AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526,
THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT
MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF

CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES
THEREOF.
' a WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of
$ certain property therein, hereinafter described has been timely complied with, SO NOW,

THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Findings.
The subject property has frontage on South Ohio Street, a busy arterial street, is larger in
area than the other C-1 zoned properties in the vicinity, has multiple tenant spaces and is
not directly adjacent tot residential properties making it suitable for C-3 zoning.
2. The requested C-3 zoning would be compatible with the zoning and land uses in the
vicinity and the character of the surrounding neighborhood.
The requested zoning change would be consistent with the City's Comprehensive Plan
which identified this property as being part of a Neighborhood Center in which the
predominant zoning is C-3.
Section 2. Amendment. DISTRICT "PC -3", PLANNED SHOPPING CENTER DISTRICT. That
the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of
Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so
that the following described property be rezoned as follows, to -wit:
A portion of Lots Twelve (12), Thirteen (13) and Fourteen (14), Block Four (4), Replat of
Schippel Addition Blocks Four (4), Five (5), and part of Block Three (3), City of Salina,
Saline County, Kansas, being more particularly described as follows:
Beginning at a point on the South line of said Lot Fourteen (14) that is Twenty-two
(22.00) feet North 89 degrees 54'46"E of the Southwest corner of said Lot Fourteen (14);
thence North 89 degrees 54'46"E along the South line and South line extended of said
Lot Fourteen (14) a distance of One Hundred Eighty-five (185.00) feet; thence North 0
degrees 13'10"W along a line parallel to the East line of said Lots Fourteen (14), Thirteen
(13) and Twelve (12) a distance of Two Hundred Thirty-five and Ten Hundredths
(235.10) feet, thence South 89 degrees 54'46"W along a line parallel to the South line of
said Lot Fourteen (14) a distance of Two Hundred Forty and Ten Hundredths (240.10)
feet; thence South 13 degrees 24'20"E along a line parallel to the West line of said Lots
Twelve (12), Thirteen (I J) and Fourteen (14), a distance of Two Hundred Forty-one and
Sixty Hundredths (241.60) feet to the point of beginning. The subject property is
addressed as 1830 S. Ohio Street.
shall become a part of DISTRICT "PC -3", PLANNED SHOPPING CENTER DISTRICT.
' Section 3. Conditions of Approval. The use of said described property shall be subject to all the
conditions, restrictions and limitations as made and provided for in Ordinance No. 8526, the same being
Chapter 42 of the Salina Code with reference to the PLANNED SHOPPING CENTER DISTRICT.
Development of the property shall be subject to the site plan on file with the City Planning Commission
and/or City Clerk and the following conditions:
1. Permitted uses on the property shall include all uses permitted in the C-3 district.
2. Permitted signage on the property shall be limited to one (1) pole or ground sign not
exceeding fifteen (15) feet in height and shall not exceed a total sign area of two hundred
(200) square feet.
Section 4. Repealer. That all prior ordinances in conflict herewith as they relate to the above described
real estate are hereby repealed.
Section 5. Summary of ordinance for publication. That this ordinance shall be in full force and
effect from and after its adoption and publication once in the official city newspaper.
Ordinance No. 13-10677 Summary
On February, 11, 2013, the City of Salina, Kansas, passed Ordinance No. 13-10677. The
w ordinance changes the zoning district classification of the Discover Dental Clinic property located
at the northwest comer of South Ohio Street and Schippel Drive from C-1 (Restricted Business)
to PC -3 (Planned Shopping Center) to expand the list of permitted uses that could go in the
building and increase the allowable sign area on the lot. A complete copy of the ordinance is

Section 6. Effective date. That this ordinance shall be in full force and effect from and after its
adoption and publication of the summary once in the official city newspaper.
