01-15-1991 MinutesAction 91-027 CITY OF SALINA, KANSAS SPECIAL MEETING OF THE BOARD OF COMMISSIONERS JANUARY 15, 1991 4:00 p.m. The Special Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Tuesday, January 15, 1991 at 1:00 p.m. There were present: Mayor Robert E. Frank, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Stephen C. Ryan Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Robert K. Biles, Director of Finance and Administration Peter Brown, Public Information Officer Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: None The meeting was called for the purpose of conducting a "Show Cause" Hearing relating to violation of the Salina Cable Television franchise pursuant to K.S.A. 12-2011. Greg Bengtson, City Attorney, acted as the hearing officer. Peter Brown, Public Information Officer, reviewed the history of the hearings held to this time and presented the City's information relating to the noticed Salina Cable Television franchise violation. Ernest Cole, 153 South Front, said citizens have been overcharged and the overcharge should be repaid. Randy Bang, State Manager of TCI, presented charts and graphs relating to the cable franchise and general cable operations. Paul Glist, legal counsel for TCI, presented the franchisee's position relating to the noticed franchise violation. Joseph Van Eaton, Special Counsel to the City on cable television issues, spoke to the City's position. The following persons appeared and commented on the proceedings: William Frank Schwarz, Jr., 803 Park; William Johnson, 524 South Fourth; Ernest Cole, 153 South Front; Jim Torrey, 1006 East Ellsworth; Wilber Davis, 317 West Jewell; and Larry Wood, vice president of TCI North Central Division. A record of the proceedings was made by a certified court reporter and is incorporated herein by reference. Moved by Commissioner Ryan, seconded by Commissioner Warner and Beggs that the Special Meeting of the Board of Commissioners be adjourned. Aye: (5). Nay: (0).
