12-17-1990 MinutesAction 90-454 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS DECEMBER 17, 1990 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, December 17, 1990, at 4:00 p.m. There were present: Mayor Robert E. Frank, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Stephen C. Ryan Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: None CITIZEN FORUM Mayor Frank introduced Jim Hill, the newly appointed Chief of Police. Mr. Hill said he is looking forward to coming to Salina the middle of January. AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the week of December 22 through 28, 1990 as "WINTER PREPAREDNESS WEEK." The proclamation was read by Gail Aills, Civil Preparedness Director. (4.2) The Mayor proclaimed the week of December 31, 1990 through January 4, 1991 as "SOUTH-CENTRAL HIGH SPIRIT WEEK." The proclamation was read by Brian Mills, Salina South Student Council President and Todd Davidson, Central High Student Body President. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting December 10, 1990. Moved by Commissioner Ryan, seconded- by Commissioner Divine that the consent agenda item be approved. Aye: (5) . Nay: (0) . Motion adopted. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 90-18, filed by Darrell and Kleo Francisco, for the rezoning of Lots 5, 8 and 9, Block 19, Sunset Manor Addition, be approved. [Introduce Ordinance Number 91-9420 for first reading] Roy Dudark, Director of Planning and Community Development reviewed the application. Action 90-455 Moved by Commissioner Warner, seconded by Commissioner Beggs that the recommendation of the City Planning Commission be accepted, that Zoning Application 90-18 be approved and that Ordinance Number 91-9420, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be introduced for first reading. Aye: (5). Nay: (0). Motion adopted. (7.2) Manufactured Home PDD issue. Planned Development District Application 90-2, filed by D and B Investments for the rezoning of Lots 11, 13, 15, 17, 19, 21, 23, Block 27, Episcopal Military Institute Addition. (7.2a) Second Reading Ordinance Number 90-9418, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof. Roy Dudark, Director of Planning and Community Development, reviewed the application and recommendation from the City Planning Commission and said if the City Commission moves to adopt Ordinance Number 90-9418, it will require passage by a 4/5 vote. Bob Gile, 838 Fairdale Road, gave the Commissioners handouts and discussed financing for manufactured homes. He said he could build a 14' x 50' house on the lot now, and that he is willing to reduce the number of units to 6 with the other requirements in the PDD. Rose Base, 1205 North Third, presented a scale model of the proposed PDD development. John Samples, President of Kenbuilt, Inc., Osage City, Kansas, reviewed the differences in manufactured homes, UBC modular homes and pre -site construction homes. He expressed concern that the City Commission is opening pandora's box in that if one builder is allowed to place these homes, others would expect to do the same thing. Cornell Hutton, 1329 North Front, presented pictures of a dilapidated 2 year old manufactured home. Fie asked the City Commission not to allow structures which vary from city standards by 75% and do not meet UBC or NEC standards. He said the neighbors do not want substandard housing in the neighborhood. He suggested the creation of a task force to deal with developing the area. Daniel J. Huell, President of Kansas Mobile Homes and Country Oaks Development said financing manufactured homes in the new Country Oaks area has been very difficult. Mrs. Brotherton, 420 East Otis, objected to manufactured homes being allowed in this area when she was not allowed to place one on her lot. James Price, 326 South Oakdale, said he lived in a mobile home for 20 years and sold it for nearly as much as the purchase price. Joyce Gile, D & B Investments, agreed to reducing the number of units from 7 to 6. She discussed the financing available for manufactured units and said they can be financed with 5% down, the same as other housing. Steve Johnson, 1017 North Third, said he lives in a 1954 12 x 50' mobile home and you can't find one flaw in it. He said it is not easy to insure. He said if the City Commission allows this development, there will be manufactured homes from Pacific to Hamilton. Harold Larson, land owner in the north end, said there are 43 vacant lots, not including the Gile lots. There are 169 residents. If manufactured homes are allowed in this development, it would be spot zoning. If the City Commission decides it is a good idea, it should be a good idea for any area in tow n. Action 90-456 �90-457 90-458 91-459 90-460 Moved by Commissioner Divine that Ordinance Number 90-9418, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. Commissioner Ryan seconded the motion and asked that the findings of fact in the staff report be listed, that it must be realized this is an unusual and exceptional case and that these findings of fact would be required in any future action. Moved by Commissioner Divine, seconded by Commissioner Warner that the Commission recess for 5 minutes to discuss amendments with staff and legal counsel. The Board of Commissioners recessed at 6:20 p.m. and reconvened at 6:25 p.m. Moved by Commissioner Warner that the motion on the floor be amended to reduce the number of lots or units from 7 to 6, that the site plan be revised accordingly, that the units must have a 20' minimum width and that condition 2 be revised accordingly. Commissioner Divine asked that the amendments be considered separately. Commissioner Divine seconded the motion to amend the units from 7 to 6. The Mayor called for a vote on Commission Action 90-458. Aye: Beggs, Divine, Ryan, Warner, (4) . Nay: Frank (1 ) . Motion adopted. Moved by Commissioner Warner, seconded by Mayor Frank that units have a 20' minimum width and that condition 2 be revised accordingly. Aye: Warner, Frank (2). Nay: Divine, Ryan (2). Commissioner Beggs abstained. Motion defeated. Commissioner Warner called for a vote on Commission Action 90-456, Aye: Divine, Ryan, Warner, (3). Nay: Beggs, Frank (2). Motion defeated. ADMINISTRATION (8.1) Report on bids received December 11 , 1990 for a Solid Waste Building. [ Reject all bids.] Frank Weinhold, Director of General Services, reviewed the bids received and said the bids exceeded the architect's estimate and asked the City Commission to reject all bids. Moved by Commissioner Warner, seconded by Commissioner Ryan that the recommendation of the Director of General Services be accepted, and that all bids be rejected. Aye: (5) . Nay: (0) . Motion adopted. (8.2) Report on bids received December 11 , 1990 for Engineering Project 90-815 for 1990 Water main improvements. [Award the contract to Stevens Contractors, Inc. in the amount of $42,218.] received. Don Hoff, Director of Engineering and Utilities, reported on the bids 90-461 Moved by Commissioner Ryan, seconded by Commissioner Divine that the recommendation of the City Engineer be accepted and that the contract be awarded to Stevens Contractors, Inc., in the amount of $42,218. Aye: (5). Nay: (0) . Motion adopted. (8.3) Report on bids received December 11 , 1990 for Engineering Project 90-816 for a metal frame building for Central Garage. [Award the contract to Salina Building Systems, Inc. in the amount of $31,9681 Frank Weinhold, Director of General Services, reported on the bids received. Action 90-462 90-463 90-464 90-465 90-466 Moved by Commissioner Divine, seconded by Commissioner Warner that the recommendation of the City Engineer be accepted and that the contract be awarded to Salina Building Systems, Inc. in the amount of $31,968. Aye: (5). Nay: (0) . Motion adopted. (8.4) Report on bids received December 11, 1990 for Engineering Project 90-819 for curb and gutter replacement. [Award the contract to Wilson Constructors, Inc. in the amount of $ 46,915.00.1 Moved by Commissioner Warner, seconded by Commissioner Ryan that the recommendation of the City Engineer be accepted and that the contract be awarded to Wilson Constructors, Inc. in the amount of $46,915.00. (8.5) Second Reading Ordinance 90-9217, amending the budget of the City of Salina for the year beginning January 1, 1990 by amending Section 2 of Ordinance Number 89-9340 in accordance with K.S.A. 79-2929a. [Amending the 1990 Parks and Recreation Budget] Moved by Commissioner Ryan, seconded by Commissioner Divine that Ordinance Number 90-9217, amending the budget of the City of Salina for the year beginning January 1, 1990 by amending Section 2 of Ordinance Number 89-9340 in accordance with K.S.A. 79-2929a, be adopted. (8.6) Second Reading Ordinance Number 90-9419, amending Section 42-552 of the Salina Code pertaining to standards for off-street parking; and repealing the existing section. Roy Dudark, Director of Planning and Community Development reviewed the application and amendment to the Salina Code section. Moved by Commissioner Ryan, seconded by Commissioner Dudark that Ordinance Number 90-9419, amending Section 42-552 of the Salina Code pertaining to standards for off-street .parking; and repealing the existing section, be adopted. (8.7) First Reading Ordinance 91-9421, amending Chapter 39 of the Salina Code regulating the planting, maintenance, treatment and removal of trees and shrubbery upon all streets, alleys, avenues, boulevards and parkings within the City of Salina, and repealing the existing chapter. Steve Snyder, Director of Parks and Recreation, reviewed the amendment to Chapter 39 of the Salina Code. Bob Ash, City Forester, discussed public tree selection. Gordon Horst, 920 South Ninth, asked for clarification of the $500 fine which may be imposed. City staff explained this is the normal fine for misdemeanor offences. (8.8) First Reading Ordinance 91-9422, amending Section 38-87 of the Salina Code relating to authorization and procedures to abate the nuisance of inoperable vehicles, and repealing the existing section. Mike Peterson, Chief Building Official, reviewed the amendment to the Salina Code section regarding the inoperable vehicle nuisance. Moved by Commissioner Ryan, seconded by Commissioner Divine that .Ordinance 91-9421, amending Chapter 39 of the Salina Code regulating the planting, maintenance, treatment and removal of trees and shrubbery upon all streets, alleys, avenues, boulevards and parkings within the City of Salina, and repealing the existing chapter, be introduced for first reading. Steve Snyder, Director of Parks and Recreation, reviewed the 1991 Capital Improvement projects and asked for City Commission approval of projects for the Park Department in the amount of $75,000 and for Recreation in the amount of $47,500. Moved by Commissioner Divine, seconded by Commissioner Ryan that the 1991 Capital Improvement Projects for the Parks and Recreation Department be approved with $75,000 for the Parks and $47,500 for the Recreation. Aye: (5). Nay: (0). Motion adopted. (8.10) City Commission consideration of 1991 employee compensation changes. (Includes proposed health insurance benefit change and pay plan adjustment for all employees) Dennis M. Kissinger, City Manager, explained the compensations to be considered and asked for City Commission approval. Moved by Commissioner Warner, seconded by Commissioner Ryan that the City paid portion of the health insurance premium be increased in an amount that will maintain the employee paid portion at its 1990 level. Moved by Commissioner Warner, seconded by Commissioner Divine that pay increase of 3% for all classified full time and classified part time employees be approved. Aye: (5). Nay: (0). Motion adopted. (8.11) Consideration of 1991 vehicles and equipment program. Bob Biles, Director of Finance and Administration, reviewed the vehicles and equipment to be purchased in 1991. Moved by Commissioner Ryan, seconded by Commissioner Divine that the City Commission approve the 1991 vehicles and equipment program. Aye: (5). Nay: (0). Motion adopted. (8.12) Set the date of January 22, 1991 as the date to receive bids on aerial photographs for the Salina urban area. Moved by Commissioner Warner, seconded by Commissioner Ryan that January 22, 1991 be set as the date to receive bids for aerial photographs for the Salina urban area. Aye: (5). Nay: (0). Motion adopted. OTHER BUSINESS Mayor Frank announced there will be no City Commission Meeting on December 24 or December 31, 1990. Mayor Frank wished everyone happy holidays.
