ORDINANCE NUMBER 13-10690 AN ORDINANCE ESTABLISHING A KENWOOD COVE MULTI-YEAR CAPITAL IMPROVEMENTS FUND. w BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Fund Established. In accordance with K.S.A. 12-1,118, there is hereby established a multi- year capital improvements fund to be entitled "Kenwood Cove Improvement Reserve Fund". 3 Section 2. Purpose limited. The Kenwood Cove Improvement Fund shall be used only for the construction, repair, replacement, rehabilitation, alteration, installation, acquisition, or fabrication of Kenwood Cove capital facilities and as authorized by K.S.A. 12-1,118. This may include: A. Aquatics facility infrastructure repair, replacement and rehabilitation, including but not limited to pumps, piping, control panels and devices, electronics, buildings, and structural features. B. Fixed or portable equipment provided that such equipment is dedicated solely to the operation of Aquatics facility. C. Professional services contracts directly related to the primary purpose of the fund, including preliminary engineering, design and feasibility studies. D. Other contractual services related to the primary purpose of the fund. E. Acquisition of real estate, improvements to real estate, and related personal property necessary to accomplish the purpose of the fund. Work performed pursuant to the purposes of the Fund may be performed by the City, or contracted to others. However, fund resources shall not be used for payment of salary or benefits paid directly by the City of Salina to its employees, nor shall they be used to pay normal operating expenses of the City. Section 3. Monies for the Fund. Monies for the fund may be provided through budgeted transfers from the Special Sales Tax fund, from Bond and Temporary Note proceeds, special assessments, reimbursements from other funds of the City of Salina, reimbursements or contributions from private and public agencies, or State or Federal Aid. Section 4. Annual Budget not Required. Pursuant to KSA 12-1,118, resources of the fund shall not be subject to the annual budget process. Section 5. Effective. This ordinance shall be in full force and effect from and after its adoption and publication by the following summary once in the official city newspaper.
