08-10455 Vacation Restricted Access East of Lakewood SchoolSummary published in The Salina Journal'j¢p ,90.1 ORDINANCE NUMBER 08-10455 AN ORDINANCE PROVIDING FOR THE VACATION OF PLATTED RESTRICTED ACCESS IN TWO (2) LOCATIONS ALONG THE EAST LINE OF THE LAKEWOOD SCHOOL ADDITION IN THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on July 14, 2008 the governing body conducted a public hearing on the petition filed by Unified School District Number 305 ('Petitioner") requesting vacation of restricted access along the east line of the Lakewood School Addition in two (2) locations that were approved on an interim basis to allow school bus ingress and egress on a circular drop off drive connecting to Lakewood Park Drive into the Lakewood Middle School site and in a third location one hundred (100) feet to the south to allow full driveway access from the Lakewood Middle School site onto Lakewood Park Drive. The northernmost requested access break for bus ingress and egress is thirty (30) feet wide and begins at a point one hundred and ninety-nine (199) feet south of the northeast corner of the Lakewood School Addition. The second requested access break for school bus ingress and egress is thirty (30) feet wide and begins at a point four hundred and fifty-nine (459) feet south of the northeast corner of the Lakewood School Addition. Section 2. Findings. That the governing body finds from the evidence presented at the public hearing that (1) Due and legal notice has been given by publication as required by law; (2) That no private rights will be injured or endangered by vacation of the Restricted Access in these two (2) locations; (3) That the public will suffer no loss or inconvenience thereby, and that injustice to the Petitioner vacation of the Restricted Access in those locations should be granted as requested. ' Section 3. That the restricted access markings along the east line of the Lakewood School Addition shown on the recorded plat and the restricted access note on the plat are hereby amended to allow school bus ingress and egress to a bus drop off area only, and not full vehicular access to the school site, in the two (2) requested locations as depicted on the attached and incorporated Exhibit A. Section 4. That for the purpose of recording this ordinance with the office of the Saline County Register of Deeds, this vacation of restricted access relates to that tract of real property described as Lot One (1), Block One (1), Lakewood School Addition to the City of Salina, Saline County; Kansas. Section 5. Repealer. That all prior ordinances in conflict her with as they relate to the above described real estate are hereby repealed. Section 6. Summary of ordinance publication. That this ordinance shall be in full force and effect from and after its adoption and publication once ii the official city newspaper. Ordinance No. 08-10455 Summary On September 9, 2013, the City of Salina, Kanlas, passed Ordinance No. 08-10455. The ordinance vacates the platted restricted access along the east boundary of Lot 1, Block 1 of the Lakewood School Addition in two locations to allow a circular drive serving a bus drop off area for Lakewood Middle School students that was approved on an emergency basis to be used on a ' permanent basis.
