ORDINANCE NUMBER 13-10689 AN ORDINANCE ESTABLISHING A SOLID WASTE SYSTEM MULTI-YEAR CAPITAL IMPROVEMENTS FUND. w BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Fund Established. In accordance with K.S.A. 12-1,118, there is hereby established a multi- ' $ year capital improvements fund to be entitled "Solid Waste Improvement Fund". U Section 2. Purpose limited. The Solid Waste Improvement Fund shall be used only for the construction, repair, rehabilitation, alteration, installation, acquisition, or fabrication of Solid Waste capital improvements as enumerated in the City of Salina Capital Improvements Program and as authorized by K.S.A. 12-1,118. This may include: A. Solid Waste infrastructure including, but not limited to construction and closure of solid waste disposal cells. B. Major equipment necessary to implement the purposes of the Solid Waste disposal system, as identified in the Capital Improvements Program C. Fixed or portable equipment, including vehicles, provided that such equipment is dedicated solely to the operation of Solid Waste facilities. D. Professional services contracts directly related to the primary purpose of the fund, including preliminary engineering, design and feasibility studies. E. Other contractual services related to the primary purpose of the fund. F. Acquisition of real estate, improvements to real estate, and related personal property necessary to accomplish the purpose of the fund. G. Payment of principal, interest and related costs of debt issued for water and wastewater ' improvements, either directly or through transfers to the Bond and Interest Fund. Work performed pursuant to the purposes of the Fund may be performed by the City, or contracted to others. However, fund resources shall not be used for payment of salary or benefits paid directly by the City of Salina to its employees, nor shall they be used to pay normal operating expenses of the City. Section 3. Monies for the Fund. Monies for the fund may be provided through budgeted transfers from the Solid Waste Operating fund, from Bond and Temporary Note proceeds, special assessments, reimbursements from other funds of the City of Salina, reimbursements or contributions from private and public agencies, or State or Federal Aid. Section 4. Annual Budget not Required. Pursuant to KSA 12-1,118, resources of the fund shall not be subject to the annual budget process. Section 5. Effective. This ordinance shall be in full force and effect from and after its adoption and publication by the following summary once in the official city newspaper.
