04-15-2013 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS April 15, 2013 4:00 p.m. N W The City Commission convened at 3:10 p.m. in a Study Session for an executive session. 13-070 Moved by Commissioner Householter, seconded by Commissioner Shirley, to recess into executive session for 20 minutes for the purpose of discussing matters pertaining to non- ' 9 elected City personnel for the reason the public discussion of the matter would violate the privacy rights of the non -elected personnel involved; and reconvene at 3:30 p.m. Aye: (4). Nay: (0). Motion carried Commissioner Crawford arrived at 3:12 p.m. The City Commission reconvened into the regular study session for a citizens forum at 3:45 p.m. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City -County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Norman M. Jennings (presiding), Commissioners Samantha P. Angell, Kaye J. Crawford, Aaron Householter, and Barb Shirley Also present: Jason A. Gage, City Manager; Michael D. Schrage, Deputy City Manager; Greg Bengtson, City Attorney; and Lieu Ann Elsey, City Clerk CITIZEN FORUM None. AWARDS AND PROCLAMATIONS (4.1) The day of April 26, 2013 as "Arbor Day' in the city of Salina. Jerry Holtz, Tree Advisory Board Chairman, read the proclamation and announced upcoming events. (4.2) The day of May 2, 2013 as "National Day of Prayer" in the city of Salina. Val Johnson, National Day of Prayer Committee Co -Chair, read the proclamation and announced upcoming events. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of April 8, 2013. (6.2) Resolution No. 13-6997 appointing members to the Library Board. 13-0121 11 Moved by Commissioner Crawford, seconded by Commissioner Householter, to approve the consent agenda as presented. Aye: (5). Nay: (0). Motion carried. DEVELOPMENT BUSINESS None. ' ADMINISTRATION (8.1) Second reading Ordinance No. 13-10691 amending the Salina Code by repealing Chapter 32 entitled Sales. Mayor Jennings noted that Ordinance No. 13-10691 was passed on first reading on April 8, 2013 and since that time no comments have been received. 13-0122 Moved by Commissioner Householter, seconded by Commissioner Shirley, to adopt Ordinance No. 13-10691 on second reading. A roll call vote was taken. Aye: (5) Angell, Crawford, Householter, Shirley, Jennings. Nay: (0). Motion carried. (8.2) Second reading Ordinance No. 13-10692 amending the Salina Code by re -codifying Chapter 31 entitled Public Utilities as Chapter 32. Page 1 Mayor Jennings noted that Ordinance No. 13-10692 was passed on first reading on April 8, 2013 and since that time no comments have been received. 13-0123 Moved by Commissioner Crawford, seconded by Commissioner Shirley, to adopt Ordinance No. 13-10692 on second reading. Motion carried. w y (8.3) Second reading Ordinance No. 13-10693 amending the Salina Code by adding Chapter 31 pertaining to Property Maintenance. g Mayor Jennings noted that Ordinance No. 13-10693 was passed on first reading on April 8, 2013 and since that time no comments have been received. Michael Schrage, Deputy City Manager, summarized the amendments to the ordinance between first and second reading. 13-0124 Moved by Commissioner Householter, seconded by Commissioner Shirley, to adopt Ordinance No. 13-10693 on second reading. A roll call vote was taken. Aye: (3) Crawford, Householter, Shirley. Nay: (2) Angell, Jennings. Motion carried. (8.4) Second reading Ordinance No. 13-10694 amending Section 38-1 of the Salina Code providing a local amendment to the Standard Traffic Ordinance. Mayor Jennings noted that Ordinance No. 13-10694 was passed on first reading on April 8, 2013 and since that time no comments have been received. Michael Schrage, Deputy City Manager, summarized the amendments to the ordinance between first and second reading. Mr. Schrage then responded to Commissioner Angell's question regarding overflow parking. 13-0125 Moved by Commissioner Shirley, seconded by Commissioner Householter, to adopt Ordinance No. 13-10694 on second reading. A roll call vote was taken. Aye: (4) Angell, Crawford, Householter, Shirley. Nay: (1) Jennings. Motion carried. ' City Manager Jason Gage explained that Ordinance No. 13-10688 was presented to the City Commission last meeting for consideration. The ordinance was a housekeeping item by moving chapter 30.5 into chapter 17, and would allow the chapters to re realigned in the existing code. 13-0126 Moved by Commissioner Householter, seconded by Commissioner Angell, to add Ordinance 13-10688 to the agenda. Aye: (5). Nay: (0). Motion carried. 13-0127 11 Moved by Commissioner Householter, seconded by Commissioner Shirley, to pass Ordinance No. 13-10688 on first reading. Aye: (5). Nay: (0). Motion carried. OTHER BUSINESS (9.1) Comments from outgoing City Commissioner Angell. Commissioner Angell noted achievements of the Kenwood -Oakdale Parks resolution and the consent decree for the ground water contamination at the former Schilling Air Force Base. She also thanked her family, City staff, Chamber of Commerce, Saline County, USD 305, commissioners she has served, and the voters. (9.2) Comments from Mayor Jennings at the end of his mayoral term. Mayor Jennings felt that it was a challenging four years; appreciative for all the ' different perspectives and that we are a community that values our citizens and businesses. Serving as a commissioner came with some sacrifices; however, thankful for the opportunity and support received. ORGANIZATIONAL MEETING (10.1) City Clerk administers Oaths of Office to new Commissioners. (10.2) Organizational meeting is called to order and roll call taken. Those present: Commissioners Jon R. Blanchard, Kaye J. Crawford, Randall R. Hardy, Aaron Householter, and Barbara V. Shirley (10.3) Nominations for Mayor and Chairman of the Board of Commissioners. (10.6) Mayor Shirley presented a "Plaque of Appreciation" to Samantha Angell for her term as City Commissioner. (10.7) Mayor Shirley presents a "Plaque of Appreciation" and gavel to Norman Jennings for his term as Mayor and City Commissioner. (10.8) New mayoral comments. Mayor Shirley thanked her family, voters, staff and past commissioners. She continued to express her enthusiasm for the future and working with the new commission.
