03-19-1990 MinutesAction 90-096 90-097 CITY OF SALINA, KANSAS REGULAR ;MEETING OF THE BOARD OF COMMISSIONERS MARCH 19, 1990 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, March 19, 1990, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Robert E. Frank Commissioner Stephen C. Ryan comprising a quorum of the Board, also present: Greg Bengtson, City Attorney William E. Harris, Acting City Manager Jacqueline Shiever, City Clerk Absent: Dennis M. Kissinger, City Manager CITIZEN FORUM None AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on 1990 CDBG Community Improvement Program. Mayor Warner declared the public hearing open. There were no comments filed, written or oral, so the Mayor declared the public hearing closed. Roy Dudark, Director of Planning and Community Development, reviewed the CDBG Community Improvement Program. Moved by Commissioner Divine, seconded by Commissioner Frank that April 9, 1990 be set for the final public hearing and that staff be instructed to prepare a formal application for consideration at the final public hearing. Aye: (5). Nay: (0). Motion adopted. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting March 12, 1990. (6.2) Petition Number 3988, filed by James T. Graves, Attorney for Bank IV, Salina, N.A., Trustee of Graves Trusts, for the establishment of a special improvement district for the purpose of payment of the cost of certain storm drainage retention improvements related to Mariposa Subdivision. [Refer the petition to the City Engineer for a recommendation. ) Moved by Commissioner Frank, seconded by Commissioner Ryan that all items on the Consent Agenda be approved. Aye: (5) . Nay: (0) . None DEVELOPMENT BUSINESS Action 90-098 90-099 ADMINISTRATION (8.1) Second Reading Ordinance Number 90-9373, repealing Section 27-17 of the Salina Code regarding animals in City parks. Moved by Commissioner Ryan, seconded by Commissioner Frank that Ordinance Number 90-9373, repealing Section 27-17 of the Salina Code regarding animals in City parks, be adopted. Aye: Beggs, Divine, Frank, Ryan, Warner (5) . Nay: (0) . Motion adopted. (8.2) Resolution Number 90-4176, authorizing the Mayor to execute and the City Clerk to attest a consent to assignment and assumption of undivided one-third tenant's interest and to mortgage of leasehold estate. [ "The Doctors" Industrial Revenue Bond issue.] Greg Bengtson, City Attorney, reviewed "the Doctors" IRB application and reviewed the consent to assignment. He introduced Dr. Norman Macy in the audience who was present to answer any questions of the City Commission. Moved by Commissioner Divine, seconded by Commissioner Ryan that Resolution Number 90-4176, authorizing the Mayor to execute and the City Clerk to attest a consent to assignment and assumption of undivided one-third tenant's interest and to mortgage of leasehold estate, be adopted. Aye: (5). Nay: (0). Motion adopted. OTHER BUSINESS Mayor Warner announced the Neighborhood Open Forum will be held at the Salvation Army at 1137 North Santa Fe Avenue, at 7:00 p.m. this evening. Mayor Warner thanked the community for its support of the victims of the Hesston tornado. Commissioner Frank asked the City staff to check into policy and staff requirements of the Salina Municipal Court to handle the increased case load so cases can be prosecuted which involve damage to city property and cleanup of hazardous material so the citizens are not assessed.
