ORDINANCE NUMBER 13-10682 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO PLACE TRAFFIC CONTROL DEVICES AND REGULATE TRAFFIC GENERALLY. WHEREAS, the Kansas uniform act regulating traffic (specifically K.S.A. 8-1401, el. seq., referred to as the "Act") applies uniformly to all cities and political subdivisions through the State of Kansas, while acknowledging the power of "local authorities" to adopt additional traffic regulations which are not in conflict with the provisions of the act (K.S.A. 8-2001); x 3 WHEREAS, the City of Salina is a "local authority" as defined under the act (K.S.A. 8-1432); WHEREAS, pursuant to its authority as a city and consistent with the Act, the governing body has incorporated by reference the "Standard Traffic Ordinance for Kansas Cities," 40th Edition (2012), with certain amendments, into the Salina Code; WHEREAS, the city manager and designated city staff are well-suited to perform the regulatory functions associated with exercising the City's powers relating to traffic control in conformity with applicable state law, local ordinance, recognized standards and guidelines, and generally accepted engineering practices; and WHEREAS, the Governing Body has determined that delegating to the city manager and designated city staff the authority to regulate traffic within the City of Salina in accordance with all applicable law and recognized standards is in the best interests of public safety, public welfare, and overall administrative efficiency; SO NOW THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the Salina Code is hereby amended by adding a section to be numbered Chapter 38, Article I, Section 38-1.2 which section reads as follows: ' Sec. 38-1.2. Authority of the City Manager. The governing body delegates to the city manager the authority to place traffic signs, to designate crosswalks, to designate safety zones, to designate "no parking" zones and traffic lanes, to designate road construction zones and speed limits therein, to place traffic control devices generally, and to exercise all other acts of regulatory authority held by to the governing body under applicable law relating to traffic control as deemed to be in the best interest of public safety and welfare. Such authority shall be exercised according to the following standards and guidelines, in descending order of priority: the Standard Traffic Ordinance (as amended), the Manual on Uniform Traffic Control Devices currently approved by the State Department of Transportation, or generally accepted engineering practices. Nothing contained in this section shall be deemed to limit the authority of the governing body to regulate traffic. All traffic - control devices erected pursuant to this ordinance and not inconsistent with the provisions of state law or city ordinance are official traffic -control devices. Section 2. Summary of Ordinance for Publication. The ordinance amends Chapter 38, Article 1, of the Salina Code by adding Section 38-1.2 delegating to the city manager the authority to regulate traffic.
