11-30-1989 MinutesAction CITY OF SALINA, KANSAS SPECIAL MEETING OF THE BOARD OF COMMISSIONERS NOVEMBER 30, 1989 4:00 p.m. A Special Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Thursday, November 30, 1989 at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Robert E. Frank Commissioner Stephen C. Ryan comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: None The meeting was called for the purpose of considering the following: 1. Motion to suspend City Commission Procedural Rule No. 20 to permit reconsideration of a question at a special meeting during a week in which a regular meeting will not take place. 2. Motion to reconsider the decision made at the Regular City Commission Meeting of November 20, 1989 to withdraw application for an interchange at 1-135 and Magnolia Road under the Kansas Department of Transportation's System Enhancement Program. 3. (If motion to reconsider prevails) Consider submittal of an official project request for an interchange at 1-135 and Magnolia Road under the Kansas Department of Transportation's System Enhancement Program. Greg Bengtson, City Attorney, reviewed the procedure required for City Commission reconsideration of the motion regarding submittal of an official project request for an interchange at 1-135 and Magnolia Road and recommended that public comment be taken between Items 1 and 2. 1. Motion to suspend City Commission Procedural Rule No. 20 to permit reconsideration of a question at a special meeting during a week in which a regular meeting will not take place. Commissioner Divine stated that he requested the special meeting because Senator Ben Vidricksen called to say he has new and additional information and felt he would like to present this information since the City Commission voted on the issue on November 20. He said he felt it is critical to have all the information possible on this issue before the deadline. Dr. Charles Olson, 2420 Highland, asked to hear the new information. Commissioner Divine read a letter from Senator Ben Vidricksen that he no longer is concerned that the Highway 81 project will be harmed by the Magnolia Interchange and that he is no longer voicing his objections to the Magnolia project. 89-457 Moved by Commissioner Ryan, seconded by Commissioner Divine that City Commission Procedural Rule No. 20, to permit reconsideration of a question at a special meeting during a week in which a regular meeting did not take place, be suspended. Aye: (5) . Nay: (0) . Motion adopted. Action 89-458 89-459 89-460 Dennis Kissinger, City Manager, reviewed the Magnolia Interchange project and said the application deadline is December 1. The following members of the public expressed their concerns about such issues as relocation expenses, the additional tax burden, excessive city spending, 3 interchanges in a 2 mile area: Roger Naylor; Andy Peele, 751 Comanche for Wilber Davis; Larry Triplett, 2111 Melrose Lane; Gary Yates, 509 Star; Ann Nordboe, 1008a West Magnolia Road; Mike Scriven, 217 South Tenth; Jake Hartmetz, 1921 D Glendale; Ernest Cole, 153 South Front; and Andy Peele, 751 Comanche, for himself. Deborah Divine, 1748 Glen, summarized 13 concerns she heard the public express and asked the City Commissioners to sign a petition to support the Highway 81 project. The following members of the public spoke in favor of the Magnolia Interchange: Leo Becker, 2080 Harold; Ed Adams, representing Jim Palmer Trucking at 2359 Hein Avenue; Steve Mulvihill, Manager of Harvest Foods; David Antrim, 436 Seitz; Tim Rogers, Executive Director of the Salina Airport Authority; Randy Duncan, 302 Irene; Jim Waters, 2600 Highland; Gerald Cook, President of the Salina Area Chamber of Commerce. 2. Motion to reconsider the decision made at the Regular City Commission Meeting of November 20, 1989 to withdraw application for an interchange at 1-135 and Magnolia Road under the Kansas Department of Transportation's System Enhancement Program. Moved by Commissioner Divine, seconded by Commissioner Ryan that the City Commission reconsider the decision made at the Regular City Commission Meeting of November 20, 1989 to withdraw application for an interchange at 1-135 and Magnolia Road under the Kansas Department of Transportation's System Enhancement Program. Aye: (5) . Nay: (0) . Motion adopted. 3. Consider submittal of an official project request for an interchange at 1-135 and Magnolia Road under the Kansas Department of Transportation's System Enhancement Program. The City Commissioners and staff discussed specific aspects of the project. Commissioner Divine withdrew his original motion made on November 20, 1989. Moved by Commissioner Ryan, seconded by Commissioner Divine that staff be instructed to submit an official project request for an interchange at 1-135 and Magnolia Road under the Kansas Department of Transportation's System Enhancement Program. After comments by each Commissioner, Mayor Warner called for a roll call vote on Commission Action 89-459: Aye: Divine, Frank, Ryan, Warner (4) . Nay: Beggs (1) . Motion adopted. Moved by Commissioner Ryan, seconded by Commissioner Frank that the Special Meeting of the Board of Commissioners be adjourned. Aye: (5) . Nay: (0) . Motion adopted.
