AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526,
THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT
MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF
CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES

' W WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of
certain property therein, hereinafter described has been timely complied with, SO NOW,
U THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Findings.
Limiting the use of the property to C-3 uses except for the addition of outdoor equipment
display and storage maintains compatibility with the zoning and uses of nearby property.
2. Although there are residential properties on the north side of Greeley Avenue, there are no
residential dwellings that face the proposed outdoor display/storage area on the north side of the
hardware store.
The landscaping on the Waters True Value site exceeds the requirements of the City's
landscaping regulations.
4. The requested zoning change is consistent with the City's Comprehensive Plan which identifies
this property as being part of a Commercial land use area.
Section 2. Amendment. DISTRICT "PC -5", PLANNED COMMERCIAL DISTRICT. That the
' Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance
Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the
following described property be rezoned as follows, to -wit:
Lot Three (3), Block One (1) in the Replat of Lot One (1) of Surveyor's Plat No. 52 in the City of
Salina, Saline County, Kansas. The subject property is addressed as 460 S. Ohio Street.
shall become apart of DISTRICT "PC -5", PLANNED SERVICE COMMERCIAL DISTRICT.
Section 3. Conditions of Approval. The use of said described property shall be subject to all the
conditions, restrictions and limitations as made and provided for in Ordinance No. 8526, the same being
Chapter 42 of the Salina Code with reference to the PLANNED SERVICE COMMERCIAL
DISTRICT. Development of the property shall be subject to the site plan on file with the City Planning
Commission and/or City Clerk and the following conditions:
Permitted uses on the property shall be limited to equipment sales and rental with outdoor
display plus uses permitted in the C-3 district.
2. Development on the property shall be subject to the C-3 district bulk regulations and use
limitations, except that the outdoor display area on the site may exceed the floor area of the
building on the property by 132%.
3. Signage on the property shall be subject to the C-3 sign regulations.
4. The outdoor storage area north of the building shall be enclosed by architectural type fencing
with a landscape buffer as approved by City staff.
5. Development on the property, including screening of outdoor storage areas, shall conform to the
approved site development plan and landscape plan as amended.
ion 4. Repealer. That all prior ordinances in conflict herewith as they relate to the above described
estate are hereby repealed.

Ordinance No. 13-10686 Summary
On April 1, 2013, the City of Salina, Kansas, passed Ordinance No. 13-10686. The ordinance
changes the coning district classification of the Waters True Value property located at the southwest
corner of South Ohio Street and Greeley Avenue from PC -3 (Planned Shopping Center) to PC -5
(Planned Service Commercial) to allow the outdoor storage and display of rental equipment on the
