07-02-1990 MinutesAction CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS JULY 2, 1990 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, July 2, 1990, at 4:00 p.m. There were present: Mayor Robert E. Frank, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Stephen C. Ryan Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) Resolution Number 90-4202, expressing gratitude and appreciation to KENNETH P. SCHMIDT for serving as firefighter and fire lieutenant for the fire department of the City of Salina, Kansas, from May 26, 1960 to June 30, 1990. The Mayor reported Mr. Schmidt was unable to attend the meeting today. (4.2) The Mayor proclaimed the Month of July, 1990, as "NATIONAL RECREATION AND PARKS MONTH." The proclamation was read by Randi Clifford, Recreation Superintendent of the Parks and Recreation Department. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting June 25, 1990. (6.2) Petition Number 3992 was filed by Charles W. Pohlman, 624 Beechwood Road, for the vacation of the south one foot of a utility easement lying along the north property line of Lot 22, Block 1, Georgetown Addition. [Refer to the City Engineer for a recommendation] 90-242 Moved by Commissioner Ryan, seconded by Commissioner Warner that all items on the Consent Agenda be approved. Aye: (5). Nay: (0). Motion adopted. Action 90-243 90-244 DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Planned Development District Application 88-4, filed by Monty Montee and Danny Huehl, for an amendment of the Country Oak Estates Planned Development District, be approved. [ Introduce Ordinance Number 90-9392 for first reading.] Roy Dudark, Director of Planning and Community Development, reviewed the nature of the request to reduce the front yard setback from 25' to 20' in the Country Oak Estates Planned Development District. Moved by Commissioner Warner, seconded by Commissioner Ryan that the recommendation of the City Planning Commission be accepted, that Planned Development District Application 88-4 be amended and that Ordinance Number 90-9392, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 90-9391, authorizing and directing the issuance, sale and delivery of $7,865,000 principal amount of combined Water and Sewage System Revenue Bonds of the City of Salina, Kansas, $5,655,000 of such bonds, designated combined Water and Sewage System Revenue Refunding Bonds, Series 1990-A, to be used for the purpose of refunding two prior issues of combined Water and Sewage System Revenue Bonds of the City, and the remaining $2,210,000 of said bonds, designated Combined Water and Sewage System Revenue Bonds, Series 1990-B, to be used for the purpose of repairing, altering, extending, reconstructing, enlarging and improving the combined water and sewage system, prescribing the form and details of said revenue bonds, providing for the collection, segregation and application of the revenues of said system for the purposes authorized by law, including paying the cost of operation and maintenance of said utility, paying the principal of and interest on the revenue bonds of said city issued against said system and providing adequate reserve funds, making certain covenants with respect to said bonds; approving a preliminary official statement and official statement relating to said bonds authorizing escrow trust agreements and calling certain outstanding combined water and sewage system revenue bonds for redemption. (8.2) Report on bids received Tuesday, June 19, 1990 for Engineering Project 90-801 for the drive-through door project at Fire Station #2, 1110 South Santa Fe. [Award the contract to Lancaster Construction in the amount of $16,844.] Action 90-245 90-246 90-247 90-248 Tom Girard, Fire Chief, reported on the bids received June 19, 1990 and recommended the contract be awarded to Lancaster Construction in the amount of $16,844. Moved by Commissioner Divine, seconded by Commissioner Beggs that the recommendation of the Fire Chief be accepted and that the contract be awarded to Lancaster Construction in the amount of $16,844. Aye: (5). Nay: (0) . Motion adopted. (8.3) Request by Robert L. Marietta, President of Fairfax Enterprises, Inc. to keep five hives of bees (one active) at 1740 Beverly Drive. (West of Old Dry Creek and North of the Moose Lodge) . Moved by Commissioner Beggs, seconded by Commissioner Warner that the request to keep five hives of bees at 1740 Beverly Drive be approved. Aye: (5). Nay: (0). Motion adopted. (8.4) Resolution Number 90-4205, authorizing the Mayor to execute and the City Clerk to attest a contract concurring with the Kansas Department of Transportation in awarding a contract to B 6 W Electrical Contractors, Inc. of Salina for traffic signal improvements at the intersection of Ninth and Cloud Streets. Moved by Commissioner Ryan, seconded by Commissioner Divine that Resolution Number 90-4205, authorizing the Mayor to execute and the City Clerk to attest a contract concurring with the Kansas Department of Transportation in awarding a contract to B & W Electrical Contractors, Inc. of Salina for traffic signal improvements at the intersection of Ninth and Cloud Streets, be adopted. Aye: (5) . Nay: (0) . Motion adopted. OTHER BUSINESS Dennis M. Kissinger, City Manager, reported on the meeting with the Saline County Fair Association regarding ownership of Oakdale and Kenwood Parks, the park building site, loss of open space and litigation concerning the Bicentennial Center parking lot. Mayor Frank announced that the 4th of July celebration will be held during the day in Oakdale Park with games for the children and food, and that the fireworks display will take place at the East Crawford Recreation Center at sundown.
