AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES AND PARCELS
OF GROUND IN THE CITY OF SALINA, KANSAS FOR THE PURPOSE OF PAYING A
PORTION OF THE COST OF CERTAIN IMPROVEMENTS IN THE CITY.

WHEREAS, the Governing Body of the City of Salina, Kansas (the "City") has authorized the following
improvements (collectively, the `Improvements") in the City to be constructed pursuant to K.S.A. 12-6a01
and K.S.A. 12-6a19 el seq.:

PROJECT NO. 10-2816 - STONE LAKE ADDITION
STREET, DRAINAGE &UTILITY IMPROVEMENTS
The installation of approximately 4,414 lineal feet of eight -inch water main, fire hydrants, valves,
fittings, service connections and all appurtenances thereto for water lines within right of way and/or
utility easement as shown on Exhibit A attached hereto, specifically excluding the portion of the
eight -inch water main located in the designated "Cost Recovery Area" shown on Exhibit A (the "8"
Waterline Improvements").
The installation of approximately 390 lineal feet of twelve -inch water main, fire hydrants, valves,
Fittings, service connections and all appurtenances thereto for water lines within right of way and/or
utility easement to be constructed from Ohio Street east as shown on Exhibit A attached hereto (the
"North 12" Waterline Improvements").
The installation of approximately 779 lineal feet of twelve -inch water main, fire hydrants, valves,
fittings, service connections and all appurtenances thereto for water lines within right of way and/or
utility easement to be constructed from Shoreline Drive south to Schilling Road as shown on Exhibit
A attached hereto (the "South 12" Waterline Improvements").
The installation of curb & gutter, pavement, and grading for Shoreline Drive from Ohio Street east
approximately 190 lineal feet, including four lanes with a center median (the "Entrance Boulevard
Street Improvements").
The installation of curb & gutter, pavement, and grading for approximately 2,400 lineal feet of
Shoreline Drive (the "Street Improvements").
The installation of approximately 847 lineal feet of storm sewer, inlets, and all appurtenances thereto
for storm sewer lines lying within right of way and/or drainage easement, (the "Storm Sewer
Iinprove ments").
The installation of approximately 1,911 lineal feet of eight -inch sanitary sewer main, service
connections, manholes and all appurtenances thereto for sanitary sewer lines lying within right of
way and/or utility easement to be constructed as shown on Exhibit A attached hereto (the "8" Sewer
Line Improvements").
The installation of approximately 595 lineal feet of fifteen -inch sanitary sewer main, service
connections, manholes and all appurtenances thereto for sanitary sewer lines lying within right of
way and/or utility easement to be constructed as shown on Exhibit A attached hereto (the "15" Sewer
Line Improvements").
Various general and miscellaneous improvements related to all of the foregoing, including but not
limited to clearing and grubbing, common excavation, compaction of earthwork, temporary slope
barrier and other temporary construction requirements, permanent seeding, construction staking, and
traffic control and barricades (the "General and Miscellaneous Improvements")
(collectively, the "Improvements").
WHEREAS, the total costs of such improvements have been determined; the Governing Body has
caused the assessments against each lot, piece or parcel of land deemed to be benefited by such
improvements, to be determined in the manner set forth in the resolutions as to advisability of the
improvements provided for pursuant to K.S.A. 12-6a04; and an assessment roll has been prepared; and
WHEREAS, such assessment roll was filed with the City Clerk and has been open to public inspection;
and
WHEREAS, the Owners hereby further state that the Owners have received a copy of the Statement
of Final Costs and Assessment Roll Certification relating to the Improvements and the Owners hereby agrees
to the following: (1) Waiver of formal notice of and the holding of a public hearing by the governing body of
the City for the purpose of considering special assessments against the Property; (2) Consent to the levy of
special assessments against the Property in the amounts hereinafter described (the "Special Assessment") by
appropriate proceedings of the governing body of the City; (3) Waiver of the thirty (30) day period after
publication of the assessment ordinance of the City to contest the levy of the Special Assessment; and (4)
Consent that the City may immediately proceed to issue its general obligation bonds to finance the costs of
a the Improvements in accordance with K.S.A. 12-6a01 et seq.

Section 2. The special assessments provided for in Section I of this Ordinance shall be certified by
the City Clerk to the County Clerk in the same manner and at the same time as other taxes are certified. The
assessments and will be collected in fifteen (15) equal annual installments, together with interest on such
amounts at a rate not exceeding the maximum rate therefore as prescribed by the Act. The first installment
shall become due with the first payment of general property taxes for the year 2013. Interest on the assessed
amount remaining unpaid between the effective date of this Ordinance and the date the first installment is
payable, but not less than the amount of interest due during the coming year on any outstanding bonds issued
to finance the Improvements, shall be added to the first installment. The interest for one year on all unpaid
installments shall be added to each subsequent installment until paid.
Section 3. The owner of any piece or parcel of property liable for any such assessments may redeem
his property, in whole or in part, from such liability by paying to the City Treasurer the entire amount, or a
portion thereof, chargeable against said property, at any time on or before February 4, 2013, and to the extent
of any such payment, the property so paid on shall not thereafter be liable for any further assessments for the
cost of said improvements, nor for any interest due thereon.
Section 4. This ordinance shall be published by the following summary:

On February 4, 2013, the City of Salina, Kansas, passed Ordinance No. 13-10673. The
ordinance levies special assessments to pay the cost of street, drainage and utility
improvements in the Stone Lake Addition. A complete copy of the ordinance is available at
www.salina-ks.gov or in the office of the city clerk, 300 W. Ash Street, free of charge. This
summary is certified by the city attorney.

Section 2. The special assessments provided for in Section I of this Ordinance shall be certified by
the City Clerk to the County Clerk in the same manner and at the same time as other taxes are certified. The
assessments and will be collected in fifteen (IS) equal annual installments, together with interest on such
amounts at a rate not exceeding the maximum rate therefore as prescribed by the Act. The first installment
shall become due with the first payment of general property taxes for the year 2013. Interest on the assessed
amount remaining unpaid between the effective date of this Ordinance and the date the first installment is
payable, but not less than the amount of interest due during the coming year on any outstanding bonds issued
to finance the Improvements, shall be added to the first installment. The interest for one year on all unpaid
installments shall be added to each subsequent installment until paid.
Section 3. The owner of any piece or parcel of property liable for any such assessments may redeem
his property, in whole or in part, from such liability by paying to the City Treasurer the entire amount, or a
portion thereof, chargeable against said property, at any time on or before February 4, 2013, and to the extent
of any such payment, the property so paid on shall not thereafter be liable for any further assessments for the
cost of said improvements, nor for any interest due thereon.
