlocked and the importance of preserving the educational facility. Commissioner Hardy continued by expressing his support of the request. Tracey Sin, 340 lh S. Connecticut, complimented Dr. Thompson for his work he has done for the university. 13-0383 Moved by Commissioner Blanchard, seconded by Commissioner Householter, to authorize the Mayor to sign the Kansas Wesleyan University Sports Complex Addition plat authorizing the vacation of portions of the South Fourth Street, Claflin Avenue, and Osborne Street right-of- way and accept the offered drainage easement and restricted access dedications as recommended by the Planning Commission with the subjected conditions and with the additional of the supplemental condition to Condition No. 4 stated above. The City Commission took a short break at 5:14 and returned at 5:22 p.m. (8.3) Application # PDD 13-2/2A (filed by Kansas Wesleyan University) requesting a change in zoning district classification from U (University) district to PDD/U (Planned Development District/ University) and approval of a preliminary development plan to allow redevelopment of the Kansas Wesleyan Sports Complex facilities. (8.3a) First reading Ordinance No. 13-10723. Dean Andrew, Planning and Zoning Administrator, explained the current zoning, request, facility improvements, site plan, Planning Commission's recommendation, and off-street parking. Commissioner Blanchard complimented the City of Salina, Kansas Wesleyan University, and Wilson & Company's staffs for their work. Mr. Andrew then responded to Commissioner Blanchard's questions regarding off-street parking. Matt Thompson, Kansas Wesleyan University, thanked the Commission and welcomed any additional questions. The Commission continued to express their appreciation to the applicant and proposed improvements to the area. Dennis Lauver, Salina Chamber of Commerce, commented on the economic impact to the community. 13-0384 11 Moved by Commissioner Householter, seconded by Commissioner Hardy, to pass Ordinance No. 13-10723 on first reading. OTHER BUSINESS Commissioner Crawford asked the City Commission to consider nominating City Clerk ' Lieu Ann Elsey for the Mildred Vance City Clerk of the Year Award and submitting an application to the City Clerk and Municipal Officers Association by December 31, 2013. The City Commission concurred with the request. Commissioner Blanchard applauded staff for their work in presenting the Comprehensive Plan Overview study session earlier. (9.1) Request for executive session. Page 3 13-0385 Moved by Commissioner Blanchard, seconded by Commissioner Householter, to recess into executive session for 60 minutes to discuss with legal counsel matters subject to the attorney- client privilege for the reason that public discussion of those matters would waive the privilege and adversely affect the City's interest in the matters, for the purpose of discussing matters pertaining to non -elected City personnel for the reason that public discussions of the w matter would violate the privacy rights of the non -elected personnel involved, and to discuss confidential data relating to the financial affairs and trade secrets of a corporation for the reason that public discussion of the information would competitively disadvantage the corporation and reconvene at 6:50 p.m. Aye: (5).
