04-08-1991 Minutes91-133 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS APRIL 8, 1991 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, April 8, 1991, at 4:00 p.m. There were present: Mayor Robert E. Frank, Chairman presiding Commissioner Carol E. Beggs Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: Commissioner Divine Commissioner Ryan City Attorney Greg Bengtson None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Month of April, 1991 as "FAIR HOUSING MONTH." The proclamation was read by Will Burnett, Human Relations Director. h PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting April 1, 1991. (6.2) Set the date of April 30, 1991 to receive bids for Engineering Project 91-827 for the Smoky Hill River Development, Phase II, for the clean up of the river channel from Walnut Street to Iron Avenue by volunteer and City forces, enhanced landscaping at Founder's Park (next to Community Theatre) and dredging of the channel from Iron Avenue to the Mill Dam. (6.3) Set the date of April 30, 1991 to receive bids for Engineering Project 91-828 for construction of restroom facilities at Lakewood and Centennial Parks. (6.4) Set the date of April 16, 1991 to receive bids for Engineering Project 91-831 for backstop and fencing at the East Crawford Recreation Area practice diamond. (6.5) Set the date of April 30, 1991 to receive bids for certain vehicles and equipment purchase, authorized for the second quarter 1991. (6.6) Authorize the City Clerk to issue Taxi Cab License #8 to Radio Cab/Yellow Taxi. Moved by Commissioner Warner, seconded by Commissioner Beggs that all items on the Consent Agenda be approved. Motion adopted. 91-134 91-135 91-136 None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second Reading Ordinance Number 91-9434, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof. (Z91-2, filed by Roger Mattison, for the rezoning of Lots 1,2,3 less the West 24.625 feet, Block 9, Meyer Addition to District R-2). Moved by Commissioner Beggs, seconded by Commissioner Warner that Ordinance Number 91-9434, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. (8.2) Second Reading Ordinance Number 91-9435, authorizing issuance of a Request for Proposals, setting dates for response, establishing standards for review of Salina Cable TV's request for a franchise renewal, establishing procedures and standards for receiving and reviewing franchise applications by others, establishing legal qualifications for a franchise, and requiring that any cable system obtain a franchise. Peter Brown, Public Information Officer, explained that this Ordinance is not intended to exclude anything, but rather to open the market by complying with the new Cable TV Act regulations. Moved by Commissioner Warner, seconded by Commissioner Beggs that Ordinance Number 91-9435, authorizing issuance of a Request for Proposals, setting dates for response, establishing standards for review of Salina Cable TV's request for a franchise renewal, establishing procedures and standards for receiving and reviewing franchise applications by others, establishing legal qualifications for a franchise, and requiring that any cable system obtain a franchise, be approved for second reading. (8.3) First Reading Ordinance Number 91-9436, relating to certain licenses issued by the City and repealing Sections 6-1, 6-76, 6-77, 6-86, 6-87, 6-88, 6-89, 6-90, 6-91, 6-92, 6-106, 6-116, 6-117, 6-118, 6-119, 6-141, 6-142, 6-143, 6-144, 6-156, 6-157, 6-158, 6-159, 6-166, 6-167, 6-168, 6-169, 6-170, 40-16, 40-17, 40-18, 40-19, 40-20, 40-21, 40-22, 40-23, 40-24, 40-25, 40-26, 40-27, 40-28, 40-29, 40-30, and Chapter 7.5 of the Salina Code. Dennis Kissinger, City Manager, explained this is the first phase in deregulating certain occupational licenses that can no longer be justified for public purpose. He said all licenses are being reviewed as well as the requirements for each license. He said after the ordinances have been adopted, 1991 license fees will be pro -rated and refunded to those who purchased a 1991 license which is deregulated. He said the review process will continue through the summer. Ernest Cole, 153 S. Front, said he favors deleting these licenses and asked staff to review Salina Code Section 3.1 dealing with advertising material being attached to automobile windshields. Moved by Commissioner Beggs, seconded by Commissioner Warner that Ordinance Number 91-9436, relating to certain licenses issued by the City and repealing Sections 6-1, 6-76, 6-77, 6-86, 6-87, 6-88, 6-89, 6-90, 6-91, 6-92, 6-106, 6-116, 6-117, 6-118, 6-119, 6-141, 6-142, 6-143, 6-144, 6-156, 6-157, 6-158, 6-159, 6-166, 6-167, 6-168, 6-169, 6-170, 40-16, 40-17, 40-18, 40-19, 40-20, 40-21, 40-22, 40-23, 40-24, 40-25, 40-26, 40-27, 40-28, 40-29, 40-30, and Chapter 7.5 of the Salina Code, be introduced for first reading. Motion adopted. 91-137 4a 91-139 91-140 91-141 (8.4) First Reading Ordinance Number 91-9437, amending Section 28-1 of the Salina Code regarding the licensing of ice cream vendors and itinerant canvassers, and repealing the existing section. Moved by Commissioner Beggs, seconded by Commissioner Warner that Ordinance Number 91-9437, amending Section 28-1 of the Salina Code regarding the licensing of ice cream vendors and itinerant canvassers, and repealing the existing section, be introduced for first reading. (8.5) Report on bids received March 19, 1991 for Engineering Project 91-824 for the construction of a restroom/concession facility at the premier baseball field located at the East Crawford Recreation area. (Award the contract to Don Vancil Construction in the amount of $55,900.). Dennis Kissinger, City Manager, said staff had not received the private funding on this project and recommended this item be tabled until April 15, 1991. (8.6) Resolution Number 91-4291, authorizing the Mayor to execute an agreement with Daktronics, Inc. of South Dakota to upgrade the four-sided scoreboard, add a new ticket area message center and change control systems to modernize the system. Dennis Kissinger, City Manager, said staff received some additional information and asked that this item be tabled until April 15, 1991. (8.7) Resolution Number 91-4292, making appointments to the Heritage Conservation Commission. Motion adopted. OTHER BUSINESS Commissioner Beggs urged citizen participation in a jointly sponsored program on the prevention of child abuse on Saturday, April 13, 1991. Mayor Frank thanked those citizens who participated in free landfill day on April 7th and the clean up of Salina.
